(Department of Public Health and Environment) 2. The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S.flood plain policy. In accordance with the Colorado I.S.D.S. Regulations, no septic systems shall be installed within the floodway. 3. All conditions of reclamation are to be verified and approved by Weld County prior to abandonment of mining operations. We have been working with the County to satisfy all Use by Special Review requirements, and at a meeting with you on February 7, 2002 we established a course of action to resolve all outstanding conditions for plat recording. This transmittal contains several important piece of documentation required by Weld County, and it summarizes the steps taken to finalize the plat recording. Since the February 7th meeting, the following actions have been taken to address outstanding conditions: • The land owner signature on sheet 1 of the USR mylar plat set has been completed by George Steven Fancher of Loveland Ready Mix Concrete, Inc. • Extensive research and a letter to Weld County were undertaken in our effort to meet County requirements for the approval of the Flood Hazard Development Permit (Condition 2B). As a result, a new floodplain model is being prepared. With clarifications provided by the County, this model will satisfy Weld County FHDP approval criteria; submittal to the County is anticipated next week. • Two Improvements Agreements (Conditions 2D and 2M) are enclosed. These Improvements Agreements each have an associated Performance Bond (Le. collateral, in satisfaction of Condition 2M), and each has been reviewed and approved by Weld County staff. The public improvements agreement is attached under Insco Bond No. 880900S, and the private improvements agreement is attached under Insco Bond No. 880901 S. Riders correcting the address listed on the bonds have been included at the request of the County Attorney's Office. These documents should be forwarded to the Board of County Commissioners for acceptance as soon as possible. • A letter from Larimer County Engineering, stating their satisfaction with Loveland Ready Mix's efforts to address their concerns (Condition 2O), is enclosed. Green/Croissant Sand and Gravel Mine(USR-1329) Satisfaction of Rat Recording Conditions 5 March 2002 Page 2 These enclosures resolve all outstanding conditions for plat recording, with the exception of the approval of the Flood Hazard Development Permit. Believing that we are close to a resolution of the floodplain issues, we are transmitting all mylars and the appropriate fee for plat recording (Banks and Gesso, LLC check no. 7668, in the amount of $70.00). We will advise you of the progress of the FHDP, and request that documents be prepared for plat recording as soon as it is appropriate. Our joint discussions with the Applicant and Weld County Public Works satisfactorily resolved all design issues,including turn lanes,tapers, and pavement. In addition, it was determined that additional right- of-way would be needed on the Larimer County side of the LCR 18/WCR 54 at WCR 13 intersection. Loveland Ready Mix has successfully negotiated for,and is in the process of acquiring, this right-of-way; this purchase will be credited to the Applicant and is estimated to be approximately equal to the contribution to the Larimer County Capital Expansion fee originally requested. This project has been a successful collaboration between Larimer and Weld Counties, and we have been pleased with the efforts made by Loveland Ready Mix to address the concerns of Larimer County. Robert Anderson Weld County Department of Planning Services — x,`22 1555 N. 17th Avenue Greeley, CO 80631 5e RECEIVED Dear Mrderson, On behalf of Loveland Ready Mix Concrete, Inc., this letter requests recording of the mylar Use by Special Review' plat sheets for USR-1329 (Green/Croissant Sand and Gravel Mine). The complete set of seven mylar Use by Special Review sheets for this project was transmitted to you on December 21, 2001 under separate cover. Folded paper copies of those sheets are enclosed in this letter for your record, and also included is the fee of $70 (Banks and Gesso, LLC Check number 7668) for recording the seven final USR- 1329 plat sheets. As noted in the December 21st transmittal, this current letter completes the process of documenting that all Conditions of Approval required for plat recording have been satisfied. You may first note that two preious letters have been sent to your attention updating the County on the satisfaction of USR Conditions and transmitting related materials. These Letters, dated July 18 and September 20, 2001, are attached for your reference. From the previous letters, you will note that the following conditions have been previously satisfied: 1, 2A, 2C, 2E, 2F, 2G, 2H, 2J, 2K, and 2N. All mappable features relating to these Conditions (particularly 2C, 2E, 2F, and 2G) are incorporated into the final plat drawings transmitted to the County on December 215'. To complete the County's record of conditions satisfied for plat recording, the following summary is provided for all outstanding items not addressed above: Condition 28. A Flood Hazard Development Permit (FHDP) was applied for in a submittal package sent to your attention at Weld County on December 21, 2001. A copy of this transmittal letter is enclosed for your reference. The Applicant has elected to avoid placing any new structures, parking areas, or other built improvements in the floodplain. Because the Flood Hazard Development Permit is limited to excavation in the floodplain and includes extensive hydrologic anallysis demonstrating no impact to flood conveyances, we anticipate the County'sI approval of the FHDP in the near future. Condition 2D. Execution of Improvements Agreements and posting of appropriate Collateral are required, respectively, by Conditions 2D and 2M. it Loveland Ready Mix Concrete,Inc.,USR-1329,Green/Croissant Sand and Gravel Mine Request for Plat Recording January 3,2002 Page 2 We were initially referred to Donald Carroll of the Weld County Public Works Department for all matters relating to Improvements Agreements. The public and private Improvements Agreements have been reviewed and approved by Mr. Carroll (see attached), and a copy of each is enclosed for your use, if Planning Services requires a review. Following our initial conversations with Mr. Carroll, Lee Farnsworth of the County Attorney's Office was also contacted regarding form of collateral; therefore, in accordance with Mr. Farnsworth's guidance, Loveland Ready Mix Concrete, Inc. is prepared to execute the Improvements Agreements and submit a financial instrument, satisfying Conditions 2D and 2M. Please note that the completion of both public and private improvements at the site is likely to occur shortly after the commencement of USR-1329 operations, possibly as soon as the summer of 2002. Condition 21. On September 19, 2001, Banks and Gesso, LLC submitted a Dust Abatement Plan for USR-1329 to the Weld County Department of Public Health and Environment; and on November 19, 2001, we confirmed this in a general letter to the County Health Department regarding USR-1329 Conditions of Approval. Please refer to the enclosed copies of these letters, or contact Char Davis at the Health Department if you have any questions related to the satisfaction of Condition 21. Condition 2L. Loveland Ready Mix Concrete, Inc. has received a commitment letter from the Little Thompson Water District for service to the Green/Croissant site. This letter is enclosed for County records and satisfies the potable water requirement of Condition 2L. Condition 2M. See discussion at Condition 2D, above. Condition 2O. To address concerns about road conditions and traffic associated with USR-1329, and in conjunction with the Weld County Public Works Department, we have been working with Roxann Hayes, Senior Civil Engineer, of the Larimer County Engineering Department. After several meetings and draft submittals, the Applicant has produced a plan that meets the needs of both Counties, and has defined a process for implementation of this plan. A copy of this plan, with approval signatures from representatives of both Weld and Larimer Counties, is enclosed in satisfaction of Condition 2O. If you have any additional questions regarding this Condition, please call Drew Scheltinga at Weld County Public Works or Roxann Hayes (970/498.5724) at Larimer County Engineering. Condition 2P. Loveland Ready Mix Concrete, Inc. now has Weld County septic permits for both the existing on-site residential system and the proposed commercial ISDS system that is to serve the USR-1329 operation. Please see the November 19th letter to Weld County Health for documentation regarding the existing septic system. A copy of the new permit for the commercial ISDS is enclosed for your reference. Vehicle speed on unpaved roads and disturbed areas shall not exceed a maximum of 30 m.p.h.Speed. limit signs shall be posted. 5. Vehicle speed on haul roads and service roads shall be restricted to 30 miles per hour. Speed limit signs shall be posted. 6. Unpaved haul roads shall be watered as often as needed to control fugitive particulate emissions such that the above guidelines are met. 7. Reclamation works and sequential extraction of material shall be initiated to keep the total disturbed areas at any one time to a minimum. 8. The Big Thompson River on the northeast portion of the Croissant property may serve as a dispersal corridor (it is apparently not depicted in photos accompanying the report). If even an occasional Preble's is able to traverse such generally unfavorable reaches of habitat along the Big Thompson River, this linkage may prove significant to the remaining Preble's population in Weld County. Thus. the Service concludes that development or other actions on this site should not have direct adverse effects to Preble's provided that a potential for Preble's dispersal along the Big Thompson River is not excluded. Division of Wildlife biologists Courtney Crawford and Mike Sherman visited the site and recommend the following. A major portion of the property in question lies in the flood plain of the Big Thompson River. Approximately 1000 feet of the Big Thompson River lies adjacent to this proposal at the east portion of the property. At the present time domestic cattle are heavily grazing the land. The gravel mine proposal indicates that surveys have been completed on threatened on and endangered wildlife species. We recommend that U. S.Fish and Wildlife representatives be contacted in reference to Preble's Jumping Mouse and Ute Ladies' Tresses Orchid. Pete Plage(Preble's)and Jan Mckee(Orchid)may be contacted at 303- 275-2370. Gravel mining activity on this project will have little impact on existing wildlife. Development of ponds or lakes along with proposed wetland mitigation has the potential to improve habitat for waterfowl, shorebirds, amphibians and fish. In order to maximize the site for wildlife and for recreation, reclamation plans for the ponds should include islands, shallow areas and irregularly shaped shoreline with slopes not greater that 4:1. According to this proposal a batch plant-office will be constructed near two existing ponds located in the Northwest portion of the property. Several,large,mature cottonwood trees exist at this location and it is not clear from this proposal if the trees will be removed to make room for the batch plant and adjacent storage piles. The cottonwoods provide nesting and perching habitat for a variety of birds including raptors and songbirds. Considering the ample area available for construction at this location,we recommend that plans be altered so that these cottonwood trees remain in place. Some of the lots extend North into an area that has been designated on another map as wetland enhancement. We • highly recommend that the lots be configured so that they do not conflict with wetland enhancement. wetlands are one ofthe most important habitat types in Colorado and should be-preserved-as open spaceaad-not overlap with residential development. Set backs and buffer zones should be planned so that wildlife disturbance is minimal. If residential development is approved, covenants should be in place that requires owners to maintain their property and control domestic pets. Pets running at large are a definite liability to their owners and to wildlife. Residents of this rural development must be aware that they are responsible for their property and that accumulation of trash and junk and outdoor feeding of pets may attract nuisance wildlife such as skunk,raccoon, fox, and cottontail rabbit. The extraction plan map indicates that mining activities(cell 4)will take place adjacent to the Big Thompson River. A small wetland that eventually flows into the Big Thompson River exists within that cell and it appears that it will be mined out. The proposal states that a U.S.Army Corps of Engineers-404 permit will be obtained prior to mining this area. We highly recommend that this be monitored for fixture compliance. The extraction plan map also indicates a 110-foot offset between the Big Thompson River and cell 4. This portion of the river has historically provided valuable resting and feeding area for ducks and geese. This information has been separated into two categories: (1) Conditions Satisfied provides information that we believe satisfies the condition of plat recordation; and (2) Progress Report provides an update of items that we are in the process of completing in order to satisfy the remaining conditions. Response to Referral Comments In reply to your referral comments for the Weld County USR-1329, Loveland Ready Mix Concrete Inc. project, the following information has been provided: 1. The surveys on threatened and endangered wildlife species have been completed for this project. A Preble's Jumping Mouse and Ute Ladies' Tresses Orchid Species report have been prepared by Savage and Savage and has been forwarded for your review and approval. An additional copy of the report has been enclosed for your records. This report has also been submitted to the Colorado Division of Minerals and Geology as part of its Reclamation Permit application. 2. The reclamation plan incorporates the development of several wildlife ponds and reclaimed wetland areas within the site. The development of ponds with the proposed wetland areas will potentially provide a habitat for wildlife and fish. The Applicant is currently working with local jurisdictions and ultimately the Army Corps. of Engineers to refine the reclamation plan. In this process, the Operator will consider islands, shallow areas, irregularly shaped shoreline and side slopes. 3. There are 19 mature cottonwood and birch trees located near the two existing ponds and existing farmhouse. The proposed concrete plant will be moved thirty feet east, in order to protect 18 of these trees. These trees will be monitored to evaluate their condition to assure their continued growth. One tree will be removed and replaced with three smaller trees to be placed near the east pond. 4. The potential residential/wetland enhancement area and residential development identified on the alternative reclamation plan is conceptual, not a development proposal. Concerns regarding specific lot development, setbacks, buffers and covenants will be addressed during the review of any future development applications that may be submitted to Weld County or the Town of Johnstown, subsequent to reclamation. DOW.Response.Letter July 18,2001 Page 2 of 2 5. The mining activity in Cell 4 proposed to take place adjacent to the Big Thompson River is at least 110 feet from the River, if not more. Mining in this area is not scheduled to take place for at least 10 years, by which time a mitigation program will be established. Because wetland habitat is located in this area, an U.S. Army Corps of Engineers 404 permit will be obtained prior to mining this area. The mining activities in this cell will comply with U.S. Army Corps of Engineers requirements and will be monitored under both the Army Corps. of Engineers and Division of Minerals and Geology's jurisdiction. The wildlife habitat area between cell 4 and the Big Thompson River has been marginally used by waterfowl and will likely be improved with the addition of reclamation pond number four. The proposed setback for this area will be a minimum of 110 feet and will continue to provide habitat for the waterfowl in the area. This information has been separated into two categories: (1) Conditions Satisfied provides information that we believe satisfies the condition of plat recordation; and (2) Progress Report provides an update of items that we are in the process of completing in order to satisfy the remaining conditions. Conditions Satisfied 1. The Development Standards approved for this project have been included on the revised plat plan (Extraction Plan Map). Please see the enclosed revised plat plan. 2A. A letter that addresses the concerns of the Colorado Department of Wildlife was sent on July 18, 2001. A copy of the letter has been enclosed for your information. In response to their concerns, the concrete plant has been moved approximately 30 feet to the east to in order to preserve existing cottonwood trees. 2C. The plat plan has been revised to clearly identify all storm water discharge points for the project site. Since the water route of the property will flow toward the Big Thompson River, only two storm water discharge points have been identified for the project site. The primary storm water discharge point is located at the Big Thompson River in the northeast corner of the site. The secondary discharge point is also located at the Big Thompson River in the central east portion of the site. Please see the enclosed revised plat plan. 2E. The Applicant will construct the office parking lot in accordance with surface, sight distance and grading requirements of the Weld County Department of Public Works. A note has been added to the revised plat plan regarding this requirement. DO W.Response.Letter July 18,2001 Page 2 of 2 5. The mining activity in Cell 4 proposed to take place adjacent to the Big Thompson River is at least 110 feet from the River, if not more. Mining in this area is not scheduled to take place for at least 10 years, by which time a mitigation program will be established. Because wetland habitat is located in this area, an U.S. Army Corps of Engineers 404 permit will be obtained prior to mining this area. The mining activities in this cell will comply with U.S. Army Corps of Engineers requirements and will be monitored under both the Army Corps. of Engineers and Division of Minerals and Geology's jurisdiction. The wildlife habitat area between cell 4 and the Big Thompson River has been marginally used by waterfowl and will likely be improved with the addition of reclamation pond number four. The proposed setback for this area will be a minimum of 110 feet and will continue to provide habitat for the waterfowl in the area. This concern has been addressed during the Reclamation Permit review process and the Division of Minerals and Geology approved the setback area. Thank you for your comments. Response to Referral Comments In response to your concerns and comments for the Weld County USR-1329, Loveland Ready Mix Concrete Inc. project, the following information has been provided: 1. Required Vertical clearance shall be 13'6". There shall be no grade greater than 6% on open streets and no grade greater than 4% in intersections. The vertical clearance for vehicles will be a minimum of 13'6". The grade for open streets will not exceed 6% and the grade for intersections will not exceed 4%. The land being developed under the current proposal is generally flat, with no overhead obstructions of any kind. The vertical clearance and street grades will provide adequate access for trucks, emergency vehicles and emergency apparatus. 2. This project shall comply with the fire flow requirements of the 97 UFC, Appendix Ill-A and B. The mining operation will comply with all appropriate fire requirements, including fire flow requirements of the 97 UFC, Appendix III-A and B. The Operator, Loveland Ready Mix Concrete, Inc. will have access to adequate water supply with a tap to the Little Thompson Water District main that runs along Weld County Road 54. 3. Hydrant installation details are required to be submitted to the Fire District prior to project start up. Prior to operation of the facility, the location and details for hydrants will be submitted to the Fire District. Johnstown fi re.response.letter July 18,200! Page 2 of 3 4. Hydrant location shall be located no more than 150'from structures and 300'spacing. The location of hydrants for the project site will be no more than 150' from structures and will be spaced no more than 300' apart. As you will note from the attached plans, all structures and potential fire hazards on the site are located in the western area near the existing structure. One or two hydrants are planned for this area according to the above criteria. 5. Fire safety during construction shall comply with section 8704 of the "97"UFC. Construction of the mining facility and structures will comply with all applicable Building Code and Fire Code requirements subject to review and compliance during the Building Permit process. 6. When construction of new buildings starts Addresses, Street Names, and Signs shall be posted. Prior to construction, the Applicant will provide a sign with the address and street name of the facility at the entrance of the project site. This will be simultaneous with the posting of a building permit and will be adequate to call attention to the site for fire calls. 7. The Johnstown Fire Protection District requires all buildings be provided with proper and adequate vehicle access construction of permanent all-weather surface, which is capable of supporting the weight of emergency apparatus. The vehicle access and internal roads for the project site will be constructed of bituminous asphalt or compacted road base, which will provide an adequate surface and weight for trucks and emergency apparatus. Since the site will regularly dispatch concrete and gravel trucks, all roads will be adequately maintained to receive emergency vehicles. The construction of access roads and internal roads will also meet requirements of the Weld County Public Works Department. 8. The Johnstown Fire Protection District shall receive blueprints for all structures being built on site for our review and approval. Prior to construction, the Johnstown Fire District will be forwarded blueprints for the on-site structures of the mining operation. 9. The Johnstown Fire Protection District shall receive blueprints of any and all fuel storage tanks on site for our review and approval. The fuel tanks will be located in the fuel storage area identified on the Extraction Plan Map (Site Plan). The fuel storage area will be located within a concrete spill containment area. Detailed plans for fuel tanks will be supplied as part of the blueprints requested above. 10. If there is a gate at the main entrance we will need to see drawings on this as well.
