HomeMy WebLinkAbout20020746.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST INTERMOUNTAIN MOBILE HOME SERVICE, C/O TRENTON PARKER FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Intermountain Mobile Home Services, c/o Trenton Parker, VI #0200052, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 27th day of March, 2002, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Trenton Parker, contractor, and Joseph Danelock, President and CEO of Land Home Development, were present at said hearing, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Intermountain Mobile Home Services, Go Trenton Parker, and Land Home Development, do Joseph Danelock, to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. None of the mobile homes have the requisite permits for location on the property. No pre-move permits have been issued for the mobile homes brought onto the property.Thus,the above mentioned property is in violation of the following Section(s)of the Weld County Code: Chapter 23,Section 23-1-90"Definitions" MOBILE HOME:A transportable STRUCTURE which exceeds either eight(8)feet in width or thirty-two (32) feet in length, is built on a chassis and is designed, when connected to the required utilities, to be used as a year-round DWELLING UNIT with or without a permanent foundation. A SINGLE-FAMILY DWELLING which is certified pursuant to the "National Manufactured Housing Construction and Safety Standards Act of 1974,"42 U.S.C.5401 et seq., as amended, but does not meet all of the other provisions of the definition of MANUFACTURED HOME is considered to be a MOBILE HOME.A MOBILE HOME shall not be allowed to deteriorate to the condition of a DERELICT MOBILE HOME.A MOBILE HOME shall not be used as an AGRICULTURALLY EXEMPT BUILDING or as a TEMPORARY STRUCTURE for storage. No BUILDING, STRUCTURE or land shall be USED and no BUILDING or STRUCTURE shall hereafter be erected, structurally altered, enlarged or maintained in the A (Agricultural) Zone District except for one (1) or more of the following USES. . . Chapter 29, Section 29-3-10"Building permits required" No building or structure regulated by this Building Code shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a separate building permit for each building or structure has been first obtained from the Building Inspection Department. (Before any demolition permits are issued,approval must be given by the Department of Public Health and Environment) Chapter 29,Section 29-3-40"Additions,alterations or repairs" A.Additions,alterations or repairs may be made to any building or structure without requiring the existing building or structure to comply with all the requirements of this Chapter,provided that the addition, alteration or repair conforms to that required for a new building or structure. Additions or alterations shall not be made to an existing building or structure when such existing building or structure is not in full compliance with the provisions of this Building Code, except when such addition or alteration will result in the existing building or structure being no more hazardous based on life safety, fire safety and sanitation, than before such additions or alterations are undertaken. D. Alterations or repairs to an existing building or structure that are nonstructural and do not adversely affect any structural member or any part of the building or structure having required fire resistance may be made with the same materials of which the building or structure is constructed.The installation or replacement of glass and electrical devices shall be as required for new installations. Chapter 29, Section 29-3-70"Moved buildings" A. Building permits issued pursuant to this Article are required prior to any buildings or structures being moved into or within the County.A pre-move permit shall also be obtained from the Building Inspection Department and a pre-move inspection shall be made before a building permit is issued to determine any unsafe or substandard conditions.Any conditions determined to be unsafe or substandard as defined in Sections 29-11-30,29-11-40 and 29-11-50 of this Chapter and Chapter 10 of the Uniform Housing Code, will need to be corrected in accordance with approved plans and prior to the issuance of a certificate of occupancy. Chapter 29,Section 29-3-100"Mobile or manufactured homes" Mobile or manufactured homes no longer meeting the definition of a mobile home,as defined by Chapter 23 of this Code,and which has the entire frame removed, shall require a building permit,except those meeting the provisions of Section 29-3-20 B.13 of this Chapter.Floors shall comply with Section 2306.3 of the Uniform Building Code or alternate methods approved by the Building Official. Foundation requirements shall meet the standards of Section 29-2-90 B of this Chapter or alternate methods approved by the Building Official. Chapter 29, Section 29-3-120"Plot plan" A plot plan of the property, at suitable scale to show the location of the proposed building or structure,shall be submitted when application for a permit is made.The plot plan shall include distances from the property lines, access to the property, location and measurements of any easements or rights-of-way,identification of any county,state or federal roads or highways,and any existing structures and identification of their use on the property. Chapter 29, Section 29-7-10 "Permit required" No mobile, manufactured or factory-built home, as defined in this Building Code, may be located or relocated within the County without a building permit issued by the Building Official. Chapter 29, Section 29-7-20 "Additions,alterations, or repairs" Mobile,manufactured or factory-built homes to which additions,alterations or repairs are made shall comply with all requirements of this Building Code. A separate building permit shall be applied for as provided for in Article III of this Chapter. To bring your property into compliance with the Weld County Code,all of the mobile homes,structures and miscellaneous debris mustjbe removed from the property. The Board of County Commissioners meeting will take place in the County Commissioners'Hearing Room,First Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance to answer any questions the Board of County Commissioners might have about the violations. The Department of Planning Services will be recommending that the Board of County Commissioners authorize the County Attorney to proceed with legal action to remedy the violations, including,but not limited to,seeking restraining orders and injunctions against you which require the removal of the mobile homes, structures and miscellaneous debris. We have since discovered that this is a trailer salvage business moving from Commerce City. The property Mr. Parker is moving to is located between two housing developments and we feel it is inappropriate to allow ANY type of salvage or dumping operation this close to housing. There are many commercial areas where this type of operation can be located and not have the impact on property values and way of life. Mr. Parker has also brought in a large herd of horses. This area is known as "The Sand Hills" and with good reason. We have huge problems with erosion and blowing sand whenever the grass is disturbed or destroyed. A few hoses would have no significant effect on the land but we worry about the effects of a large herd. If Mr. Parker has such little regard for the law and the impact the trailers are having to our area then we doubt he would abide by the regulation of limited livestock per acre. If Mr. Parker is and has been in the trailer salvage business he should be held to a higher standard of compliance when it comes to building codes when choosing a property to relocate his business. He is simply ignoring the building codes and putting the burden of compliance on the adjacent property owners and the resources of Weld County. It has come to our attention that an individual leasing property at 17200 Weld County Road 8 is moving old, unusable mobile homes onto the property for storage. This is unacceptable for several reasons. First, it is my understanding this area is not zoned for this type of activity. Placing mobile homes on acreage for storage is therefore a violation of county regulations. Secondly, and most importantly, many of the residents in this area purchased acreage and have constructed attractive, expensive homes which we plan to live in for many years. We, as a neighborhood, have been trying to improve the area, and to ensure that our homes and property are well maintained. This area is known as "The Sand Hills" and with good reason. We have huge problems with erosion and blowing sand whenever the grass is disturbed or destroyed. A few hoses would have no significant effect on the land but we worry about the effects of a large herd. If Mr. Parker has such little regard for the law and the impact the trailers are having to our area then we doubt he would abide by the regulation of limited livestock per acre. If Mr_Parker is and has been in the trailer salvage business he should be held to a higher standard of compliance when it comes to building codes when choosing a property to relocate his business. It has come to our attention that an individual leasing property at 17200 Weld County Road 8 is moving old, unusable mobile homes onto the property for storage. This is unacceptable for several reasons. First, it is my understanding this area is not zoned for this type of activity. Placing mobile homes on acreage for storage is therefore a violation of county regulations. Secondly, and most importantly, many of the residents in this area purchased acreage and have constructed attractive, expensive homes which we plan to live in for many years. We, as a neighborhood, have been trying to improve the area, and to ensure that our homes and property are well maintained. Placing an eye sore such as this in our neighborhood will devalue our property and certainly create an image none of us want. I strongly encourage you to further investigate this situation, and to do whatever it takes to ensure that this activity is terminated as soon as possible.
