EMPORIA, ENGLEWOOD, COLORADO 80111 WHEREAS, the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 1st day of October, 1980 at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the applica- tion of Tom Caruso, 6306 South Emporia, Englewood, Colorado 80111 , for a Special Us'e Permit for a swine farrowing and finishing operation on the following described real estate, to-wit: The West 2317 . 49 feet (*) of the South- west Quarter of Section 31 , Township 8 North, Range 67 West of the 6th P.M. , except the West 1323 . 44 feet thereof (*) , County of Weld, State of Colorado, total area to equal 60 . 281 acres . (*) (measured along the South line; and parallel to the West line of the Southwest Quarter of Section 31 . ) WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a swine farrowing and finishing operation on the above described real estate and evidence was presented in opposition to said Special Use Permit, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recommenda- tions of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a swine farrowing and finishing operation on the hereinabove described real estate, conforms to the purposes of Section 3 . 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of the petitioner for a Special Use Permit for a swine farrowing and finishing operation on the hereinabove described tract of land be, and hereby is , granted subject to the following: 1 . The Special Use Permit plat shall be amended to show the boundary of the Special Use Permit area to be in agreement with the legal description shown on the Special Use Permit Plat. 2. The Special Use Permit shall show a certified boundary survey of the property. 3 . Prior to issuance of any building or electrical permits on the Special Use Permit area, the appli- cant shall submit a geotechnical report which indi- cates the design and addresses the possible con- straints of the sewage disposal lagoon proposed to be on the property. The geotechnical report shall be reviewed and approved by the Soil Con- servation Service, Weld County Health Department, and Colorado Geological Survey before building permits for any structures are issued. 4 . The Development Standards contained in the Special Use Permit. 5. The Development Standards for the Special Use Permit and the property owner ' s signature shall be placed on the Special Use Permit Plat and the Plat shall be delivered to the office of the Department of Planning Services . 6. The proposed swine farrowing and finishing opera- tion shall not be located within 660 feet of the nearest residence. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval of the Special Use Permit for a swine farrowing and finishing operation are as follows : 1 . It is the opinion of the Board of County Commissioners that this request is in agreement with the Weld County Comprehensive Plan. 2 . It is the opinion of the Board of County Commissioners that the Development Standards will minimize the impacts on surrounding uses and the area to the greatest extent possible and provide adequate protec- tion of the health, safety and welfare of the inhabi- tants of the area and the County. 3 . It is the opinion of the Board of County Commissioners that said operation will be compatible with the sur- rounding area, in harmony with the character of the neighborhood and existing agricultural uses and further, that there is a need for the proposed use. Mr. Anson reviewed the notice and related to the Board what they may consider when making their determination on this request. Mr. Honn read the Planning Commissions' favorable recommendation, conditions and development standards. Tom Caruso was present and testifyed regarding his request. Mr. John Xincade, attorney for various landowners and area residents was present and questioned the applicant. Mr. Kincade presented to the Board a petition signed by area residents opposing this request and a map allegedly showing the homes in the area and their proximity to the SUP. Mr. Tan Pitts a consulting engineer, testifyed on behalf of the opposition regarding his opinion of the applicants waste disposal system. He mentioned that the size of the lagoon as presented today is different than what was submitted by the applicant in his application. Mr. Caruso stated he had enlarged the lagoon in accordance with the Planning Commissions' request. CHANGE TAPE 80-70 Mr. Pitts, however, still thinks the system is inadequate. John Hall, director of Environmental Health, was present and commented on the Health Departments' role in this application. Mr. Hall stated their role was wafer pollution control not oder control. Several area residents were present and questioned the applicant about various matters relating to his proposed facility. In general they all expressed opposition to the proposed facility. Commissioner Steinmark made a motion to table this matter until Monday, October 6. She feels the operation would be valuable to the County, but she would like the additional time to study the testimony presented today. No additional testimony will be accepted, however, a representative from each side should be present to answer questions. Commissioner Roe seconded the motion and it carried unanimously. Y/v� a iii L / 6- C //i' ,( 7/ ,- September 28, 1980 Weld County Commissioners Greeley, Colorado We are writing in opposition to the proposed "Special Use Permit" for Tom Caruso for a swine farrowing and finishing operation. We live right across the road south east of the proposed location. We bought our home here 31 years ago because of the quiet arq; and the clean air. Jerald has severe asthma and the pollution in the air from the city or high traffic areas cause a real health problem. We believe this use of the land would be very harmfull to his health for two reasons. 1. The increased traffic on the gravel road between our place and the proposed location would create a hazard both from the dust pollution and the traffic fumes, and 2. We are in direct wind flow, particularly in the fall and winter, from the location of the lagoons and the fumes and odor from them would be unbearable. We also feel that if this operation came in, our property value would go down to the point we would not even be able to sell our place and move to another location where these hazards were not present. Other objections we have concern the roads and the water. First the roads in this area are not constructed for the heavy use which would accompany this type of operation. There would be extreme cost to the county to improve them to support the truck traffic in and out of the area. Second the extemely high water usage required for such an operation would require new water lines to the area or the existing users would have no water pressure for their use. We believe there are many places in Weld County where such an . operation could be located that would not adversely affect so many people as it would in this location because this is a high density residential agricuilural area. Box 86 Greeley, Colorado 80632 I reviewed the Special Use Permit application for Thomas Caruso, swine farrowing and finishing operation, to be located ten miles west and two miles south of Pierce, Colorado. The main concern I have after review of this request is the feasibility of the liquid manure storage system as proposed. Mr. Caruso stated that a lagoon of one million gallon capacity will be installed on the site. His plans show a lagoon of 100 ft. X 100 ft. A pit with dimensions of 100 ft. X 100 ft. X 15 ft. deep with 3:1 side slopes will store no more than 412, 750 gallons (1.27 acre feet) , which is approximately one third the capacity needed. Furthermore, if Mr. Caruso is planning a true lagoon system (aerobic digestion) , lagoon depths should not be deeper than 6.0 feet. When depths are greater than 6.0 feet, an anaerobic condition exists, causing odors which are very difficult to filter or otherwise process as will be done in the barns. -Considering manure production to approach 1,483 cu. ft. - 1,569 cu. ft. or 55-58 cu. yds. per day, and with a conservative figure of ten gallons of water to flush one cu. ft. of manure, then 14,830 to 15,690 gallons of water per day will be used. A one million gallon holding pond will fill with water in 67 days, and will fill with solids in 90 days. With this kind of emptying schedule, manure disposal will be a very real problem. Area farms may not want or be able to use this kind of production year after year. I would suggest Mr. Caruso do some preliminary investigating to determine if neighboring farms will take his manure product. A one million gallon (3.07 ac. ft.) holding pond is needed for the 90 day -storage cycle from the confined feeding and rearing sheds. 401 ..arso - Spec:a_ ermit (Contri. ) "' As shown on the plan, a pond constructed in this location will have its depth -severely limited due to the land slope. Over two years of research has gone into engineering my intended operation. I would like to explain several aspects of my operation which will directly affect Weld County and my neighbors. Although any large assembly of livestock will emit an odor, the concentration of this odor from my facility will be absolutely minimized. A filtration system utilizing large volumes of air and an aerobic digestor reagent will guarantee a minimum of pollutants. This will be true during both winter and summer months. The manure will be handled and processed in a concentrated liquid form. A one million gallon lagoon, sealed with an artificial plastic liner, will assure that no pollutants will leach into the soil. The liquid manure will be distributed to the farmers in the area as a very economical and effective fertilizer. The confinement system will consist of seven large buildings, five for feeders and two for holding, breeding and farrowing. A grinding and mixing mill along with massive grain storage bins will supply feed for 8,000 hogs. The swine will consume nearly 200,000 bushels of corn and 2,000 tons of concentrates per year. Ample on site storage will require only one feed delivery per month. Likewise, only one group of 1,200 hogs will go to market each month. This should keep additional traffic in the area to a minimum. Emporia Englewood, CO. 80111 The following information is provided in answer to your request for soil and site information for the E 5W3/4 of Section 31, Twp. 8N, Range 67W, Weld County, Colorado. r The above described area has the presence of three soil types: Aquolls & Aquepts, flooded (34-U) ; Otero sandy loam, 5 to 9 percent slope (53-D); and Nelson fine sandy loam, 3 to 9 percent slope (53M-CD). All three soils have severe limitations for the installation of animal waste sewage disposal systems. The Aquolls & Aquepts soils are usually wet with water tables at or near the soil surface, and these soils are usually associ- ated with drainage areas which makes them subject to surface water flooding. Construction of an animal waste lagoon on this soil is not advisable. The Otero soil has very rapid permeability in the subsoil portions, therefore it is not a recommended soil site for sewage lagoons due to the possible conta- i mination of ground waters by seepage. This soil area could be used if artificial pond sealing methods were used to prevent seepage losses. Land slope of the soil L will also be a limiting feature. The Nelson soil is a shallow soil with sandstone found at depths of 20 to 40 r inches. The sandstone is usually soft and easily dug, but may contain cracks, pores or fissures which may allow excessive seepage losses from a lagoon. However, sandstone could also be consolidated enough to allow rapid sealing and a lagoon could function properly provided the land slope permits the construction of a lagoon. I am writing at this time -to register my objections to this operation. I feel this constitutes a commercial f-arrowing and feeding operation and would be a commercial business rather than the open farming as presently zoned. In order to have this large of an operation would require increased use -of roads in the area to truck traffic bringing large amounts of grain into the operation and shipping the finished pigs back out. Due to the size of the acreage, nothing would be raised -on the premises . My main objection, however, is the tiossibility of odor from a hog farm. This would definitely decrease our property values when we eventuallysell our home. I understand that Mr. Caruso plans to institute a very clean operation. However, I am concerned that -onc-e it was approved and he ever desired to sell , there would be absolutely nothing that we could do aboutthe next _operator. 1 have lived next to some of the so-called modern hog -farrow- ing and aerated lagoon _operations back in Illinois and, quite -honestly, I have never been aroundone yet that does not have its own odor. We presently live next to a _cattle feeding operation with amninimal amount of airborne odors, but a swine operation is definitely odoriferous. Caruso September 16, 1980 SOILS AND FOUNDATION INVESTIGATION, LAGOON AND WATER RETENTION STRUCTURE ANALYSIS Scope This report presents the results of a soils and foundation investigation for the proposed hog confinement system located on the SW 1/4 31-8-67W, Weld County, Colorado. The purpose of this investigation was to determine soil conditions at the site and to provide recommendations for design and construction of foundations, structural backfill , and a lagoon. Soil Classification The area on which the lagoon and structures are to be located has been classified by the Soil Conservation Service (U.S.D.A. ) as Nelson Fine Sandy Loam (53M—CD) . An analysis of the soil, combined with historical data on such deposits, places it in the Unified Classification System as a sandy—silty loam, designated as ML —SM. The AASTO Soil Classification System characterizes this soil as A-4, a medium compact silty sand. Soil Composition and Engineering Values The sandy loam is composed of 10 percent clay, 30 percent silt, and 60 percent sand. It will display very low shrinkage and is non—sensitive. Approximately 40 percent will pass the No. 200 sieve. P1=12 and LL=30 for that portion passing the No. 40 sieve. The in—situ density is 110 PCF, and the average N value was 17 blows/feet, which represents a medium dense sand. Using N=17, the 0 value was calculated to be 32°. Values for cohesion were generally small , and did not exceed 100 PSF. Sandstone Layer A sandstone layer exists below the sandy loam at an average depth of three feet. Characteristically this formation consists of poorly to well—consolidated sediments exhibiting the physical properties of soil . For this report and investigation the sandstone will be treated as the sandy loam, realizing this is a conservative assumption. Bearing Capacity and Settlement Utilizing the engineering values listed above, an allowable soil pressure was calcualted using a maximum settlement of .75 inch 0 and a FS=2 for bearing capacity. Allowable bearing capacity far exceeded the allowable soil pressure for .75 inch of settlement. Therefore, the • smaller of the values, 1 .6 TSF, was selected using N value—settlement curves for sand. (Peck, 1964). Excavation and Compaction The site will be prepared by removing an average of eight feet of the overburden, exposing layers of sandstone mixed with sandy loam. When the upper portion of this layer is compacted to a minimum of 95% Standard Proctor, settlement and bearing capactiy values will approximate current in—situ conditions. Special care will be taken to insure that fissures, commonly found in these type deposits, be grouted or over excavated and recompacted when found to be within a bearing area. The depth of over excavation and recompaction will be determined by visual field inspections. Foundations Building foundations are shallow continuous or isolated spread footings. All footings should bear a minimum of three feet below finished grade to insure frost heave protection. Footing contact area will be free from all loose material. Slabs on grade should bear on undisturbed soil or compacted backfill at 95% Standard Proctor. With foundations depths to only three feet, and considering the physical characteristics of the site, groundwater location (greater than ten feet) is of little consequence. However, seasonal fluctuations may cause the groundwater level to rise slightly. To insure that this problem is not aggrevated, storm drainage should be directed well away from the buildings. Provided this is done, consolidation will be limited, and settlements should not exceed the original estimate of .75 inches. Lagoon Construction Permeability (k) of the sandy loam was estimated to be 10-4 cm/sec which is moderately rapid. To insure that none of the effluent from the lagoon leaches into the soil an artifical liner must be used. Since no abrasive or coarse materials will contact the liner, a relatively thin membrane can be utilized. An eight mill Black Poly Liner will prevent infiltration of the waste into the soil. Eight inches of cover over the liner will insure membrane compentency. A large quantity of structural backfill is needed to construct the lagoon. A 20 feet lift is required on the south side of the embankment and 10 feet lifts on the east and west sides to bring it up to the desired elevation. • This added overburden should present no problem for either allowable bearing capacity or settlement on the soil below. All backfill within two feet of the liner should be compacted to 100 percent Standard Proctor, with all other backfill compacted to 95 percent Standard Proctor. Lagoon sides will slope at 4:1 with outside slopes at 3:1 . The lagoon will be 270,-0" x 270, —0" x 10, —0". With eight inches of cover over the liner and at maximum fill level of 1 , —4" below the crest, the effective depth of the effluent becomes eight feet. Lagoon Efficency Using the dimensions of 260, —0" x 260, —0" x 8 ' —0" the lagoon will hold approximately 15,400 cubic yards, 3 million gallons or 9.5 acre feet of effluent. The large surface area (68,000 square feet) and shallow depth should allow aerobic digestion to take place efficiently. Mechanical aeration (3-10 hp aerators) will be supplied to supplement the biochemical oxygen demand, (at 350 #/day) accelerate digestion and prevent freezing during winter months. Waste BOD Load was calculated at 2,500 mg/ I . With proper digestion, and reclamation of the water used for flushing, lagoon capacity will approach 200 days. At 200 days the semi solid waste will be adequately thickened to make pumping and distribution economical . After the lagoon is in full operation, reclaim water should provide 70 percent of the total water required for flushing. Therefore, less than 5,000 additional gallons of raw water must be used daily to supplement flushing. Water Retention Structure (Pending) A natural drainage area funnels through the property and into a pond on the adjacent land to the east. The pond is fed exclusively from surface runoff. Pending approval , a dam will be built at the lowest point in this drainage area to retain approximately six acre feet of water. This reservoir would provide the 5,000 gallons of reclaim water needed daily for flushing. To contain this quantity of water a maximum dam height of ten feet would be necessary without major reshaping of the present landscape. The length of the dam would be approximately 400 feet. The reservoir would lie in an area of Aquolls and Aquepts (34—G) type soils. These areas are normally flooded with very high water tables, however water table levels are subject to seasonal fluctuations. The dam will be constructed using the sandy loam excavated from the building site. The surface preparation below the dam will include excavating two feet of the present overburden and recompacting soil into this area to form a monolithic keyway with the dam. This keyway will be the width of the dam base which will have 3:1 side slopes. The sandy—silty loam should be compacted to a minimum of 95 percent Standard Proctor, within two percent of the optimum moisture content. This compaction should provide a permeability of k=10-5 cm/sec. Due to the location and present topography of the area dam safety is not a 4INID IND problem. Total dam failure at maximum capacity would only add to the surface drainage pond located to the east where runoff water is presently held. Dam failure is unlikely due to low hyrostatic pressures, and the compaction of the soi I. An 18 inch drain line will also be installed at the low point of the dam in order to meet the necessary release requirements during demand periods. It will also provide a means to completely drain the reservoir. Summary Utilizing historical field and data, the soil conditions at the site warrant using only conventional foundation design procedures. Following accepted design standards for shallow footings should keep settlement on all structures within tolerable limits. The lagoon and proposed dam will only add an additional 1 ,000 PSF to the soil which is still well below the allowable soil bearing capacity.
