RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR REFLECTION
BAY PLANNED UNIT DEVELOPMENT, S #557 - DONALD LAFAVER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated October 27, 2000, the Board of County Commissioners
did approve the application of Donald LaFaver, 2185 Pine Drop Lane, Golden, Colorado
80401, for a Planned Unit Development Final Plan, S #557, on the following described real
estate, to wit:
SW1/4 SW1/4 of Section 29, Township 2 North,
Range 68 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, on December 4, 2000, the Board of County Commissioners of Weld
County, Colorado, did approve an Improvements Agreement According to Policy Regarding
Collateral for Improvements (Publicly Maintained Roads) for Reflection Bay PUD, between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, and Donald LaFaver with terms and conditions being as stated in said
agreement, and on June 11, 2001, the Board released the original collateral and accepted
replacement collateral in the form of a Certificate of Deposit, drawn on the Centennial Bank of
the West, 3561 Stagecoach Road, Longmont, Colorado 80504, in the amount of $6,517.50,
and
WHEREAS, staff from the Weld County Department of Public Works has conducted a
visual inspection and recommends release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Certificate of Deposit, drawn on the Centennial Bank of the
West, 3561 Stagecoach Road, Longmont, Colorado 80504, in the amount of$6,517.50 be, and
hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.

The Weld County Department of Public Works and Planning Services received a letter from
Don LaFavor, developer of Reflection Bay PUD requesting the final release of collateral for S-
557. Per Mr. Carroll's memorandum dated May 2, 2002, all transportation items have been
verified as being complete.
The Department of Planning Services and Department of Public Works recommends that six
thousand five hundred seventeen and 50/100s (6517.50) dollars, be released.

At the written request of the applicant, an inspection of the site April 30, 2002. All transportation
items have been verified as being complete. No retainage is being requested from the Public

All non-transportation items shall be verified by Planning Services prior to release of collateral.
