Our comments and requirements are as follows: COMMENTS: WCR 55 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of- way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. The average daily traffic count on WCR 55 between WCR 40 and WCR 44 reflects 39 vehicles taken in a 24-hour period on 7/10/97. The proposed dog kennel is adjacent to the existing dairy. REQUIREMENTS: Access: The existing access to the proposed USR crosses over a small irrigation ditch to the facility. The Weld County Public Works Department recommends that the applicant trim trees and shrubs at this access point to create an adequate sight distance in both directions. Off-Street Parking: The off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 . The Environmental Health Services Division was unable to locate a septic permit for the septic system serving the Dog Kennel. The septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 5. Fugitive dust shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 7. The facility shall utilize the existing public water supply. 8. The applicant shall operate in accordance with the approved "waste handling plan". 9. Adequate handwashing and toilet facilities shall be provided for patrons of the facility. 10.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 2 19. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 21. The water system shall comply with the requirements for a community water system as defined in the Primary Drinking Water Regulations (5 CCR 1003-1). 22. Bottled water shall be utilized for drinking and hand washing during construction of the project. 23. Adequate toilet facilities (port-a-potty) shall be provided during the construction of the facility. 24. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 25. The operation shall comply with all applicable rules and regulations of the Colorado Division of Minerals and Geology. 26. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. 27. The facility shall be operated in a manner to control flies. The facility shall be operated in accordance, at all times, with the approved fly control plan. Additional fly control measures shall be implemented at the request of the Weld County Department of Public Health and Environment in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. Building permits shall be obtained prior to any construction. BCN-020374 and BCN-020375 have been applied for to allow a change of use for the two wood frame buildings to be used as kennels. 2. A plan review is required for each building. Two complete sets of plans are required when applying for the permit. 3. Buildings shall conform to the requirements of the 1997 Uniform Building Code, 1998 International Mechanical Code, 1997 International Plumbing Code, 1999 National Electrical Code and Chapter 29 of the Weld County Code. 4. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and Chapter 3. Setback and offset distances shall be determined by Chapter 23 of the Weld County Code. 5. The sheriffs office would however be willing to provide a program entitled Crime Prevention Through Environmental Design to the developer. This program reduces the likelihood of criminal activity at a specific location by "hardening" it to crime. The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. 44AC:i MEMORANDUM Ii`De TO: Carla ,1 DATE: August 102 Planner O2 COLORADO FROM: Kim Ogle, Planner III SUBJECT: Use by Special Review 1400 for a Kennel not to exceed 150 dogs Cordell and Crystal Dye The Department of Planning Services has reviewed this application and has the following comments: The applicant is proposing to Kennel 150 dogs of an unknown breed. Information shall be provided stating the breed and their typical daily requirements. The Kennel is proposed for lands associated with an existing Special Use Permit, SUP 344. The applicant shall amend SUP 344 to reflect the reduction in size of the existing permit. Further, the boundaries of SUP 344 and USR 1400 shall not overlap. The applicant's USR Map delineates extensive opaque fencing surrounding all of the existing "play yards" and "dog run" areas. The north end of the site has a chain link fence, allowing visibility from surrounding property owners and or the public at large traveling on Weld County Road 55. Depending on traffic and complaints from surrounding property owners, the Department of Planning Services will agree to permitting the fence to remain a chain link fence, however, should there be any complaints from surrounding property owners, the fence shall be modified to be opaque in structure. There is an area delineated as parking east of the existing residence. The applicant shall provide delineation as to the number of spaces present, and circulation on site for this parking area. Staff will not require the site to meet ADA standards. The application states that the building was originally constructed to house livestock. As there is a change in use, the Department of Building Inspection shall be contacted to verify how the structure was permitted and if there are any building related issues that should be addressed. The application states that irrigation and domestic water is obtained from Central Weld County Water District. As this is technically a commercial endeavor, verification of a commercial well tap should be obtained from the water district. The application states that there is a double leach field on site. No mention is made as to how the applicant is handling the disposal of wastes from the kennel. The Department of Public Health and Environment shall be contacted concerning this issue. The application does not address the issue of drainage. The Department of Public Works shall be contacted to determine what issues, if any are required to be addressed for the on-site natural drainage and the potential requirement for a retention/ detention basin to release water at a historic rate. Points of ingress and egress and storm drainage shall be addressed by the Department of Public Works. Section 23-3-250.A.6 states "Areas used for trash collection shall be screened from public rights-of-way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind- or animal-scattered trash." It is unclear from the applicant's drawing whether the trash collection area is screened from the public rights-of-way and adjacent properties. Written and /or graphic evidence shall be submitted to the Department of Planning Services for review and approval. Section 23-3-250.A.9 addresses "Outside storage. Uses involving outdoor storage of vehicles, equipment or materials when permitted shall be screened from public rights-of-way and all adjacent properties." It is unclear from the applicant's drawing whether there is an area for outdoor storage. Written and /or graphic evidence shall be submitted to the Department of Planning Services for review and approval. Section 23-3-250.B addresses Operation Standards. Section 23-3-250.6.6 addresses the issues of Light. "Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be confused with or construed as traffic control devices." It is unclear from the applicant's drawing whether there is an any exterior lighting. The applicant shall provided written and /or graphic evidence to the Department of Planning Services for review and approval. A Lighting Plan may be required. Section 23-3-250.B.7 states "Property shall be maintained in such a manner that grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property owners allow the growth of noxious weeds. (Weld County Codification Ordinance 2000-1) The USR Plat shall be drawn at a scale of 1"=100 feet or 1"=200 feet. If necessary, a detailed enlargement of an area may be delineated at a larger scale. The Location/Vicinity Map shall be drawn at V=2000 feet. The existing on-site landscape treatment is adequate for this facility. End memorandum. Hello
