HomeMy WebLinkAbout20020394.tiff HEARING CERTIFICATION DOCKET NO. 2002-09 RE: SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN,S#621,TO VACATE A UTILITY EASEMENT-SCOTT AND CRYSTAL JOHNSON A public hearing was conducted on February 13, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David D. Long, Pro-Tern Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated January 25, 2002, and duly published January 30, 2002, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Scott and Crystal Johnson for a Site Specific Development Plan and Planned Unit Development Final Plan, S#621, to vacate a utility easement. Lee Morrison, Assistant County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Lockman gave a brief description of the location of the site and surrounding uses. She stated the foundation was built in relation to the wrong surveying pins so it encroaches on an established utility easement. Ms. Lockman stated this request has been reviewed by the Board of Adjustment,which recommends approval,and staff and referral agencies have expressed no concerns. In response to Commissioner Jerke, Ms. Lockman stated there are not buried utilities in the easement, and there will still be utility easements on three sides of the property. In response to Commissioner Masden, Ms. Lockman stated there are also oil and gas facilities to the north. Don Carroll, Department of Public Works, stated he also sits on the Utility Advisory Board and after discussion with the utility companies, it was determined there are no utilities using the easement, and if additional lines are needed, they can utilize the open space. Crystal Johnson, applicant, stated there was a misunderstanding as to the location of the lot pins, so the house foundation was incorrectly located by 36 feet. Ms.Johnson stated once the error was discovered,they began working with a new builder to assist them with this process. She stated the foundation was placed in May of 2001, and construction of her home has been delayed since that time. No public testimony was offered concerning this matter. In response to Chair Vaad, Ms. Johnson stated she has reviewed and agrees with the Conditions of Approval. 2002-0394 /J./ /t9/ PL1583 HEARING CERTIFICATION - SCOTT AND CRYSTAL JOHNSON (S #621) PAGE 2 Commissioner Geile moved to approve the request of Scott and Crystal Johnson for a Site Specific Development Plan and Planned Unit Development Final Plan, S#621,to vacate a utility easement, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Long, and it carried unanimously. There being no further discussion, the hearing was completed at 10:15 a.m. This Certification was approved on the 20th day of February 2002.
