A Site Specific Development Plan and a Special Review Permit for a Major Facility of a Public
Utility (a 13.2 mile 115kV transmission line and two switching stations) in the A (Agricultural)
Zone District
USR-1392
1. A building permit shall be obtained for the two switching stations.
2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of floor plans and plot plans are required
when applying for the permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC and
Chapter 29 of the Weld County Code.
4. The transmission lines and switching stations are not subject to review or inspection under
the 1999 National Electrical Code. No electrical permits will be required.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by Chapter 23 of the Weld
County Code. Offset and setback distances are measured from the farthest projection from the
building.
6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

Special Review Permit for the construction of a major electrical transmission line and two
switching stations in the A Zone District. Approximately location between 1-15 and Weld
County Road 15 and Weld County Road 6 and Highway 66 (Case Number: USR-1392, Case
Name: Tri State Generation &Transmission).
The Fire District does not object to the project provided vehicle access is maintained so that
emergency apparatus may have access to structures in the area or the Fire District is made aware
of road closures so that alternate routes may be planned for.

Reference is made to the above-mentioned project located in Parts of Sections 5, 6, 7 & 18,

This project has been reviewed in accordance with Section 404 of the Clean Water Act under
which the U.S. Army Corps of Engineers regulates the discharge of dredged and fill material and
certain excavation activities in waters of the United States. Waters of the U.S. includes ephemeral,
intermittent and perennial streams, their surface connected wetlands and adjacent wetlands and
certain lakes,ponds, drainage ditches and irrigation ditches that have a nexus to interstate commerce.
Based on the information provided, a Department of the Army permit will not be required for this
activity.
Although a Department of the Army permit will not be required for this activity, this does not
eliminate the requirements that other applicable federal, state,tribal, and local permits are obtained if
needed.

Use Permit for a Major Facility of a Public Utility
Dear Ms. Ogle:
Thank you for referring to the City and County of Broomfield, the site specific
development and special use permit for the above stated project. After review of the
project and its location, we have the following comments:
• Is the proposed transmission line located within the WCR 11 right-of-way? The
portion of WCR 11 ROW in Section 23 is located within the City and County of
Broomfield. If the project is within the ROW then the appropriate approvals needs to
be requested from The City and County of Broomfield.
• Whether the project is or is not within the ROW, we still have concern and would like
to talk to you about the following: Within the City and County of Broomfield, the
ultimate cross section for WCR 11 calls for a widening of the roadway. At the
appropriate time, we will work with the property owners on the east and west sides
of WCR 11 to obtain the needed ROW for widening. We request that you contact us
as soon as possible to discuss the future ROW needs and to determine the exact
location of the transmission line to ensure that future ROW needs are not
compromised by this proposal.

Environmental Health Services has reviewed this proposal for a major facility of a public
utility (a 13.2 mile 115kV transmission line and two new switching stations). We have
no objections to the proposal, however, we do recommend that the following conditions
be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. If applicable, the applicant shall submit an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division,
Colorado Department of Health and Environment for emissions of criteria,
hazardous or odorous air pollutants.
2. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site. During installation of the
transmission line, all land disturbances shall be conducted so that nuisance
conditions are not created.
5. The applicant shall adhere to the maximum permissible noise levels allowed in
the Light industrial Zone as delineated in 25-12-103 C.R.S., as amended.
6. Bottled water shall be utilized for drinking and hand washing during construction
of the project.
7. Adequate portable toilet facilities (port-a-potty) shall be provided during the
construction of the project.
8. The applicant shall comply with the requirements of the Air Pollution Control
Division, of the Colorado Department of Public Health and Environment.
9. The applicant shall comply with the requirements of the Water Quality Control
Division, of the Colorado Department of Public Health and Environment.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily
under the purview of the Use by Special Review Standards,Weld County Code,Chapter 23,Article
2, Division IV, Section 23. Our comments and requirements are as follows:
COMMENTS:
The proposed transmission lines will be parallel to three separate County rights-of-way. The
remaining route has been annexed by Firestone, Frederick, Dacono, Broomfield, or Northglenn.
WCR 13 between WCR 26 and the Del Camino switching station is designated in the Weld County
Road Classification Development Area as a major arterial road, which requires a 140-foot right-of-
way at full build out.
WCR 26 is designated on the Southwest Study Capital Improvements Needs Area as a paved rural
road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-
way. The first 1,300 feet of the road and right-of-way east of WCR 13 on WCR 26 has been
annexed by the Town of Firestone. There are plans to upgrade and pave this portion of road to
accommodate the French-Lohmann Gravel Pit (USR-1326). The remaining portion of WCR 26 to
WCR 13 is maintained by Weld County
WCR 6 is designated in the Weld County Road Classification Plan as a collector status road,which
requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This
road is paved and maintained by Weld County.
REQUIREMENTS:
Future Right-of-way: The applicant indicated that the proposed utility lines will be located 63 feet
from the center line to allow for future road expansion. WCR 13 from the proposed Del Camino
switching station south to WCR 26 is designated as a major arterial, which requires a 140-foot

right-of-way for full build out. Weld County requires 70 feet from the roadway center line/section
line for future expansion on the west side of WCR 13 though this location. On WCR 26 and WCR
6, the typical set back of 63 feet is adequate from the road center line/section for future roadway
expansion.
The applicant should verify with the affected municipalities that the typical 63 feet set back from
the center line/section line is adequate to meet final widening requirements.
Weld County Right-of-Way: A Weld County Right-of-Way Permit is required wherever a
transmission line crosses the County right-of-way. There will be no staging or parking of equipment
or vehicles on the County right-of-way. Utilize the private easement. Contact the Weld County
Public Works Department to acquire a right-of-way permit prior to construction.
Bridge Replacement: The Weld County Public Works Department had scheduled to replace the
bridge over the St. Vrain River just north of WCR 26 on WCR 13, which is parallel to the proposed
transmission lines. The bridge is scheduled for this year. A detour route will be set up to
accommodate moving equipment and vehicles around the road closing. Please contact the Weld
County Pubic Works Department to verify this route.
Switching Stations: The access should be placed in such a location that there is adequate sight
distance in both directions and not below the crest of a hill.
Off-Street Parking/Access: The off-street parking including the access drive shall be surfaced
with gravel,asphalt, concrete,or the equivalent,and shall be graded to prevent drainage problems.
Storm Water Detention: The storm water detention facility has accommodated the Del Camino
site by retaining and releasing through a culvert pipe at the historical flow. The Erie switching site
has been designed to collect the run-off and then release it at the historical rate. Both sites will
accommodate any storm water that may occur on either site.

Dear Kim:
We have reviewed the referral information supporting the Site Specific Development Plan and
Special Review Permit for a Major Facility of a Public Utility as submitted by Tri-State.
The proposed alignment between Weld County Road 8 and Highway 52 is in the City of Dacono
Planning Area. The City expects to expand into this area and is concerned about land use and
transportation in this area. The County road system will eventually become the major and minor
urban arterial street system. The arterial street system will be developed according to the Baseline
Standards established for Cities and Towns in this area and supported by Weld County. These
standards call for 120 feet of right-of-way and a 25 foot landscape area on both sides adjacent to the
right-of-way. The landscape area is intended to provide an attractive streetscape and to buffer the
adjacent land uses from the roadway using such features as trees, shrubs and earth berms. The
proposed power line route along Weld County Road 11 is through an area that will soon be under
development.
Tri-State has kept the City Council well informed about the proposed alignment, the alternative
alignments and the reasons for selecting the planned route. The City does not oppose the planned
alignment but there is some concern about how the installation can be integrated with the planned
arterial street improvements and adjacent landscape buffer. We ask that Tri-State establish
reasonable standards for landscaping and earth berming in the power line easement so that an
attractive streetscape and effective noise buffer can be established along Weld County Road 11.
The City looks forward to working with Tri-State on this project.

The sheriff's office has no concerns with this Special Review Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
.-. resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
