Approved with Conditions
The Weld County Department of Planning Services has determined through administrative review that the
standards of Section 24-8-40.B.1 through 24-8-40.6.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The applicant has proposed a well as the source of adequate water for Lot A and Lot B. Property
owners are advised that the quality of water available for usage may be limited to specific uses, i.e.,
"Domestic Use Only," etc. Because each situation is unique, the Department of Planning Services
encourages property owners to contact the Office of the State Engineer, Division of Water Resources
(1313 Sherman Street, Room 818, Denver, Colorado 80203, Phone 303-866-3581), to discuss each
individual situation.
3. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 1475-25-2 RE-3285 '
DO; - 33 a5

B. In accordance with Chapter 8, Article II of the Weld County Code, Lot A shall utilize the
residential access. Direct access from a public road shall be limited to one access per legal
parcel for residential use,no circle drives or additional accesses shall be granted.The road shall
be graded and drained to provide all weather access. Accesses shall be placed in such a
location as to have adequate sight distance in both directions, shall not be placed below the
crest of a hill or where physical obstructions are present and shall be a minimum distance of 75
feet from any intersecting County or State roadway. The applicant shall utilize the existing
residential access to this parcel, and no additional accesses shall be granted.
C. Lot B shall use the existing agricultural/ oil and gas/ ditch road access points necessary for -
agricultural operations as no additional accesses shall be granted.
D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
E. Weld County Road 59 is designated on the Transportation Plan Map as a local gravel
road, which requires a 60-foot right-of-way at full build out. There is presently sixty (60)
feet of right-of-way. A total of thirty (30) feet from the centerline of Weld County Road 59 shall
be delineated right-of-way on the plat. This road is maintained by Weld County.
F. Weld County Road 6 is designated on the Transportation Plan Map as a local gravel
road, which requires a 60-foot right-of-way at full build out. There is presently sixty (60)
feet of right-of-way. A total of thirty (30) feet from the centerline of Weld County Road 6 shall
be delineated right-of-way on the plat. This road is maintained by Weld County.
G. The applicant shall attempt to address the requirements (concerns) of the Henry-Lyn Irrigation
Ditch Company, as stated in the referral response received March 22, 2002. Evidence of such
shall be submitted in writing to the Weld County Department of Planning Services.
H. The Southeast Weld County Soil Conservation District has provided information regarding the Z
soils on the site. The applicant shall submit written documentation that they have reviewed the
information and will use it to positively manage on site soils.
The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
J. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A, .
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.

3) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
4) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot B has an adequate water supply of sufficient
quality, quantity and dependability.
5) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
6) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code.
7) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
8) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Wdhout neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads; odor from animal confinement, silage, and
manure; smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed;-will not
• •
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
4. The applicant shall submit two(2) paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days
from the date the Administrative Review was signed. The applicant shall be responsible for paying
the recording fee.
5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are.dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps co.weld.co.us.
6. The Weld County Department of Planning Staffs approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

The Department of Planning Services' has reviewed your application and related materials for compliancy
with the Weld County Code. We find that your proposed Recorded Exemption meets the intent of the

please submit two (2) paper copies of your plat for review by the Department of Planning Services' staff.

RECORDED EXEMPTION QUESTIONNAIRE
1. Water Usage
A. Domestic use: A 200 foot deep domestic well exists on the 5 acre per State of
Colorado Office Of The State Engineer Registration. This well has been used
for irrigation of lawn and garden, drinking water, laundry, water for 414
animals, and fire protection. Said well was tested at 5 gpm on August 11,
2001 (Glover's Drilling Job Invoice 3441 enclosed). It is reasonable to expect
issuance of a domestic well permit for the 51.93-acre site as this is being done
all around the subject property.
B. Irrigation Water: Henry Lyn provides Irrigation ditch water. This water
comes into a concrete box at the southwest corner of the property and has
been fed into the acreage via plastic tubes and/or dirt ditches. There is one-
acre foot of water allocated for each existing acre (56.93 acres M/L).
2. Sewage Disposal: A 750-gallon septic system exists for the 5-acre site. This septic
system has provided adequate service and has never 'had' to be pumped since we've
owned the property, although we did pump it routinely as preventative maintenance.
Weld County Health Department Permit G-919113 is enclosed. We know of no
reason why another septic system permit would not be approved for the 51.93-acre
site as all requirements of the underlying zone district and the Weld County
Department of Public Health and Environment can be met.
3. Property Use: The house and improvements, which sit on the proposed nonprime 5
acres, has been used as our primary place of residence since 1986. The outbuildings,
approximately 3700 sq. ft. of enclosed space has been used as a garage, work shop,
chicken coop and barn space for 4H livestock (horses and pigs). There have been a
total of 4 head of horses at any one time and an occasional sow with a litter. A few
chickens (6 to 8) were kept around to produce eggs for our own consumption. The
other 51.93 prime acres have been used to produce row crops; corn, sugar beets, pinto
beans, and barley. Over the years this land was farmed by us, share cropped, and
cash rented.
4. Reason for Proposed Recorded Exemption: We have been advised that splitting the
house and improvements off from the prime land will make the entire property more
marketable. Five-acre properties with improvements and more affordable and
offering the larger lot without improvements makes it more affordable. We have had
this property on the market since spring 2001 and our real estate agent advises that
present day buyers cannot afford the entire package.

5. Proposed New Lot location, size, and present use: The existing improvements sit
on 5 acres that is outlined by trees and fences at the northwest corner of the 56.93
acres. Leaving 51.93 acres for the new lot with no improvements. Present use of the
51.93 acres is for irrigated row crops(corn, sugar beets, pinto beans, and barley).
Proposed use of the new lot is for residential and agricultural.
6. Unique Physical Characteristics: The entire 56.93 acres is flat which has been ideal
for irrigated row crops. There is a cedar tree line on the northwest side property line
which outlines the north side of the improvements, and a ponderosa tree line on the
south west side of the improvements. The remaining 51.93 acres is open field with a
neighbor's fence line on the far south side and a field road on the far east end. Weld
County Road 6 borders the north end of the property and Weld County Road 59
borders the west end of the property.
7. Setback Requirements: To the best of knowledge and per the County and State
paperwork we received when we purchased this property, all existing structures meet
minimum setback and offset requirements for the zone district which is 25 feet (one
foot for every three foot of building height).
8. Conservation easement: Not applicable.
9. Building Envelope: With regard to the proposed 51.93 acre lot (prime land) we are
proposing primary and alternative building envelopes as it is reasonable to expect a
buyer to will want to establish a residence. Both the primary and alternative building
envelopes are 5 acres each; one 5 acre envelope due east of the existing residence and
an alternative building envelope due south of the existing residence.
10. Weld County Code Chapter 22: It is our understanding that by right (Weld County
Code Chapter 22) we may split off improvements thereby creating a separate lot.
11. Proposed Uses Compatibility: We are proposing that both lots be used as residence
and agricultural which is compatible with the desire of Weld County to protect
agricultural land. Both lots would be in harmony with surrounding residential and
agricultural lots.

12. Weld County Code Chapters 22 and 23: Since we purchased this property, there
have been numerous homes built on smaller lots (5 to 35-acre sites). For example,
directly east of our property (within V2 mile) a home has been established on a 5-acre
lot, and further east of that,two homes have been built on the corner of WCR 6 and
WCR 61. Four homes have been built within two miles directly west of our property
on WCR 6 and another home has been built on the West Side of WCR 59 directly
across from the southwest corner of our property. From what I understand our plan
fits the Weld County comprehensive and zoning plans per Chapters 22 and 23. The
Henry Lyn water shares will be transferred in accordance with existing practices.
13. Weld County Code, Section 24-1-30: It is our understanding that this proposal is
consistent with Weld County Code, Section 24-1-30 in that only the farmstead (5-
acres of improvements) are being split from the prime land consisting of a proposed
lot of 51.93- acres. Both water and sewage provisions are adequate on the 5-acre lot
of improvements and the 51.93 acre lot is more than sufficient for providing adequate
water and sewage should another residence want to be placed on it. Both of the
proposed lots will remain as residential and agricultural properties. We are applying
for a Recorded Exemption with the Department of Planning Services and providing
the necessary documentation to support this request; Weld County Road access, copy
of Deed, well registration from the State of Colorado Division of Water Resources, a
septic system permit from the Weld County Health Department, a certificate of
Conveyance from the Land Title Guarantee Company, and a certificate from the
Weld County Treasurer indicating that no taxes are past due.

We (Laura L. and Thomas E. Willey) are requesting a subdivision exemption for our
property at 1978 Weld County Road 59,Keenesburg, CO 80643 (N1/2 of NW ''A SEC. 5,
TIN, R64W). This property is recognized as 56.93 acres (m/1) of which improvements
sit on 5 acres and 51.93 acres(m/1) are used for irrigated row crops. We acquired this
property in August 1986 from Robert Jakel. The property has been used as our place of
residence and to produce pinto beans, barley, sugar beets, and corn. The improvements,
which include approximately 3700 square feet of covered outbuildings have been used
for horses, chickens, and pigs; i.e. 4H projects.
We are requesting that the 5-acre lot with improvements be divided from the present
56.93 acres leaving 51.93 acres as a separate lot.
The purpose of this request is to allow sale of the improvements separate from the tilled
acreage which will make the entire property more marketable at this time. We have had
this property on the market since spring 2001 and our real estate agents advise that the
appraised price for the entire property is out of range for today's typical buyer.
We believe that this request is in accordance with our rights as well as Weld County's
desire to protect agricultural ground, as both of the proposed properties would remain
residential and agricultural lots.

The Weld County Public Works Department has reviewed this proposal. Our comments and
requirements are as follows:
COMMENTS:
WCR 59 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-
foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained
by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article Ill, Section 23-3-50, the required setback is measured from the future right-of-way line.

REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions
and not below the crest of a hill or where physical obstructions are present. (Lot B 51 ac parcel)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size
requirement. If the applicant chooses to place a larger culvert, please contact the Public Works
Department to adequately size your culvert.(Lot B)
Direct access from a public road shall be limited; only one access is allowed per legal residential
parcel. No circle drives will be allowed. In accordance with Chapter 8,Article II of the Weld County
Code, this policy shall apply to all new and existing accesses within the unincorporated areas of
Weld County. Properties within municipalities or other counties that access Weld County roads are
also subject to this policy.
The applicant shall utilize the existing residential access to this parcel, and no additional accesses
shall be granted. (Lot A)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the applicant/landowner
shall be responsible for controlling the noxious weeds.
The applicant shall complete a Weld County Road Access Information Sheet.

1. A Weld County Septic Permit is required for the proposed home septic system(s)
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
Additionally, please note the following:
1) This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

In consultation with the Natural Resources Conservation Service(NRCS), we have reviewed the above
referenced case and have the following comments.
SOILS/LIMITATIONS: The two predominate soils found on this parcel of land are both somewhat
limited for dwellings with or without basements and also are somewhat limited for septic tank absorption
fields and shallow excavations. The soils are well suited for windbreaks and landscape plantings
PRIME FARMLANDS: The two proposed building envelopes would take Prime Farmlands out of
production.
SOIL EROSION POTENTIAL: Surface runoff is slow and the hazard due to wind is low for both soils.
OTHER:If future land use will include grass establishment and grazing, we would recommend that the
new landowner contact the local NRCS office for guidelines on establishing and maintaining the grass and
grazing management. Additionally,the future landscape plan should address the reduction of water use
with the use of Xeriscape. We also recommend that Ron Broda,Weld County Vegetation Management
Specialist be contacted to assist the landowner in developing a weed management plan. Ron can be
contacted at 970-356-4000 x3770.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation

Dear Mr. Morgan,
This letter is in response to your inquiry regarding the property located in the NW4 of Section 25,
Township 1 North, Range 64 West of the 6" p.m., Weld County, Colorado. Planning Staff can not find
any evidence that Subdivision Exemption 414 was completed, therefore, the 2.671 acre parcel does not
exist as a separate legal lot. The 56.93 acre parcel owned by Thomas and Laura Willey is a legal parcel,
however, in Weld County, the minimum lot size in the Agricultural Zone District eligible for building
permits for a residence is 80 acres. One single family dwelling unit is a use by right per legal lot as
recognized in the Weld County Zoning Ordinance. Therefore, parcels of land under the minimum lot
size created after the 80 acre regulation went into effect are ineligible for a building permit, unless a
recognized process was utilized in creating the lot(s) in question or a Use by Special Review for a single
family residence is applied for and approved by the Board of County Commissioners. The actual sale of
a parcel 35 acres or larger but less than 80 acres is legal; it is the use of such a parcel for a residence
which is regulated under the Zoning Ordinance.
At this time, in order to create the 2.671 acre parcel originally requested by Subdivision Exemption 414,
the property owners must be approved for and complete a Recorded Exemption. Should the Recorded
Exemption be completed, both the 2.671 acre lot (Lot A) and the remaining 54.267 acre lot (Lot B)would
become legal lots eligible for building permits.
