INTERNAL MEMORANDUM ON CURRENT ZONING CASE TO FROM Name Platte River Power Authority Case No. SUP 380 Legal Description of Property Date February 12, 1980 Time RESULTS OF COMMTSSTONFRS WORK SFSSTON Discussion centered on the exact location of the Section line between two sections along PRPA' s transmission line route along Co Rd. 17. PRPA is bound by resolution to locate their transmission line 80 ft. from the section line. To resolve the actual location of the section line PRPA will have to take the issue to the courts. The courts may take a considerable amount of time to decide the issue, during which time the transmission line could be built. PRPA requests that they continue to construct the line given a best guess estimate and that that an agreement be worked out to allow for county road right-of-way. Commissioner Kirby suggested the following should the power line be constructed within the 80 feet of the s'ection line: a. move the transmission line, b. PRPA pay for acquisition of new right of way for the county road. This was agreed to by PRPA as two reasonable alternatives. The information provided was gathered from the Weld County Records, the Weld County Surveyor's office and the U.S. Department of Land Management office in Denver. Copies of the following items are included: 1. Sheet 8 (as revised 01/21/80) of the right-of-way strip maps for the Rawhide East Transmission Line showing various routing possibilities. 2. The original township plat, dated November 15, 1870, as filed at the U.S.B.L.M. office in Denver. 3. A survey performed by the Weld County Surveyor in April, 1918. 4. The monument records for Section 33, Township 8 North, Range 67 West, as filed in the Weld County Records. 5. Corner information sheets for Sections 32 and 33 from the Weld County Surveyor's office showing 312.32 feet between markers in the vicinity of the Northeast Corner of Section 32. 6. A statement by Bruce Antcliff concerning his preliminary search for the original government stone in the vicinity of the Northeast Corner of Section 32. No. 1735099, Book 813 of Weld County Records) . It should be noted, that as a result of the civil action in 1977 between Messrs. Aranci and Thayer, a boundary line between said land owners was established. Said boundary line was established without resolving the question of the location of the corner common to Sections 28, 29, 32 and 33. Based on the above information and our preliminary field measurements we are not able to recommend a probable location for the Northeast Corner of Section 32. However since the Transmission Line route may be influenced by the location of future County Road No. 17, it is recommended that PRPA attempt to define an acceptable route for both the County Road and the Transmission Line in a cooperative effort with Weld County. Commonwealth is prepared to write easement descriptions for right-of-way acquisition upon finalization of the route. If you require any additional information, please do not hesitate to ask. A prime item of contention is the location of the northwest corner of Section 33, Township 8 North, Range 67 West, or perhaps better stated, to reestablish the corner common to Sections 28, 29, 32, and 33 of Township 8 North, Range 67 West. On behalf of my client, Mr. Aranci, I would appreciate it if you would advise what it would cost for you to determine the location of this corner. From some preliminary inquiries, it is my understanding that the best process is actual field surveying and working from original government notes . We are presently confronted with the Defendant and his attorney arguing that aerial photographs and an ortho-photo plan prepared by Hogan and Olhausen established the corner approximately 300 feet east of where we believe it to be; however, that firm reserved a final opinion until further field work was done. SCOPE CF REPORT Hogan and Olhausen, P.C. was re, ined by Mr. Kenneth Thayer in August 1975 to evaluate the validity of the location of the subject corner which was re-established by Nelson, Haley, Patterson and Quirk and further verified by James H. Stewart. Mr. Thayer has owned and farmed portions of Section 29 since 1947 and has owned and farmed portions of Section 32 since 1961 and indicated to me that the corner established by NHPQ is at least 300' into property he has traditionally used and considered his. Mr. Thayer asked that I research his abstract records and report on the methods used to establish the NHPQ corner, give an opinion as to its status and validity and to give an opinion as to where I would place the corner from the evidence I found. II. INITIAL FIELD RECONNAISSANCE On or about September 1 , 1975, I visited the site with Mr. Ken Thayer and Mr. Warren Price. We visited and inspected the areas of all the corners Mr. Thayer had knowledge of. I had with me copies of the original government survey field notes which I had obtained from the Colorado Land Office. The notes called for stone monuments. Mr. Thayer showed me a stone reperted by James Stewart to be the 1/4 corner between Sections 32 & 33, but it did not match the stone described in the field notes. • • III . OCCUPATION NEAR CORNERS IN QUES1ION There is a fence around approximately the South Half of the Southest Quarter of Section 28. At the SW corner, the fence appears to have been rebuilt in several locations over the years. This opinion is based on windrows and older fences to the East and North. There is significant offset in the fences East and West of the 1/4 corner between Sections 28 and 33 irdicating the possibility of one or both of the fences being on an old roadway. The road into the 1/4 corner from the East appears to be on the Northeast 1/4 of Section 33 with the North fence on the Section line. The fence West of the 1/4 corner appears to be possibly 30 feet South of the North line of the Northwest 1/4 of Section 33. The fence going North along the West line of the South 1/2 of the SW 1/4 of Section 28 appears to possibly be on the line. IV. OTHER RECORD EVIDENCE OF CORNER LOCATION There is an abandoned ditch which traverses portions of all corners in question. The ditch is very evident and physically locatable even through it has been farmed over in places. I recommended that records be researched with regard to ditch rights of way for clues to the section line locations. V. PHOTOGRAMMETRIC AIDS FOR COMPREHENSIVE OCCUPATION MAP. I recommended that we produce precision aerial photographs and orthophoto plan of the four sections in question which would accurately delineate all occupation lines, roads and abandoned ditches. On September 15, 1975, we photographed the subject area with the Hogan and Olhausen Zeiss RMKA4-15/23 aerial mapping camera. Contact pri►►ts of the photos are labeled in the upper right corner as 1-2, 1-3 and 1-4. Hogan and Olhausen field crews measured field control data for orientation of the photo stereo models. Orthophoto negatives were prepared and assembled into the orthophoto plan. (Note: An orthophoto is an aerial photograph which has the horizontal image displacement which is caused by vertical relief removed. It is a true-to-scale photographic map. ) VI . DITCH RIGHT-OF-WAY DESCRIPTIONS We acquired the abstracts to Mr. Thayer' s property which include descrip- tion of abandoned Greeley-Poudre ditch across sections 29 and 32 with ties to the common corner to Sections 28, 29, 32 and 33 as well as the East line of 32. The descriptions were plotted independently at the same scale as the orthophoto on a translucent sheet for comparison and overlay techniques. VII . CONCLUSIONS 1 . The ditch records are consistent with field occupation and conclusions of corner location for common corner to sections 28, 29, 32 and 33. 2. The ditch descriptions are April 8, 1919 on the Section 32 portion and March 11 , 1926 on the Section 29 portion. The descriptions indicate where the surveyor 57 years ago considered the corners to be. 3. Nelson, Haley, Patterson and Quirk re-established the corner in question by proportionate measurement without consideration of all available evidence such as the ditch records. 4. James Stewart established the West 1/4 corner of section by using the wrongly set NHPQ corner. • 1 • 5. All of the subject landowners are very confused by conflicing surveyors' opinions. VIII . RECOMENDATIONS: 1 . Call a meeting of all the landowners, their surveyors and their attorneys and discuss conflicting opinions. 2. Furnish copies of this report and its exhibits to the interested parties for their review and comment. 3. Call a meeting and establish an agreement for establishment of the subject corners. 4. In the absence of the ability to agree pursue the matter in court and have the court set the corners. IX. MY OPINION OF CORNER LOCATION From the evidence I have seen thus far, I feel the corner should be in the existing11South fence at the subject disputed corner; however, I have not had full access to the surrounding properties and reserve final opinion to further field work and verification. ' It is my experience that absolute objectivity and logical reasoning among the affected landowners, their surveyors and attorneys to reach a logical compromise s much better than court action. I will personally make myself available to act in an informative capacity to your neighbors should you desire. It is important that everyone understand that the surveyor is lawfully and duty bound to act not as a personal advocate such as an attorney, but as an objective fact finder and professional expert practi- tioner. He is bound to place a replacement corner in the position he feels the court , will place it based on the best prcpenderance of r evidence he has at hand. NHPQ has used the original gov't records to prorate the distance between the Northwest Corner of Section 32 and the Northeast Corner of Section 33. There does not appear to be a conflict with those two corners. The stone found (assumed by NHPQ to be the quarter corner between Sections 32 and 33) tends to support the NHPQ placement of the common corner. There apparently is some conflict as to the validity of the quarter corner; since no markings were found on it. • In the material furnished by Hogan and Olhausen there is a copy of the April 13, 1918 survey done by H.M. Thompson, Weld County Surveyor. This survey shows that stones were found or set on the south side of Section 29 (north aide Section 32) . Distances are also shown. If the present northwest corner of Section 32 is accepted then the distances shown on the 1918 survey place the common corner in dispute within 1.5 feet of the present fence intersection. One could perhaps dig at the fence intersection and at the distance specified for the north quarter corner of Section 32 to see if additional physical evidence could be found. The distances in the 1918 survey do create some fairly unusual sections as 29 & 32 would have a common line of 5531 feet, more or less, and sections 28 and 33 would have a common line of 49.15 feet, more or less, quite out of agreement with the more nearly equal split of the ! original gov't survey notes. •A Page 2 Mr. Alden Hill July 19, 1976 I do not have all the materials that have been gathered by Hogan & Olhausen but;even if I did,I would reserve any opinion until further field work and verification had been made. • I feel that Mr. Hogans recommendations are sound and should be followed.
