RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 117 - HENRY AND INGRID

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and

WHEREAS, the Board of County Commissioners of Weld County,

Colorado has reviewed the request of Henry and Ingrid Rusch for
an exemption from the definitions of "subdivision" and "subdivided
land" in Section 30-28-101 (10) , CRS 1973, as amended, and Section
iJ 2-1 of the Weld County Subdivision Regulations , and
; WHEREAS, the Board of County Commissioners finds that Henry
and Ingrid Rusch are the owners of certain parcels of land located
in part of the Northwest Quarter of Section 32, Township 9 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows :
The Northwest Quarter (Nigh) of Section 32,
Township 9 North, Range 65 West of the 6th
P.M. , Weld County, Colorado. Said described
parcel of land contains 160 acres , more or
less , including a strip of ground 30 feet
in width along the North and West lines of
said described parcel of land reserved for
county road right-of-way purposes and is sub-
ject to any rights-of-way or other easements
as granted or reserved by instruments of
record or as now existing on said described
parcel of land.

A parcel of land located in the NWa of Sec-
tion 32 , Township 9 North, Range 65 West of
the 6th P.M. , Weld County, Colorado being
more particularly described as follows :
Beginning at the NW corner of said Section
32 and considering the West line of said
Section 32 as bearing South 00°00 ' 00" West,
with all other bearings contained herein
relative thereto;
Thence South 00°00 ' 00" West, 562. 00 feet;
Thence South 89°51' 38" East, 387. 90 feet;
Thence North 00°00 ' 00" East, 562. 00 feet;

the Point of Beginning.
Said described parcel of land contains 5. 001
acres, more or less , including 0. 634 acres,
more or less, reserved for county road right-
of-way purposes and is subject to any rights-

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the abovedescribed
parcel be, and hereby is, declared to be exempt from the defi-
nitions of "subdivision" and "subdivided land" as set forth in
Section 30-28-101 (10) , CRS 1973 , as amended, and Section 2-1
of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
July, A.D. , 1980.

The owners of the property described above have requested an exemption from

The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the followings reasons:

CCHNENTS:
Ingrid Rusch has submitted a letter setting forth the reasons why this request
has been made. This quarter section was purchased as two separate parcels —
40 acres and 120 acres. The request, if approved, would reduce the 40 acre
parcel to 5 acres and combine the balance of the 40 acres with the 120 acres.
The end result will be two parcels — one being 5 acres and the other 155 acres
in size. No additional parcels are being created by this request.
