RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JUAN AND MARIA MEZA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Juan and Maria Meza, VI #0200006, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of April, 2002, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Juan and Maria Meza were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. He noted the following number of animals located on the property: 13 =Horses 13 = Cows 21 =Hogs 7 = Sheep 11 = Goats a few chickens (could not count them) He also noted 6 adult dogs and 1 pup (about 4-5 months). Due to a language barrier, an employee from the Health Department came over and translated for me. We explained all of the issues. Mr. Meza stated that the mobile home already had the required inspections and he would bring copies of the paperwork to show it. I explained that only 4 dogs are allowed and that the number of animal units would have to be reduced to 4 per acre. He asked for a letter that he could show family members in hopes that they would remove them. I explained the Noncommercial Junkyard situation. He asked for that to be included on the letter. The potential noncompliance with the Weld County Code is the accumulation of camper-trailers, Recreational Vehicles and/or mobile homes without the required permits, if applicable. In Weld County camper-trailers/Recreational Vehicles and/or mobile homes can not be used as structures without first obtaining a building permit and in some circumstances a Zoning permit. In fact, in certain instances, they are not an allowed use at all. Additionally, there is a concern with the number of animal units and household pets. Regarding animal units, only 4 (four) animal units are allowed per acre. With regard to household pets,only four dogs are allowed per place. Lastly,a"Noncommercial Junkyard"consisting of derelict vehicles and miscellaneous debris was noted. This, in and of itself, does not pose a problem; however, it must be screened from all adjacent properties and all public rights-of-way. For your convenience, I have included a couple of our pamphlets. 1.) Noncommercial Junkyard-this will explain what is included under this definition and what can be done to correct the violation. 2.) Mobile Homes -this will explain when a permit is required and what is allowed. 3.) Uses by Special Review -this gives the definition of a kennel and explains what would be required to maintain a kennel or too many animal units. Box 101, Gill, of the County of weld and State of Colorado, grantees, WITNESSETH, That the grantor, for and in consideration of the sum of TEN DOLLARS ($10.00) the receipt and sufficiency of which is hereby acknowledged, hereby sells and quitclaims unto the grantees all the right, title, and interest of the grantor in and to the following real property, together with improvements, if any, in the County of Weld and State of Colorado: A strip of land 75.0 feet in width, situate in and being all that part of the s% of section 23, Township 6 North, Range 64 W. of the Sixth Principal Meridian, in Weld County Colorado, extending northeasterly from the south line to the east-west centerline of said Section 23, and lying between the hereinafter described centerline of the abandoned main track and said centerline extended of the Greeley Branch of the Union Pacific Railroad Company, as formerly constructed and operated, and a line that is parallel and/or concentric with and 75.0 feet distant northwesterly, measured at right angles and/or radially, from said centerline of abandoned main track, containing 5.35 acres, more or less; together with a right of way and easement for access to said parcel over an existing road across the SW; of said Section 23 lying southwest of said parcel; reserving to the Grantor, his heirs and assigns, a right of way and easement over the existing road on the southeast side of said parcel running the entire length of said parcel, and from said road to a triangular tract of land lying in the northwest corner of the SEA of said Section 23, together with the right to install water, electric, telephone and other utility lines in and on said right of way.
