We want to make this short but hope you will understand that we weren't listened to, we were hurried through, one landowner was unable to speak and it just seemed that their mind was made up and it really didn't matter as to what we had to say regarding: I. safety on the road, gravel, room enough for bus turnaround, open space being in flood plane and stated by planning services that it would be able to put a very stable fence because of flood plane, screening of neighbor's to west and possibly the east. 2. water concern; whether it be irrigation or North Weld Water. They are saying that they have plenty of irrigation water;they are saying that they are bringing 8inch water line from 392 to their development (at the expense of who99999). We are now at a 2inch line and all of a sudden they can have an 8inch line! 3. the development is not compatible to the area. We are taking farm ground and turning it into a strip housing (8 homes), two outbuildings per acre, two additional vehicles (motorized or not?) outside of what will be parked in a 2 or 3 garage home-does it fit? 4. homeowner's association that will be in charge of what is done with the 30+ open space area—and no covenant agreement written up yet and was told that they wanted to wait until meeting with commissioners—does that not leave the door wide open. It was recommended by one planner to them to have them written up by 10/02/02 but it was not voted on. It was stated by the manager of the Cattail Creek Group that pretty much summed it up that they really didn't care what the owner's did with the open space once it was sold! Also, if folks are coming to live in the country the eye catcher is equine (where are they going to be) 5. mineral rights—manager has been talking with oil company to have sites capped how can that happen so quickly to make area more appealing to development. 6. posting of zone change—it was sure unusual that there was going to be a first hearing and none of us were notified-mistakes can happen and no notices were sent out. It was stated that a notice was posted of the hearing to be held in August and also stated that it is very common for no one to see the signs as they get knocked down, no sign of second hearing was seen either. But, now a sign is up and staying up for the 10/02/02 just seems a little unusual. I know you hear hundreds of hearings and pleas but we are asking that you take into consideration our many concerns and that we be given a fair chance to present our case to all of you. My property borders the one single portion between the Page's and myself on WCR 70. The row homes will be nothing like the homes on acreage in the area. We moved to the country for quality of life and I enjoy our community very much. I feel that developer's can asked for anything but they need to be looked at very carefully and do they fit the area. These developer's come in and made all kinds of promises when they arrived and the main gentleman doesn't even live in our area any more. Is all of this happening just because of financial need and our needs of quality of life not being looked at? It just seems that there was disloyalty shown, the standards were not the same for all cases being presented and when it got time for us it was like get this show on the road. I am asking that you take myself and all the neighbors concerns into consideration. The objections listed henceforth will be in response to the Land Use Application Sheet PUD Change of Zone reasons for approval as well as other related issues which site reasonable objections and state why this "development" should hereby be DENIED. Please refer to: Section 27-2-20 Access Standards The intemal road should be paved with curb and gutter so as to eliminates dust pollution. The entry should be wide enough to accommodate a school bus so as not to impede the flow of traffic on County Road 70 and more importantly for the safety of the children riding the bus. To further reduce dust pollution on County Road 70, as this development will easily double the volume of traffic, the mile from County Road 29 to County Road 31 should be paved the entire length. Also for the safety of the children, the school bus should not be allowed to tum North onto County Road 31, as this is a blind corner and traffic moves well in excess of the posted 55 mph speed limit. Section 27-6-120.6.c The Cattail Creek development is completely incompatible with the surrounding agricultural area. This area is very much an agricultural community and has been for the past twelve years that I have lived here. There are no one acre lots in the area, let alone one acre lots in a row house configuration. Not to mention that the ground slated for this development is part of a productive farm as it has been for many years. Also,this proposal does not comply with the policies and intent of the City of Greeley Comprehensive Plan and Resolution and the City of Greeley has cited other conditions that should be part of the proposal. To allow this development to proceed is inconceivable. Section 27-6-120.6.d There is a concern that if this development is approved,that the delivery of an adequate amount of water from the North Weld County Water District will be difficult if the current system is utilized. Water pressure is already low to non-existent at times. Enlargement of the system would seem to be necessary if this type of subdivision is allowed. Also an issue of concern is the high water table in close proximity to the sewage disposal systems proposed for this development as well as the lay of the land which slopes toward the creek. The high water table combined with the natural grade of the land sloping toward the creek 4 EXHIBIT G seem to create a very real potential for contamination of the creek. This should be deemed an issue the will compromise the health, safety and welfare of the people, not only in the area, but downstream as well. Section 22-2-190.D.2.b As a former SecretaryfTreasurer for the Wood Lake Mutual Water& Irrigation Company, I have a fair understanding of how the system functions. The twenty shares allocated from the Wood Lake Mutual Water& Irrigation Company are not a guarantee of delivery to the open space. Without additional shares of a ditch company that can carry water to the Wood Lake system (for example — Larimer and Weld) the only water available to the Cattail Creek development would be seep water. In a drought, like we are experiencing now, there may be little to no seep water available to be delivered to the development for the open space. In a normal to wet year, the amount of water available to be delivered will still rely only on the seep water, which will change some, however, it will never be adequate to irrigate the 34 acres. With consideration to the fact that there will not be enough irrigation water to properly establish a crop, nor to sustain it, what can the adjacent properties and surrounding neighbors expect to see in the open space? Undesirable plants, which usually include noxious varieties, will be certain to invade the open space without adequate irrigation and maintenance. This will create a nuisance for adjacent property owners who wish to control weeds on their property as well as create a fire hazard not only for the development, but for surrounding properties as well. The other issue at hand is the delivery of 20 shares of seep water to the property. It becomes increasingly difficult and cumbersome for the ditch rider and the farmers under the system to divide the water into smaller and smaller increments for delivery to such small parcels. Section 22-3-50.6.1 If this development is allowed to proceed, adequate fire hydrant protection must be provided due to the close proximity of the homes, not only to each other, but to the surrounding properties. In conclusion, it is clear that there are no obvious benefits from this development to the surrounding landowners. It does not "fit" into the agricultural community and will only serve to diminish property values in the area as well as the quality of life that has been enjoyed there. The negative impact will far outweigh any implied benefit represented by a developer who only has an interest in taking what he can while returning nothing beneficial to the neighborhood. l would ask, that for the above mentions reasons, that you hereby deny the request for a change of zoning from agricultural to PUD. September 25, 2002 Board of County Commissioners 915 10th Street Greeley, CO 80651 Re: Case Number PZ-613, Cattail Creek Group: LLC Dear Sirs, I am writing to inform you about the proceedings of the Planning and Zoning meeting on September 17`h as well as my concerns about the pending change of zoning request by the Cattail Creek Group. Those of us who were present, sat patiently from 1:30 to 6:00 to present our case, only to be spoken to rudely and disrespectfully in a patronizing and impatient manner. The residents of the neighborhood who attended felt that it was a futile and humiliating experience. I would certainly hope that when we present our case before the Board of County Commissioners, that the Board would treat those who attend with respect and realize that they (the Board) has a responsibility to represent, not only the small percentage of constituents who are developers, but the large percentage of constituents who are land owners in these neighborhoods who do not wish to have their agricultural countryside urbanized. As you will note, there are petitions that have been signed by over 90 of the surrounding landowners who do not approve of this change of zone request as well as over 10 letters from the adjacent landowners asking that you deny this request. I would ask that you give these documents the attention they deserve. There will be many issues to be addressed, some of which you will find in the attached letter that was presented to the Department of Planning Services. Any additional issues will be presented to the Board at the Commissioners meeting on October 2nd. As a landowner for 12 years in this area, which consists mostly of farms, it would be a shame to allow a PUD such as this to occur which only serves to "line the pockets" of the developer with no obvious benefit to the surrounding landowners. Taking this into consideration, as well as the other issues presented, I would ask that you hereby deny the request for a change of zone from agriculture to PUD. My family and I have owned and farmed property adjacent to this proposed project for 15+ years. l can not imagine taking prime, irrigated ated farm ground out of production for the purpose of introducing a "cluster home" development into a strictly agricultural community. Not only does this application remove prime farm ground from production, but it over burdens resources such a schools, and domestic and agricultural water sources, while increasing the traffic load on already heavily traveled and dangerous rural roads. This whole process only serves to diminish the quality of life for everyone by trying to "urbanize" the county. As we are all aware, development does march on, however it is the responsibility of the elected officials to discern between what is appropriate and what is not appropriate development for each application that is submitted. Please consider ALL of the issues with regard to this application, I would ask that you do not overlook the fact that a majority of the adjacent and surrounding landowners are opposed to this as you will see evidence of in the letters and petitions submitted. Do we not live in a Democratic society where majority rules? Are the majority of the landowners not also the ones who pay a majority of the taxes for this area? I sincerely appreciate your consideration in this matter and respectfully request that you hereby deny this application for a change of zone from agricultural to PUD. We were very dissatisfied with the way the meeting was conducted. We question the professionalism,ethics and attitudes of the majority of the planners.These individuals as a group seemed rather uninterested in our concerns as adjoining landowners. It was almost as if their votes had already been cast. The first scheduled hearing on August 20,2002 was postponed because notification of this was never sent to the neighbors. Luckily,a concerned landowner saw the date and the property in question and got the meeting postponed. The Department of Planning Services said that it was their fault no letters were sent out. We feel that those letters were discretely not sent out so that there would be no opposition at the meeting and the case would be passed through. Subsequently,the notice of hearing for change of zoning posted by the roadside was never seen by any of the surrounding neighbors. According to Sherri Lockman,"They just don't know what happens to these signs, we put them up and they disappear." How funny! We have many valid objections to the change of zoning.Here are some of our concerns: • Petition of 91 signatures—denouncing the applicant request • Prime Farmland • Compatibility • Irrigation water shares • NWCWD water-limitations already purposed water usage • Safety—Street Intersection,Farm equipment,Automobiles,Animals We will speak on our behalf at the hearing on October 2,2002. Dear Mr. Long: We are writing to convey our disapproval in the matter of the new"cluster"of homes proposed by the Cattail Creek Group.The tract of land in question for development lies directly across our property line to the east along County Rd. 70. Our objections will be clearly stated in the body of this letter. The subject matter is in response to the topics discussed in the Land Use Application Summary Sheet for P.U.D. Change of Zone dated August 20,2002. To begin: In reference to: 2.A(1)Section 11-1-190.D.2.b,P.U.D.Policy 4.2 Cattail Creek has allocated 20 Shares of Woods Lake Mutual water to irrigate the 30 acres of open space to the east of the purposed units. The 20 shares are not a guaranteed delivery of water.Without shares of a supporting ditch company, such as the Larimer-Weld Ditch Co.,(which fills Woods Lake Reservoir)this open space may ^ only receive 50%or less of its allotment in a dry year.Also without supporting shares the property would only receive seepage and run off. 2.A(2)Section 22-3-50.B.1,P. Goal 2 "States North Weld County Water District will be used for potable water&fire protection. North Weld County Water District is already on water restriction.I spoke with a NWCWD representative today and they stated currently they are OK,however another year of this type of drought and they would be in the same position as other water companies. .Where is the water coming from?If it is the Colorado Big Thompson,North Poudre,and or any other water source it is only good if there is water in it.The forecast is predicating that it will be several years before we can fully re-coop the losses that we have experienced the past few years. We do not need 8 or 9 more homes maintain at the present. In the event that this is approved,the Applicant must provide a fife hydrant due to the closeness of our homes.With the type of wind that we experienced in this area it is not uncommon to have 40 to 65 mile per hour wind.Combined with the dryness&wind,many homes could be lost within a few hours. 2.B Section 27-2-20 Access standards,applicant proposes internal gravel roadway. We support the decision of the Weld County Dept. of Public works to pave the internal roadway. Furthermore, if the zoning changes from Agricultural to PUD,then concrete curb and gutter should also be installed. r 2.C Section 27-6-120.6.C Compatible Planning Services seems to be under the impression that this cluster development would be compatible with the surrounding area.Not So! Our agricultural farm community has several acreage's in the two(2)digits,and many more that are in the three-(3)digits.Many of these are less than '/3 mile from the purposed development and more just a mile or two(2)further.In this immediate area five(5)acre is the smallest. This is prime farmland that has been farmed probably longer than you or I have lived. It has a perfectly fine concrete ditch that delivers water to the acreage,and produces a good crop yield. The density of 8 to 9, 1-acre lots is not suitable for the area. This is a fanning community not mini sub- division 2.D Section 27-6-120.6.d Water Supply&Sewer disposal. Ground water can be reached at three(3)feet in this area.We find this very difficult to believe that 8 to 9 septic systems at such close proximately could be a benefit for the area. Where will the seepage flow, into the open space? Several people who have lived in this area for many years' state,In a wet spring water has been V2 way up the purposed development. This brings up environmental issues, Coal Bank creek is right below the development site and seepage of the septic system has the potential to pollute the creek. This represents a health issue.After the review of objection, if the Planning Commission approves this, then it is imperative that the Applicant be required to tap into The City of Greely's sewer system. 2.E Section 27-6-120.6E States streets,highways to property are adequate. If this development is approved, it will be crucial that County Rd. 70 is paved from County RD. 31 to County Rd.29 due to traffic and road conditions that Weld County can barley maintain with the current flow of traffic.There should also be a requirement for County Rd.70 for a designated off the road access for School buses. There are other issues that we have,when we signed a contract January 2000 to purchased farm land from John A. Shepardson,Jr.who is the Register Agent of the Cattail Creek Group,LLC that was recorded with the Colorado Secretary of State on November 01/2001. We agreed to purchased this land because we were told that the surrounding land would remain"farmed land,and that it would be at least ten years( 10)before anything else could be exempted from this farm land. Had we wanted neighbors right out side our back door,we would have remained in our former neighborhood. We realize that areas are being developed all through Weld County but many of them are being built in areas that make sense. This area and the plans that the developer have are certainly not for this area. First of all the way they went about getting this done is almost like slipping it in through the back door—it hasn't been very popular since the beginning and I would hope that all are treated equally but from the hearing with the planning services it almost seemed like all of our information had been given to team presenting their case for rezoning. I am hoping that honesty and good ethics will be presented at the next hearing. a) the lay of the land for this project is farm ground—certainly not designed for this (8) in a row homes. We are understanding that these will be $300, - $500, homes, up to two outbuildings, additional vehicles can be parked outside these beautiful homes and what about livestock where are they going. b) We would request paved roads in the development and also WCR 70 from WCR 31 to WCR 29, these are heavily traveled roads and blind corners. c) There are too many issues to put in writing but only hope that you will listen to our concerns. My husband and I were unable to attend the first meeting due to the fact that we are both teachers and it makes it very difficult for us to attend meetings that are held in the middle of the day. It would be much more accommodating to the general public and better serve the due process of such hearings if they were indeed held at a time that is conducive to the working family— perhaps late afternoon or early evening. We have been very involved in the campaign against such a development in this area and feel also that our voices were not heard by the exact people that we elected to represent us the Weld County landowners. With over 90 signatures on a petition we felt that the opposition to this "urbanization" should have carried more clout than the panel gave it. We certainly felt defeated before we ever began. I currently live on Road 31 and I know that we have lost numerous animals on the road due to the amount of traffic it has. I enjoy being able to ride my horse on county road 70 as well as run with my mom without having to always worry about the cars. As it stands right now it is a great danger to just go 'A of a mile to road 70 on County Road 31 with all the traffic. This I'm sure will only increase if you allow the development on Road 70. r If you continue to allow people to simply place housing developments in the middle of our"country-style" living you are going to be ruining the lives of many generations to come. I will be unable to attend the meeting of 10/2/2002 because I just gave birth to our fifth(5)child on Monday. I have lived in Colorado all my life,and my husband since he was 17 years old. I was raised in Weld County and lived also in Boulder,until the growth and congestion became exceedlying hard to deal with. We moved back to Weld County,and eventually to our present home so we could raise our children, in an agriculture area.I am to understand that these planners work on voluntary bases. It seemed rather odd that only one Planning Board member James even went to the location site, Fred said he knew where the area was. I bet if it was their community that they would have made a visit. Their job plays a big part in what happens in Weld County, I think this position needs reviewed,because these planners seemed pretty bored,and somewhat confrontational a couple of times. Ms. Clamp was definitely hungry,or so she said several times.Our group had been there since 1:30 PM waiting to be heard and didn't leave until 7:45 PM. There was clearly a difference on how this Planning Board treated the Applicant,and his presenters,almost as if they use to work together. The Department of Planning Services said it was an over site that adjoining property owners were not notified. Here are just a few things we would like you to consider. Mr,and Mrs. Danny Perdew live at 13248 WCR 72 approximately 2 miles from this proposal. Mr. Perdew is a pastor at a local church and frequently invites his parishioners and their families to his home on County Road 72 to enjoy horseback riding. I have often seen them riding the surrounding county roads venturing several miles from the home place. As you can see from the enclosed petition and letters from the children,the parishioners,as well as the children,have an understanding of the impact this type of housing cluster can have on the quality of life that we enjoy in rural areas. They realize that an increase in homes will for the present,increase traffic on the roads where they enjoy riding making it difficult as well as dangerous to continue this activity. For the future,approval of rezoning from agriculture to PUD will set precedence for more development,eventually transforming what is now"rural"to"urban". When is enough,enough? When an issue impacts the health,safety and welfare of not only adjacent and surrounding landowners,but others who also utilize and enjoy the"country", I would believe that serious consideration should be taken to review the issues at hand. Please also consider that the petitions contain over 150 signatures,that more than 20 letters have been mailed or delivered from adjacent and surrounding landowners. These arc real people expressing very real concerns for the future of our rural communities.
