HomeMy WebLinkAbout841048.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 714 - GARY AND JUDY ROBERTSON WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 714 , does not come within the purview of the definition of the terms "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 714 was submitted by Gary and Judy Robertson for property which is located in Part of the NW4 , Section 6 , Township 4 North, Range 68 West of the 6th P .M. , Weld County, Colorado, being more par- ticularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into par- cels which have been estimated to be approximately 10 acres and 10 acres. The parcel of land on which this request is being made is described as part of the NW', Section 6, T4N, R68W of the 6th P.M. , Weld County, Colorado. The property is located approximately 21 miles northeast of Berthoud and 7 miles west of Johnstown on State Highway 60. The property contains approximately 20 acres of class I (prime) irrigated soil. This is a soil with few limitations that would restrict its use for cultivation and plant productivity according to the Soil Conservation Service. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of ten (10) acres and ten (10) acres, more or less. Mr. and Mrs. Robertson propose to further divide a parcel of land that was created by the Recorded Exemption process in 1979. There are no improvements on the twenty (20) acres and it is currently used as irrigated cropland for corn and vegetables. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends that the request be denied for the following reasons: The request does not comply with Section 9-2 E; the Standards and Conditions for approval of a recorded exemption. It is the responsibility of the applicant to demonstrate that the proposal is consistent with the intent of the district in which the use is located. 841048 Board of County Commissioners Page 2 - The subject site is located in an Agricultural Zone District outside of a projected town growth area. The minimum lot size in the Agricultural Zone District is eighty (80) acres for irrigated land and one hundred sixty (160) acres for dryland. The further subdivision of a twenty (20) acre parcel into two (2) lots is inconsistent with efficient and orderly development in the agricultural zone district outside of a projected town growth area. - It is the responsibility of the applicant to demonstrate that the proposed use will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the County. - The Weld County Future Land Use Map indicates the type of development at the subject location is intended to remain agricultural and the zone district is intended to remain agricultural. As explained on pages forty-two (42) and forty-three (43) of the Weld County Comprehensive Plan, problems occur when agricultural uses and residential uses are mixed together. One such problem relevant to this area and this recorded exemption is the conflict that can occur when irrigation ditches are subjected to residential areas. Irrigation ditches and laterals, such as the Home Supply Ditch are vital to the farmer and to agriculture. Also, the ditches present an attractive but dangerous place for children to play. The end result usually means damage to the ditch or fencing of the ditch. This requires additional maintenance and cleaning costs of the ditch each spring. As explained in the Comprehensive Plan on page forty-four (44) , "scattered development in rural areas has other implications. Residential development in rural areas necessitates an increase of public service to that area." More people in the area places additional strain on expenditures for road maintenance, police protection, fire protection, and educational services. It has not been demonstrated that the increased revenues generated by development will pay for the required new facilities and services. The creation of an additional building site through the recorded exemption process will have little impact on the need for services; however, if the recorded exemption becomes the norm and numerous similar proposals are granted, the above impacts can be expected to develop. 841048 Board of County Commissioners Page 3 In this regard, the cost of County services can be reduced if development is encouraged around existing population centers and future town growth areas. Development in town growth areas reduces the conflict that arises between rural and urban land uses. If the approval is granted for RE-714 by the board of County Commissioners, the Department of Planning Services staff would require the applicant to submit a revised mylar plat to the Department of Planning Services office to be recorded in the office of the Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. September 25, 1984 TO WHOM IT MAY CONCERN: My wife and I purchased this 20-acre parcel 5 years ago for the purpose of raising dairy heifers, which we had done for 16 years in Wisconsin. Since this time our plans have changed as we have bought a business in Loveland. This business requires 12-14 hours per day and it is not feasible for us to live 6 miles from our store, much less try to keep up with a 20-acre heifer operation. Because of this, we have listed the property for sale. We have had numerous interested buyers but none who could afford or care for the entire acreage. We currently have a contract to sell the larger half of the acreage (10.15 acres) to a buyer who wants to build their own home and raise sweet corn. They cannot make a living doing this but they can supplement their income and do something they have always wanted to do. There is also a contract pending on the smaller parcel from a buyer who wants to raise alfalfa. This person has been looking at the property for over a year but could never afford to buy the whole acreage. He is presently leasing land nearby for this purpose but would prefer to own. We feel this requested exemption is consistent with Weld County's desire to protect farming and the quality of life in Weld County. Because this is an irrigated acreage, it has attracted a specific type of buyer -- one who 1) will pay the additional price for irrigation water and 2) who has a need or use for it. The buyers we have talked to all have very definite plans for either crop or livestock raising. These purposes are consistent with the agricultural zoning of the property. The surrounding area in all directions is composed of small rural subdivisions of 2-1/2 to 5 acres, farm homes with 1 to 2 acres, and several 40 to 160 acre farms. We feel that this proposed exemption and the uses proposed for it are totally compatible with the surrounding land uses. This property is located along a 60 ft. road easement that departs from State Highway 60. To the North of the subject property is a 5 acre site with a new home currently under construction. To the South is another small acreage with an existing home. We feel that this proposed exemption for two 10-acre parcels (approximately) would be very consistent with the growth and development of the surrounding area. The sewage disposal method for both parcels would be individual septic systems. The domestic water source is Little Thompson Water District. There are taps available and the master line is already in place along State Highway 60. A 1/2 share of Consolidated Home Supply Ditch & Reservoir Company will also be included in each parcel of this proposed split as well as 1/4 interest in the existing pump and irrigation equipment.
