RE: APPROVE AMENDMENT TO RECORDED EXEMPTION NO. 14 , PREVIOUSLY
KNOWN AS MINOR SUBDIVISION NO. 14 - RONALD AND MARY ANN NOLDE
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on November 22 , 1972 , the Board did, by Resolution,
approve Minor Subdivision No. 14 , and
WHEREAS , Minor Subdivisions are now referred to as Recorded
Exemptions , and
WHEREAS, Ronald and Mary Ann Nolde are requesting an amend-
ment to said Recorded Exemption No. 14 , and
WHEREAS , said amendment would decrease the acreage of Lot
A from 90 . 940 acres to 80. 161 acres, more or less , and increase
the acreage of Lot B from . 921 acres to 11 . 824 acres , more or
less, and
WHEREAS , the parcel of land for which this request is being
made is described as Part of the S1, Section 21 , Township 4 North,
Range 68 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicants and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , the Board deems it appropriate to approve the amend-
ment to Recorded Exemption No. 14 for Ronald and Mary Ann Nolde on
the above described parcel.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the above mentioned
amendment to Recorded Exemption No. 14 , previously known as Minor
Subdivision No. 14 , requested by Ronald and Mary Ann Nolde on the
hereinabove described parcel of land be , and hereby is, approved,
subject to the applicants submitting a mylar plat to the Depart-
ment of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be drawn in accord-
ance with the requirements of Section 9-2C. (4) of the Weld County

Re: Amendment to Minor Subdivision 14
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Ronald and Mary Ann Nolde for a recorded exemption. The parcel of land
on which this request is being made is described as Pt. of the S'1, Section 21,
T4N, R68W of the 6th P.M. , Weld County, Colorado.
The property is located 4 miles North of Mead on Weld County Rd. 42. The
property contains approximately 91.985 acres of Class Ile irrigated and IIIc
and IVe nonirrigated soils.
The request is to amend Minor Subdivision 14 so that parcel B will be 11.824
acres in size. Lot A would then be 80. 161 acres in size. The Noldes will be
raising livestock on the additional land they will be purchasing.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
The 91.985 acres, more or less, under consideration will
be compatible with the existing surrounding land uses and
with future development of the surrounding area as
permitted by the Agricultural Zoning. The proposal is
also consistent with the intent of the "A" Agricultural
Zone District in which it is located.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from Weld
County Rd 5.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.

WHEREAS, on May 5, 1972, the General Assembly of the State of Colorado,
enacted Senate Bill #35 as relates to Chapter 106 of the Colorado Revised Statutes,
and
WHEREAS, on August 30, 1972, the Board of County Commissioners of Weld
County, Colorado, adopted Subdivision Regulations for Weld County, Colorado, to
comply with the prescribed Senate Bill #35y and
WHEREAS, the Weld County Planning Commission has recommended to the
Board of County Commissioners for recording Minor Subdivision No. 1061-21-3-MS-14
as provided in Section 9 of the Subdivision Regulations for Weld County, Colorado.
Said subdivision is more particularly described as follows:

North, Range 68 West of the 6th P.M. in the County of Weld, State
of Colorado more particularly described as follows:
