HomeMy WebLinkAbout20022780.tiff RESOLUTION RE: APPROVE LETTER OF AGREEMENT FOR BUENO HIGH SCHOOL EQUIVALENCY PROGRAM AND AUTHORIZE CHAIR TO SIGN - BUENO CENTER FOR MULTICULTURAL EDUCATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Letter of Agreement for the BUENO High School Equivalency Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the BUENO Center for Multicultural Education, commencing October 7, 2002, with further terms and conditions being as stated in said Letter of Agreement, and WHEREAS, after review, the Board deems it advisable to approve said Letter of Agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Letter of Agreement for the BUENO High School Equivalency Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the BUENO Center for Multicultural Education be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Letter of Agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 16th day of October, A.D., 2002. CENTER FOR MULTICULTURAL EDUCATION School of Education 04 ) LA C B C• campus Bow 249 University of Colorado Boulder,Colorado 80309-0249 (303)492-5416, FAX: (303)492-2883 Letter of Agreement This agreement, made this 7i"day of October 2002, by and between the BUENO High School Equivalency Program located in the BUENO Center at the University of Colorado, Boulder, Colorado,hereinafter referred to as "BUENO-HEP," and the Board of Weld County Commissioners of Weld County, Colorado, on behalf of the Weld County Division of Human Services' Employment Services of Weld County,hereinafter referred to as "Employment Services." WHEREAS,BUENO-HEP receives funds from the US Department of Education, Office of Migrant Education to provide services to qualified seasonal and migrant farmworkers so that they may earn their General Education Diploma(GED). NOW,THEREFORE, in consideration of the premises, the parties hereto convent and agree as follows: L PURPOSE AND GOAL A partnership between BUENO-HEP and Employment Services explores strategies to increase opportunities for seasonal and migrant farmworkers to enroll in a program of study leading to a General Education Diploma(GED)by: A. providing an afternoon GED program for qualified students; B. providing tutorials for all students participating in GNi training at Employment Services who need additional support and assistance to successfully pass the Official GED Test and C. providing funds for qualified students for the Official GED Test and supplemental books. Others eligible are those whom measure at least two grade levels below twelfth grade reading level or individuals whom are receiving public assistance. H. TERM The term of this agreement shall be for the period beginning October 7, 2002, and is subject to the provisions of Section IV herein and future written modifications requested by any of the parties. Any party who wishes to rescind this Agreement must provide written notice stating their intent to the other party at least thirty(30) days prior to the desired end date of the Agreement. III. SCOPE OF SERVICES A.BUENO-HEP will: 1. provide Intake on all students for entry into the program to identify qualified program participants; 2. provide services of a 20%time Program Recruiter to recruit qualified students for participation in the program; 3. provide services of a qualified GED instructor, paid though University of Colorado funds,four days per week between the hours of 1:00 p.m. and 4:30 p.m., Monday though Thursday, to prepare students to successfully pass all sections of the Official GED Test; 4 provide non consumable instructional materials for use by qualified program participants; 5. waive the Official GED testing fee for qualified program participants; 6. provide tutorial services to all students participating in GED training at Employment Services needing additional support so that they may successfully pass the Official GED Test; 7. provide program funds to purchase classroom supplies and supplemental instructional materials; and 8 provide program funds for charges associated with duplication and long distance telephone tolls. B. Employment Services will: 1. provide BUENO-HEP rent free office space for the Coordinator/Instructor of BUENO-HEP; 2. provide BUENO-HEP rent-free use of a classroom,Monday through Friday,between the hours of 1:00 pm—4:00 pm; 3. provide BUENO-HEP use of a telephone and copier. Employment Services shall bill BUENO-HEP for telephone and copier charges on a monthly basis; and 4. on a cost reimbursement basis, provide BUENO-HEP students services offered through the on-site computer lab. IV. MODIFICATION OF AGREEMENT All modifications to this Agreement shall be in writing and signed by all parties. V. SEVERABILITY If any term or condition of this Agreement shall be held to be invalid, illegal, or unenforceable,this Agreement shall be construed and enforced without such provision to the extent that this Agreement is then capable of execution within the original intent of the parties hereto. VI. NO THIRD PARTY BENEFICIARY ENFORCEMENT It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing contained in the Agreement shall give or allow any claim or right to action whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this Agreement shall be an incidental beneficiary only. VII. ENTIRE AGREEMENT The parties hereby agree that none have made or authorized any Agreement with respect to the subject matter of this instrument, other than expressly set forth herein, and no oral representation, promise, or consideration different from the terms herein contained shall be binding on any party, or its agents or employees, hereto. This Agreement embodies all Agreements between the parties hereto and there are no promises,terms, conditions, or obligations referring to the subject matter whereof than as contained herein. VIII. NO WAIVER OF IMMUNITY No portion of this Agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may posses,nor shall any portion of this Agreement be deemed to have related a duty of care, which did not previously exist with respect to any person not party to this Agreement. The parties hereto acknowledge and agree that no part of this Agreement is intended to circumvent or replace such immunities. IX. NON-APPRORIATION None of the parties hereto shall be required to expend its public funds for any of the understandings set forth herein, without the express prior approval of its governing body or director. Any financial obligations of the parties resulting from the promises, covenants and/or terms set forth therein shall be subject to annual appropriations as provided by law.
