The original building was placed under Building Permit #BC-9900174 with a final approval date of 11/5/99. We have been asked to provide a 14'x60' modular that will sit adjacent to the existing 36'x60' guard building and be connected with a covered walkway. The addition will be used for locker rooms and an exercise area and will not include any additional plumbing. I would appreciate your input regarding the requirements and or submittals that would be required by the county for the expansion. Staff has determined that the addition of the above ground piping and valve set that will incorporate the KN pipeline and the Colorado Interstate Gas Company system into the existing Public Service system east of the town of Fort Lupton is not considered a substantial change to the existing permit. The area where this activity is to occur is within a one hundred (100) foot by seventy-five (75)foot fenced area south of Weld County Road 16 and west of Weld County Road 33. There are existing improvements in-situ. Because of the restriction of personnel and the duties to be performed, we are requesting exemption from the America's Disability Act (ADA) requirements. The location of the alarm station (attached to the spent fuel storage bull mg)prohibits the intake of nourishment and personnel hygiene needs. The administration building, which is outside the fence and across the drive, has human conveniences but is approximately 100 feet away. The guards also patrol around the administration building, which gives them access to the administration building facilities. PROPOSED LOCATION A 40 acre site located immediately south of the Fort St. Vrain Power Plant northwest of Platteville. The site is approximately 6 miles east of I-25 via paved WCR 34 and paved WCR 19.5; and 3 miles west of U.S. Highway 85 via paved WCR 32 (Grand Avenue in Platteville) and paved WCR 19.5. The land is owned by Public Service Company and is zoned I-3. Based on anticipated BFG utility needs, this is the most cost-effective and desirable property in Colorado. Market value of the property is estimated to be $32,670/acre when infrastructure is complete. See Site Location section. 2. PROJECT DEVELOPMENT COSTS/WAIVERS A variety of public and private infrastructure will need to be developed to serve this project. Various infrastructure requirements and estimated costs are summarized below. Based on BFG's anticipated job creation, investment, and overall positive impact on the state economy, Colorado has set aside up to $1 million in federal Community Development Block Grant (CDBG) funding to help pay for a portion of the public infrastructure development costs. Greeley/Weld Economic Development (EDAP) and Weld County government have experience in preparing and successfully receiving CDBG funding. These two entities, with required participation from BFG, will be responsible for completing/monitoring the CDBG application process, which can be somewhat time consuming. See the Incentive Calculations section for additional information. Infrastructure requirements and estimated development costs: a. County Development: The County requires that Site Plan Review documentation be submitted by the company for county planning office approval. Site Plan Review requirements and general information can be found in the appendix. Fees will be assessed upon receiving the Site Plan submittal and when a building permit is issued. The very nominal county building/plan check fees, estimated to be approximately $28,000 (Phase 1 & 2), cannot be waived. Calculations are estimated based on the fee schedule which will go into effect in 1998 and may be subject to minor change once the fee schedule is adopted. r • Executive Summary—Page 2 b. Waste Water Development: The property is not served by a public sewer system. Therefore, a private septic system will need to be developed and operated by BFG. Based on soil types in the general area, a septic system is suitable. An experienced consultant has estimated the cost to handle domestic waste to be approximately $150,000, with an annual operating cost of approximately $1,000. At this time he is unable to estimate the cost associated with BFG production waste water. The chemical composition of the production waste and state health requirements will determine the most viable method of disposal (ie. land application, disposal into the Platte River, etc.). With additional information and by working with local and state health officials he can provide an estimated cost. Depending upon the complexity, the process could take 6-9 months. BFG (or representative) will need to work with the Weld County Health Department to obtain proper permitting. Additional information can be found in the Infrastructure section. c. Roadway Development: Approximately 1/2 mile of road will need to be built east off of WCR 19.5 to serve the property. The cost of this road is estimated to be $100,000 and will be covered by state CDBG grant dollars. This would provide a paved roadway 24' wide with two 4' wide shoulders built to county standards. Weld County would own and maintain the road. See Site Location section. d. Fire Protection: The sites are located within the service territory of the Platteville/ Gilcrest Fire District. Upon completion of your site plan documentation, the County will forward information on your project to the fire district and ask for comments. We are unaware of any development costs at this time. e. Water Development: The site is located within the Central Weld Water District. In order to meet your total anticipated load at buildout, an 8" water line will have to be extended approximately 2.5 miles at an estimated cost of $591,000. This capital improvement cost will be covered by state CDBG grant dollars. The purchase of a 4" water tap including 290 shares of Colorado Big Thompson raw water will also be required by BFG. Based on todays water market, the water district conservatively estimates the cost to be $800,000, which could be phased in over several years depending upon water usage. The usage of steam produced by PSCo. could also reduce the water demand which would reduce the number of water shares required. Water rates are extremely competitive at $.66/1000 gallons. Central Weld Water is not able to provide the 4,800 gpm water flow for emergency use. PSCo owns a day lined storage pond on site that can provide at least 15,000,000 gallons of reserve water. The reservoir is filled from the Platte River. This is available to provide an emergency backup water supply if necessary. However, the pond will need to be cleaned and pipe laid to the BFG facility, which is estimated to cost $963,000. There are no state/local funds to cover this cost if deemed necessary. The need for this emergency water flow can be eliminated by on-site back-up generation (600 HP) which can operate the water pumps. It is estimated that this would cost approximately $350,000. See Infrastructure section. , Executive Summary—Page 3 f. Steam Line Development: Steam can be provided to the new facility for approximately $3.50/mlb of steam. These costs may change once actual loads and pressures are known. This does not include the cost of piping the steam from Fort St. Vrain to the new facility or modifications to the plant. We estimate these costs to be between $130-$140/foot and have assumed that lines will need to be extended 2,500 ft. Based on these assumptions, steam line development cost is estimated to be $350,000. This cost will be covered by state CDBG grant dollars. Usage of this steam source would also reduce water consumption and ultimately reduce water tap fees. See Infrastructure section for additional information. g. Electric Service Development: Electricity can be supplied to the property. There are five major transmission lines connected to Fort St. Vrain and a sixth transmission line is planned for construction in the near future. The reliability of electric service should be excellent. PSCo will provide an allowance for constructing new electric facilities to the site. This allowance is determined by the rate selected— secondary or primary voltage service. Assuming BFG's electric load to be 2,500 kilowatts of billing demand, the construction allowance for secondary service would be $375,000 or $300,000 for primary service. Either allowance should cover all electric extension costs. Emergency back-up generation-600 HP can be provided as summarized under water development. See the Infrastructure section for additional information. The rate structure has been previously given by PSCo representatives. h. Natural Gas Service Development: The site is currently supplied gas from Wyoming by Colorado Interstate Gas. There are adequate supplies of gas to the intersection of WCR 19.5 and WCR 34. A construction allowance will be provided to construct gas pipelines to the new facility. Based on usage of 500,000 dekatherms, the allowance would be $100,000. The natural gas is not currently oxygenated and the supply has proven to be very reliable. By combining gas loads at this facility and the Pueblo facility the transportation charge is estimated at $.48 per mmbtu for service across CIG and PSCo systems. See the Infrastructure section for additional information. 3. TAXES a. Sales/Use Tax: Weld County does not charge a sales/use tax on equipment or construction materials. Therefore, only the 3% state sales will apply. By not assessing a county sales/use tax we have estimated a total savings to BFG of approximately $1.1 million. b. Property Tax/Waiver: All property is assessed for tax purposes at 29% of actual value. The mill levy for this location is extremely low at 75.268 mills. As allowed under Senate Bill 182, the school district and Weld County have the ability to waive up to 50% of the taxes due on new personal property (equipment) for up to 4 years. Executive Summary—Page 4 They can't waive taxes due on real property (building and land). We feel confident that both taxing jurisdictions will waive applicable taxes which we estimate to be $1,086,760 (Phase 1 & 2). See the Incentive Calculations section and Appendix for additional information. c. Enterprise Zone State Income Tax Credits: Eligible companies have the ability to earn a variety of state income tax credits based on qualified company investments in new equipment, job creation/training, health insurance benefits, etc. By getting the BFG project "grandfathered" under EZ legislation, we estimate BFG could earn approximately $1,648,480 in state income tax credits (Phase 1 & 2). See the Incentive Calculations section and Appendix for additional information. 4. LABORJTRAINING a. Working through Aims Community College and the state, Colorado First Customized Training grants will be available to help offset BFG training costs. In order to proceed with additional development on this site an "adequate" sewage system will be needed. A septic system may not be adequate to meet the industrial intensity of the site. The Weld County Health Department will make the determination regarding the adequacy of a system. The adequacy of a system is based on engineering data which must be provided by the applicant. Frequently, these permits are time consuming, both at the local and state level. These permits must be in place prior to any land use approval. Additionally, I have notified Jeff Stoll of the Weld County Health Department of your request to discharge into the St. Vrain. In order to conduct this activity you do need to submit additional permits to Mr. Stoll and will, likely, need a discharge permit from the State. This permit, once again, relies upon detailed engineering and design computations. In order to proceed with additional development on this site an "adequate" sewage system will be needed. A septic system may not be adequate to meet the industrial intensity of the site. The Weld County Health Department will make the determination regarding the adequacy of a system. The adequacy of a system is based on engineering data which must be provided by the applicant. Frequently, these permits are time consuming, both at the local and state level. These permits must be in place prior to any land use approval. Additionally, I have notified Jeff Stoll of the Weld County Health Department of your request to discharge into the St. Vrain. In order to conduct this activity you do need to submit additional permits to Mr. Stoll and will, likely, need a discharge permit from the State. This permit, once again, relies upon detailed engineering and design computations. I explained that in order to conduct these activities the following situations would have to occur. First,the existing USR-1063 would need to be amended to exclude the 40 acre parcel. After approval from the Planning Commission a site plan analysis would be required to entertain the 13 uses. Some of the concerns expressed at the meeting where that public water presently is served to the site, however, the sanitary sewer issues on the site present some problems. Presently the site is served by an individual package treatment facility and the new user to the 40 acre site has requested their on package treatment facility. I explained to those present that in order to conduct this activity the 208 permit may need to be amended and state approval would be needed. I than expressed that in my understanding, it will take a minimum of about six months to amend this permit. I recommended that Trevor Jiricek and Jeff Stoll with the Weld County Health Department be consulted. While discussing the possibility of converting this parcel to an 13 use, I distributed and explained the Site Plan Review application. I expressed a concern that the applicants need to incorporate the specific design requirements associated with 13 uses in their application. Ted Borst expressed some concerns regarding transportation requirements associated with these proposals. According to Mr. Borst,the existing St. Vrain Power Plant employed approximately one thousand people, but at the present time there are only about 40 people on the site. It was Mr. Borsts' opinion that the existing transportation would be sufficient to support the St. Vrain facility and the new proposed activity. I than recommended that Drew Scheltinga and Don Carroll review the situation. Because the PUD seems to be an activity that Public Service would like to enter into sometime in the near future, but not a the present time, this issue was not discussed in detail. I did distribute the existing PUD procedure guide and recommended that they look at the requirements.Once again, I expressed my concern about the sewer issues which would be required in conjunction with any future developments . Finally, I recommended that any future lines going into or out of the facility exceeding 69 vt's would need to be included in the amendment. I have had the opportunity to review the files, and I find that a portion of your property is zoned 1-3 (Z-76). This, apparently, includes the area of your site you are proposing for development. By right you will be able to convey a forty acre parcel to the proposed seller which would meet both building and zoning requirements and will be considered a legal buildable parcel in the 1-3 zone district. .A site plan review will be necessary for this parcel to assure that the proposed uses will be conducted in accordance with the requirements of the 1-3 District. As proposed, a reduction in size of the original parcel will be considered a substantial change to the existing USR (1063) permit and will necessitate the need to amend the existing USR. Several planners in the department have spoken to representatives from Public Service about extending an additional line into the facility. This would also be considered a substantial change to the existing USR permit and would require an amendment. Both of thi≥a.ectivities should be addressed in the same amendment. I have not reviewed the site application, so I am not able to comment on the sewage treatment at this time. Depending on this permit and the capacity listed an amendment may be needed here as well. A review of your permit should answer these questions. I have included procedural guides for the site plan and USR.Together,these two procedural guides should address "` your immediate need for developing one parcel. I will be more than happy to review these with you when you are ready to proceed. Future development of the site will probably most efficiently be handle through the PUD process. The final site selection should be made around the first of November 1997 with the facility scheduled to be constructed in mid-1998 with an occupancy of late 1998. This is a very aggressive schedule.
