HomeMy WebLinkAbout800617.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #452 - STANLEY AND MARY JANE BEDAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 6th day of August, 1980 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 452 , being the property of Stanley and Mary Jane Bedan, described as part of the Northwest Quarter of Section 6, Township 4 North, Range 65 West of the 6th P .M. , Weld County, Colorado, being more particularly described as follows does not come within the purview of the definition of the terms "subdi- vision" and "subdivided land", pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended: All that part of the Northwest Quarter of Section 6, Township 4 North, Range 65 West of the 6th P.M. , more particularly described as follows: BEGINNING at a point on the West right of way line of State Highway from whence the North Quarter corner of said Section 6 bears North 15°46 ' East 1296 . 0 feet; running thence North 74°46 ' West 152. 00 feet; thence South 33°15 ' West 247. 7 feet; thence South 53°43 ' East 152 . 0 feet to the West right of way line of the Union Pacific Railroad; thence North 36°17 ' East 242 . 0 feet along said West right of way line of the Union Pacific Railroad to its intersec- tion with the West right of way line of the State Highway; thence North 15°14 ' East 64 . 0 feet along the West right of way line of the State Highway to the place of BEGINNING, containing 1. 0 acres, more or less, ALSO: The premises described as follows, to-wit: BEGINNING at the Northwest corner of a tract of land conveyed to E. This zone change could result in a significant increase in turning movements at the existing access to the service road. This service road is very close to the main lanes of U.S. 85 and this results in a limited turning radius, especially for tandem trucks. The increase in right-turn movements will result in conflicts due to the location of the service road access in relation to the highway. To improve this access situation, it is suggested that the northern driveway onto the service road be moved to align with the highway access opening. It would also be helpful to provide an unobstructed, 25-foot-wide strip along the west property line. This area would allow for the separation of the service road from the main lanes of U.S. 85 in the event that it becomes necessary to provide a larger turning radius in the future. Left turns from U.S. 85 into this site will also result in conflicts on the high- way. Even though there are two southbound travel lanes , there is no left-turn slot available for protected left turns. Stopped, left-turning vehicles will present a hazard to accelerating vehicles heading south from La Salle. 2. Any development of this property for industrial purposes should take into con- sideration the potential impacts of increased surface runoff. If any increase in runoff is to be directed toward U.S. 85, we ask that on-site measures be taken to maintain the historical runoff contribution from this site. 3. The service road serving this property is located within U.S. 85 right of way. Proper authorization must be obtained from this office if any work is planned which affects this road. Due to the small lot size and the fact that one well already exists on the one acre, we doubt that an additional permit could be issued under existing statutes. Also, required spacing between wells and septic tank-leach fields may not be possible. The existing well is for domestic use, and could not be used for commercial purposes without inclusion in an approved plan for augmentation.
