The concerns that I have about the rezoning of this property are the operation of our
irrigation ditch (Roth/Winter Ditch) and environmental conditions of this proposed
change.
The irrigation ditch provides water to two farms south of the Lohr's farm. The land of
the ditch needs to remain agricultural and not be rezoned. There needs to be an area of at
least 25 feet on each side of the ditch reserved for our operation and maintenance of the
ditch. The "Right to Farm" rule needs to be part of this re-zoning
The next concern is, why does it need to be re-zoned? What Buildings will be built on
this land and how many. What plan is there for the disposal of the toilet waste and
chemicals used to clean and disinfect the portable toilets?
The neighboring land to this proposal, is our source of income and our residence.
Please help to protect our rights to continue to live and operate as we have in the past.

This firm represents Kerr-McGee Rocky Mountain Corporation ("Kerr-McGee").
Kerr-McGee has received the County's notice of a proposed hearing regarding the application
of Raymond and Dorthula Lohr ("Applicants") for a site specific development plan and use by
special review permit affecting a portion of the S/2NF/4 of Section 19, T. 6 N., R. 64 W., in
Weld Conley ("Application lands").
Kerr-McGee owns interests in oil and gas leases covering all of the Application Lands,
At present, Kerr-McGee operates two wells and associated production facilities on the
Application Lands. Based on its leasehold interests, Kerr-McGee has the right to drill
additional wells at locations authorized under the regulations of the Colorado Oil and Gas
Conservation Commission and to construct additional production facilities associated with such
wells.
Based upon the plat and other correspondence received from the Applicants, Kerr-
McGee understands that the proposed development is limited to a small area in the Southeast
corner of the Application Lands and will have no adverse effect on Kerr-McGee's present or
potential liiInra oil and gas operations on the Application Lands. Kerr-McGee therefore has no
objection to the development as platted.
