USE BY SPECIAL REVIEW QUESTIONNAIRE
1. Explain, in detail, the proposed use of the property.
Currently,the property is being used as a delicatessen, gift shop, Colorado lottery
outlet, and Powerball outlet. I propose to add a liquor license to the
establishment. This would increase the business' overall profitability. There has
been slow growth over the past 4 'h years. The break-even point was achieved in
the tax year 1999;the year 2000 finally showed a small profit. The addition of a
liquor license would help to stabilize the business in the long term. This proposal
is not intended to create a bar-type atmosphere but rather to enhance the dining
experience for our customers. The present operating hours of 9:00 AM to 9:00
PM,Monday through Saturday, will remain unchanged for the immediate future,
but I would like to reserve the option of extending the closing time until
Midnight.
2. Explain how this proposal is consistent with the intent of the Weld County Code,
Chapter 22.
This proposal will contribute to the economic development of Weld County. We
have been the number one retail sales outlet for the Colorado Lottery since
approximately six months after first opening for business. We have a large
customer base; the addition of a liquor license would benefit Weld County and the
state of Colorado as a result of increasing our already substantial volume of ticket
sales.
3. Explain how this proposal is consistent with the intent of the Weld County Code,
Chapter 23 and the zone district in which it is located.
This proposal will not adversely affect any pre-existing use of land in the
immediate surrounding area. It will not interfere with and will not be
incompatible with agricultural or other activities. There will be negligible impact
upon local public services and taxpayers.
4. What types of uses surround the site? Explain how the proposed use is consistent
and compatible with the surrounding land uses.
Within Weld County there is pasture and one residence surrounding this site.
Across the state border into Wyoming there is one nightclub and two residences—
all owned by the applicant for this Use of Special Review.
5. Describe, in detail,the following:
a How many people will use this site?
From approximately 50 people to 1000peopleper day depending on the

status of the lottery.
b. How many employees are proposed to be employed at this site?
There are two shifts per day. Presently, there are 2 to 4 employees per
shift. With the addition of a liquor license, there would be 3 to 5
employees per shift.
c. What are the hours of operation?
Presently, 9:00 AM to 9:00 PM,Monday through Saturday—closed on
Sunday. With the addition of a liquor license, the daily hours may extend
to 12:00 Midnight.
d. What type and how many structures will be erected(built) on this site?
No additional structures are planned at this time. However, we propose to
attach an atrium and patio to the existing structure. A walk-in cooler
would have to be added to stock the beer and liquor.
e. What type and how many animals, if any, will be on this site?

None.
f. What kind(type, size, weight) of vehicles will access this site and how
often?
Most vehicles will be normal personal vehicles of customers and
employees(compact, medium, and large automobiles averaging 2500 lbs).
On an infrequent basis, there will be small to medium size delivery
vehicles(food, UPS)and trash removal vehicles.
g. Who will provide fire protection to the site?
As approved in the initial Special Use By Review Permit, both fire and
police protection is provided by Laramie County, WY, as their facilities
are closer and would provide a quicker response in an emergency. The
next closest fire company is in Nunn, CO, which would be immediately
notified by Laramie County officials. Already in place are fire, smoke,
and intrusion detection sensors monitored by Wyoming Security Company
in Cheyenne, WY.
h. What is the water source on the property?(Both domestic and irrigation).

The water source is well water from a well approved by Weld Co. and
located immediately adjacent to the structure on the Wyoming side of the
border. Water samples are done quarterly and sent to the EPA in Denver,
CO.
i. What is the sewage disposal system on the property? (Existing and
proposed).
Existing is a large septic system approved by Weld Co. Two restrooms
are located in the present facility. Attached are complete details and
drawings of existing septic system.
j. If storage or warehousing is proposed, what type of items will be stored?
None.
6. Explain the proposed landscaping for the site. The landscaping shall be
separately submitted as a landscape plan map as part of the application submittal.
No landscaping plans have been made at this time. Any future landscaping would
be minimal with the purpose of improving property appearance.
7. Explain any proposed reclamation procedures when termination of the Use by
Special Review activity occurs.
This is a permanent facility.
8. Explain how the storm water drainage will be handled on the site.
Attached map shows site drainage.
9. Explain how long it will take to construct this site and when construction and
landscaping is scheduled to begin.
The structure already exists and is in operation. Proposed additions, such as patio
and atrium, are explained in#5d, above.
10. Explain where storage and/or stockpile of wastes will occur on this site.
A fenced area on the Southwest corner of the building holds one dumpster that is
emptied weekly by Flyte Sanitation(a commercial trash removal company).
