The area cited in your letter has been annexed into the Town of Nunn, and as such Weld Government no longer has land use jurisdiction in these areas. The Town Board of Nunn has sole land use discretion for the Nunn Meadow subdivision. Whether built in Weld County or the Town of Nunn, FEMA,(Federal Emergency Management Agency)rules and regulations apply to all flood plain areas. The administration of FEMA is delegated to controlling land use agencies, and as such, the Town of Nunn has the responsibility to enforce these regulations. I encourage you to visit with Jolene or Anita, (970) 897-2385, the Town of Nunn's flood administration personnel. They will be able to address the specific flood questions raised in your letter. Frank Hempen, Weld County Department of Public Works, reviewed your concerns about the roads. Mr. Hempen has been given a copy of your letter and will respond to your concerns. As a final note, the scale house built at the south west corner of WCR 100 and WCR 29 was not required to obtain a building permit, but an electrical permit was obtained. Attached is a copy of letter from me directed to VFIS,the Nunn Board of Trustees' carrier for Directors and Officers Coverage and Error's and Omission Coverage dated August 25, 2002,which chronicles a longstanding problem. See Karen Veraldi Burd letter directed to VFIS,the Nunn Board of Trustees' carrier for Directors and Officers Coverage and Error's and Omission Coverage dated August 25, 2002. During one afternoon rainstorm,my property at 48656 Weld County Road 29,which is not in the floodplain, sustained flash flood damaged after the natural drainage in the area had been altered. At the time of the flashflood damage,the Nunn Board of Trustees and the Weld County Commissioners were contacted. Nunn Board of Trustees and the Weld County Commissioners determined that water draining from the hills West of Nunn was diverted by : 1.) changes made to Weld County Road 100 and Weld County Road 29,plus 2.) building up the Southwest corner of Weld County Road 100 and Weld County Road 29 to facilitate the building of a scale house on the Bellmore property,then in unincorporated Weld County, at Southwest corner of Weld County Road 100 and Weld County Road 29 and were primary causes of the flash flood damage done to my property. Weld County Road 29 was repaired. As yet the individuals and entities responsible for this damage to my property have made no real reparations to me as a property owner. After the damage to my property,I was amazed when Mr.Jensen as a member of the Nunn Board of Trustees asked and the Nunn Board of Trustees granted the Jensens a home building permit in a mapped floodplain with a history of flash flooding-- the dryland wheat field North of my property. I do not believe the Nunn Board of Trustees properly considered the conflict of interest and the disproportionate burden or risk of the other property owners in the immediate area when it allowed the Jensen's to build and sell a home on a known floodplain with a history of flash flooding. In addition the Jensen's proposed 1.) the Jensen Subdivide and 2.) the Jensen-Patrick Re-subdivision in a known floodplain with a history of flash flooding based on the future home owners' promise to purchase NFIP insurance. See attachment. Nunn Meadows; Minor Replat Request involves a request to subdivide one of the subdivisions of the Jensen Re-Subdivision dated 6th day of February 2001,Notice of Public Hearing Jensen-Patrick Re-Subdivision dated 2nd day of March 2001, Preliminary Plan of Replat of the West Twenty -Two Acres of Block D,Plat of the Town of Nunn; see attachment . Again,this is in the floodplain north of my property. As to drainage,the developers recognize that the development lies within the floodplain, but after meetings with the Weld County Department of Planning and Zoning, determined that "by elevating each home two feet,we would alleviate the floodplain issues. Given the size of the lots and distance between neighboring properties,there would be no negative drainage impact on surrounding properties." The Weld County Department of Planning and Zoning's determination is for an area North of my property where an earlier flashflood that damaged my property washed away a road bed,carried away a significant amount of soil,damaged my fence,and left a steep, ugly gully along the north side of my property which is over five feet deep. How is two feet of dirt going to help if hit by flashflood waters? During a flashflood,what is the impact to the natural gas lines,water mains, septic tanks,and electrical lines attached to the homes proposed by the developers? During a flashflood, where will the flashflood waters be diverted after hitting houses set on two foot berms of dirt? The Nunn Meadows development on Weld County Road 100 is approximately the same distance from the north boundary of my property as is the Bellmore scale house on Weld County Road 100. Could flash flood water again be diverted from property in the flood plain to my property which is not in the flood plain? I don't believe the Nunn Board of Trustees' and the Weld County Department of Planning and Zoning has considered the disproportionate burden or risk of the other property owners in the immediate area when it approved the yet to be constructed Nunn Meadows development. Two feet of dirt and buying flood insurance from National Flood Insurance Program does nothing to improve the physical safety for those people living near or in the floodplains. The community of Fort Collins,Colorado,now claims that on the site where five people lost their lives during the 1997 flood,that,that site was not in the floodplain. Larimer County and Fort Collins altered the drainage of the Spring Creek area. As reported in the Fort Collins Coloradoan. "Builder has plans for '97 floodsite: Land not in Suring Creek Floodplain." of July 1,200,people lost their lives and property on a site that had been changed and bordered the actual floodplain. During my earlier calls I asked for the following information: 1.)the name and address of the carrier for the Weld County Commissioners the Directors and Officers Coverage and Error's and Omissions Coverage 2.)a copy of the building permit issued for the Bellmore scale house at the intersection of Weld County Roads 100 and 29,then in unincorporated Weld County I would also ask that the Weld County Commissioners and Weld County Department of Planning and Zoning to reconsider their decision concerning the yet to be constructed Nunn Meadows development and any other development in the floodplains in the area North of my property with a history of flash flooding. After their independent and critical review to ensure public safety, I would ask the Nunn Board of Trustees,Weld County Commissioners,the Weld County Department of Planning and Zoning,and FEMA to provide a clearer written explanation of their position and why they recommend it to the public. I understand that some of these developers/builders include some of the same individuals and entities that caused earlier damage to my property, dumped chunks of broken concrete on my property, and as yet have made no reparation to me as a property owner. I was also surprised by your spokesperson,Lynette's,comment to me that the Nunn Town Clerk had nothing on record from me regarding any concerns or difficulties. Attached is a copy of letter from me directed to the Nunn Town Board of Directors, signed and received by the Nunn Town Clerk,A. Alvarez. My letter dated March 14, 2001 chronicles a longstanding problem. See attachment A,Karen Veraldi Burd letter dated March 14,2001; RE: Proposed Jensen Re-subdivision (Part of Block D,being in NV/4,NW4,Section 33,TS9N,R66W [described as Parcel A]) sans attachments. As a legal consideration,the Town of Nunn Board of Trustees has an obligation to record problems and objections and ensure debate on controversial and difficult issues. During one afternoon rainstorm,my property at 48656 Weld County Road 29, which is not in the floodplain, sustained flash flood damaged after the natural drainage in the area had been altered. At the time of the flashflood damage,the Nunn Board of Trustees and the Weld County Commissioners were contacted. As a Weld County aerial photograph demonstrates,water historically drained across the dry land wheat field North of my property and there was no significant erosion on the Northern boundary of my property. See photograph B. One afternoon storm caused a flashflood that carried away a significant portion of the roadbed of Weld County Road 29. See photographs C,D,E. That storm also carried away a significant amount of ground from the field North of my property. See photograph at F . Also,a significant amount of my property was washed away and my fence line was damage. See photographs G and H. Weld County Road 29 was repaired. As yet the individuals and entities responsible for this damage to my property have made no real reparations to me as a property owner. Without contacting me large chunks of concrete were dumped on my property. See photographs I and J. A reasonable person would have problems arguing that large chunks of concrete do anything to provide just compensation for the damage to my property or improve the value of my property. In my opinion this has diminished the value of my property. After the damage to my property,I was amazed when Mr.Jensen as a member of the Nunn Board of Trustees asked and the Nunn Board of Trustees granted the Jensens a home building permit in a mapped floodplain with a history of flash flooding-- the dryland wheat field North of my property. I do not believe the Nunn Board of Trustees properly considered the conflict of interest and the disproportionate burden or risk of the other property owners in the immediate area when it allowed the Jensen's to build and sell a home on a known floodplain with a history of flash flooding. As floodplains have been mapped,the National Flood Insurance Program was created for people who unknowingly invested in and found themselves living in what turned out to be fragile sites such as floodplains. I certainly support what FEMA has done to provide some level of financial help to those people. For developers hoping to profit from development in what has historically been floodplains, a article in the February 19,2001 Fortune page 50 recommends that "The government will not pay people to do stupid things. [The expansion of the National Flood Insurance Program to cover undeveloped fragile sites] offers subsidized insurance to people who build on properties that the private sector either will not insure or will insure only at great cost. Environmentally,the NFIP is a problem because it encourages building on fragile sites...Economically, it costs billions because the cheap premiums it charges aren't enough to cover the claims." It is difficult for me as a stakeholder and resident of Nunn to follow the Nunn Board of Trustees plans and policies and how they are carried out. *As a community member present during the board meeting considering the second Bellmore Annexation,I was asked to leave the meeting while the Nunn board went into executive session to discuss the Bellmore Annexation. In my opinion, the board violated the Colorado open meeting law. *At the board meetings I have attended,copies of the issues to be discussed are made and given only to actual members of the Nunn Board of Trustees. Extra copies are not available as evidenced by a copy of Nunn Meadow attached at L. A copy of the Nunn Meadows; Minor Replat Request with a post-it note referring to the December 6,2001 meeting was sent to me on December 13,2001, as evidenced by the postmark on the envelope from the town of Nunn. Under the Colorado consumer Act,home owners can recover treble damages if the can prove willful conduct. At what point does this become willful blindness? During the Nunn Board of Trustees' January 3,2002 meeting, I asked if a building permit had been issued for what appears to be a constructions site just feet from the Northern boundary of my property and where the earlier flash flooding occurred. I got no information concerning a building permit. See photograph N. As I mentioned in my telephone conversations with your office,I have some grave concerns about the types of developments being approved by the Nunn Town Board of Trustees. My reasons for writing are: 1.) to ask if your firm is prepared to continue Directors and Officers Coverage and Error's and Omission Coverage for the Town of Nunn Board of Trustees coverage and to assure that if flash flood damage does occur in this area,VFIS is prepared to cover claims. (Recently some carriers have refused to cover claims,claiming that damage was not accidental but the result of the developer/builder's deliberate negligence which would not be covered under their policy. If you knowingly develop/build in a known floodplain and damage occurs,how is that an accident?) 2.) to ask for a copy of any claim turned in to VFIS concerning the earlier damage to my property, 3) to ask how much public money is being paid as premiums to VFIS to protect the property and profits of board members like Trustee Jensen. I am copying the Nunn Board of Trustees, Weld County Commissioners,Weld County Department of Planning and Zoning,and FEMA. I would ask that the Nunn Board,the Weld County Commissioners,the Weld County Department of Planning and Zoning to review and reconsider their decision concerning the yet to be constructed Nunn Meadows development and any other development in the floodplains in this area with a history of flash flooding. As a property owner in the immediate vicinity of Jensen-Patrick re-subdivision, I am opposed to the Jensen-Patrick re-subdivision because it is in the floodplain, see attached Notice of Public Hearing Jensen-Patrick Re-subdivision dated 2n°March 2001, letter from The Town of Nunn, Colorado dated March 2, 2001, and Preliminary Plan; Replat of the West Twenty-Two Acres of Block D, Plat of the Town of Nunn. The land borders my property on the North. I was amazed when Mr. Jensen as a member of the Nunn Board of Trustees asked and the Nunn Board of Trustees granted the Jensens a home building permit in a mapped floodplain. The historical value of the Jensen-Patrick re-subdivide and now former Jensen home is property that has as a basis that the property was: purchased for an initial investment of approximately $5000.00, located in a known floodplain, zoned agriculture, - and had long been a dryland wheat field. The Jensens seem like very pleasant people, but I don't believe the Nunn Board of Trustees considered the disproportionate burden or risk of the other property owners in the immediate area when it allowed the Jensens to build and sell a home on a known floodplain. I understand that in addition the Nunn Board of Trustees now wants to allow the Jensen- Patrick re-subdivision in a known floodplain based on the future home owners' promise to purchase of NFIP insurance. With the knowledge of previous problems in the area of proposed Jensen-Patrick re- subdivide, I expect the Nunn Board of Trustees to provide protection from development in a known floodplains and to prohibit any further altering of the natural drainage of that floodplain. Also, I would like to obtain a copy of the Nunn Town Charter. Charters are important and valuable documents—school charters, bank charters, town charters. I will contact the Nunn Town Clerk to arrange payment.forup�y c ,gying costs.
