RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST INTERMOUNTAIN MOBILE HOME SERVICE, C/O
TRENTON PARKER FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Intermountain Mobile Home Services, c/o Trenton Parker, VI #0200052, is
allegedly in violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 27th day of March, 2002, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Trenton Parker, contractor, and Joseph Danelock, President and CEO of
Land Home Development, were present at said hearing, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Intermountain Mobile Home Services, Go Trenton Parker, and
Land Home Development, do Joseph Danelock, to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.
BE IT FURTHER RESOLVED by the Board, that the County Attorney be, and hereby is,
authorized to seek a Temporary Restraining Order to prevent any owners of property or
equipment from moving more items onto the subject properties.

compliance the property owner must remove all mobile homes and miscellaneous
debris .
The Department of Planning Services also recommends that the County Attorney
authorize legal action against any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties.

Dear Mr. Trenton Parker:
The property referenced above is'fin violation of the Weld County Code. Because of the on going addition of
mobile homes and miscellaneous debris, I have scheduled the matter to be heard atra meeting of the Board of
County Commissioners on March 27, 2002,at 9:00 a.m.,for the Boardto consider the violations occurring on
the property. As of this date, there are 13, (thirteen) mobile homes on the property. On March 14, 2002, you
were notified of the violations resulting from the addition of mobile homes. Also, a "stop work order" was
posted. Even though the violations are apparent,the addition of mobile homes and miscellaneous debris is still
occurring. None of the mobile homes have the requisite permits for location on the property. No pre-move
permits have been issued for the mobile homes brought onto the property.Thus,the above mentioned property
is in violation of the following Section(s)of the Weld County Code:
Chapter 23,Section 23-1-90"Definitions"
MOBILE HOME:A transportable STRUCTURE which exceeds either eight(8)feet in width or
thirty-two (32) feet in length, is built on a chassis and is designed, when connected to the
required utilities, to be used as a year-round DWELLING UNIT with or without a permanent
foundation. A SINGLE-FAMILY DWELLING which is certified pursuant to the "National
Manufactured Housing Construction and Safety Standards Act of 1974,"42 U.S.C.5401 et seq.,
as amended, but does not meet all of the other provisions of the definition of
MANUFACTURED HOME is considered to be a MOBILE HOME.A MOBILE HOME shall not
be allowed to deteriorate to the condition of a DERELICT MOBILE HOME.A MOBILE HOME
shall not be used as an AGRICULTURALLY EXEMPT BUILDING or as a TEMPORARY
STRUCTURE for storage.
Chapter 23, Section 23-3-20. Uses allowed by right.
No BUILDING, STRUCTURE or land shall be USED and no BUILDING or STRUCTURE shall
hereafter be erected, structurally altered, enlarged or maintained in the A (Agricultural) Zone
District except for one (1) or more of the following USES. . .
Chapter 23,Section 23-3-20.P
P. MOBILE HOME subject to the additional requirements of Article IV, Division 3 of this
Chapter.
Chapter 29, Section 29-3-10"Building permits required"
No building or structure regulated by this Building Code shall be erected, constructed,
enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a
separate building permit for each building or structure has been first obtained from the Building
Inspection Department. (Before any demolition permits are issued,approval must be given by
the Department of Public Health and Environment)
Chapter 29,Section 29-3-40"Additions,alterations or repairs"
A.Additions,alterations or repairs may be made to any building or structure without requiring
the existing building or structure to comply with all the requirements of this Chapter,provided
that the addition, alteration or repair conforms to that required for a new building or structure.
B. Additions or alterations shall not be made to an existing building or structure which will
cause the existing building or structure to be in violation of any of the provisions of this
Building Code, and such additions or alterations shall not cause the existing building or
structure to become unsafe. An unsafe condition shall be deemed to have been created if an
addition or alteration will cause the existing building or structure to become structurally unsafe
or overloaded, will not provide adequate egress in compliance with the provisions of this
Building Code, will obstruct existing exits, will create a fire hazard, will reduce required fire
resistance or will otherwise create conditions dangerous to human life.Any building so altered,
which involves a change in use or occupancy, shall not exceed the height, number of stories
and area permitted for new buildings. Any building plus new additions shall not exceed the
height, number of stories and area specified for new buildings.
C. Additions or alterations shall not be made to an existing building or structure when such
existing building or structure is not in full compliance with the provisions of this Building Code,
except when such addition or alteration will result in the existing building or structure being
no more hazardous based on life safety, fire safety and sanitation, than before such additions
or alterations are undertaken.
D. Alterations or repairs to an existing building or structure that are nonstructural and do not
adversely affect any structural member or any part of the building or structure having required
fire resistance may be made with the same materials of which the building or structure is
constructed.The installation or replacement of glass and electrical devices shall be as required
for new installations.
Chapter 29, Section 29-3-70"Moved buildings"
A. Building permits issued pursuant to this Article are required prior to any buildings or structures being
moved into or within the County.A pre-move permit shall also be obtained from the Building Inspection
Department and a pre-move inspection shall be made before a building permit is issued to determine any
unsafe or substandard conditions.Any conditions determined to be unsafe or substandard as defined in
Sections 29-11-30,29-11-40 and 29-11-50 of this Chapter and Chapter 10 of the Uniform Housing Code,
will need to be corrected in accordance with approved plans and prior to the issuance of a certificate of
occupancy.
Chapter 29,Section 29-3-100"Mobile or manufactured homes"
Mobile or manufactured homes no longer meeting the definition of a mobile home,as defined
by Chapter 23 of this Code,and which has the entire frame removed, shall require a building
permit,except those meeting the provisions of Section 29-3-20 B.13 of this Chapter.Floors shall
comply with Section 2306.3 of the Uniform Building Code or alternate methods approved by
the Building Official. Foundation requirements shall meet the standards of Section 29-2-90 B
of this Chapter or alternate methods approved by the Building Official.
Chapter 29, Section 29-3-120"Plot plan"
A plot plan of the property, at suitable scale to show the location of the proposed building or
structure,shall be submitted when application for a permit is made.The plot plan shall include
distances from the property lines, access to the property, location and measurements of any
easements or rights-of-way,identification of any county,state or federal roads or highways,and
any existing structures and identification of their use on the property.
Chapter 29, Section 29-7-10 "Permit required"
No mobile, manufactured or factory-built home, as defined in this Building Code, may be
located or relocated within the County without a building permit issued by the Building
Official.
Chapter 29, Section 29-7-20 "Additions,alterations, or repairs"
Mobile,manufactured or factory-built homes to which additions,alterations or repairs are made
shall comply with all requirements of this Building Code. A separate building permit shall be
applied for as provided for in Article III of this Chapter.
To bring your property into compliance with the Weld County Code,all of the mobile homes,structures and
miscellaneous debris mustjbe removed from the property.
The Board of County Commissioners meeting will take place in the County Commissioners'Hearing Room,First
Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services will be recommending that the Board of County Commissioners authorize
the County Attorney to proceed with legal action to remedy the violations, including,but not limited to,seeking
restraining orders and injunctions against you which require the removal of the mobile homes, structures and
miscellaneous debris. Our records indicate that you were made aware of the nature of the violation over one

Please also be advised that I will be taking video from the road or adjacent properties a few days before the
Violation Hearing (indicated above).
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call

We are writing concerning the property which runs behind our house. A week ago many trailers began to
be moved on to this property and every day since more and more are being brought in.
We have since discovered that this is a trailer salvage business moving from Commerce City. The
property Mr. Parker is moving to is located between two housing developments and we feel it is
inappropriate to allow ANY type of salvage or dumping operation this close to housing. There are many
commercial areas where this type of operation can be located and not have the impact on property values
and way of life.
Mr. Parker has also brought in a large herd of horses. This area is known as "The Sand Hills" and with
good reason. We have huge problems with erosion and blowing sand whenever the grass is disturbed or
destroyed. A few hoses would have no significant effect on the land but we worry about the effects of a
large herd. If Mr. Parker has such little regard for the law and the impact the trailers are having to our
area then we doubt he would abide by the regulation of limited livestock per acre.
If Mr. Parker is and has been in the trailer salvage business he should be held to a higher standard of
compliance when it comes to building codes when choosing a property to relocate his business. He is
simply ignoring the building codes and putting the burden of compliance on the adjacent property owners
and the resources of Weld County.

I am writing this letter to voice my strong opposition to a recent development in our
neighborhood. It has come to our attention that an individual leasing property at 17200
Weld County Road 8 is moving old, unusable mobile homes onto the property for
storage. This is unacceptable for several reasons. First, it is my understanding this area
is not zoned for this type of activity. Placing mobile homes on acreage for storage is
therefore a violation of county regulations. Secondly, and most importantly, many of the
residents in this area purchased acreage and have constructed attractive, expensive homes
which we plan to live in for many years. We, as a neighborhood, have been trying to
improve the area, and to ensure that our homes and property are well maintained. Placing
an eye sore such as this in our neighborhood will devalue our property and certainly
create an image none of us want.
I strongly encourage you to further investigate this situation, and to do whatever it takes
to ensure that this activity is terminated as soon as possible. We are willing to pursue
whatever avenues may be necessary to rectify the situation. Please let me know if there
is anything else I can do. Thank you for your attention in this matter.

As residents of Country Estates, we are extremely concerned with the property violations
on LOT B of Am Re-704, also known as part of the NW4, of Section 24, TIN, R66W of
the 6th P.M., Weld County, Colorado.
Junk, decrepit mobile homes, in very poor and unsightly condition, are appearing on this
property, causing it to look like a mobile home salvage yard. We do NOT wish to live in
a neighborhood that borders a salvage yard.
If this is allowed to continue, the value of our property, and those of the surrounding
areas, will plummet. The property in question is between two residential subdivisions,
whose property values have increased significantly in the last five years. These properties
stand to lose this increase in value, plus more, if a salvage operation is allowed to
continue on LOT B of Am Re-704.
We are surprised that Weld County would tolerate such a violation of zoning, as it will
greatly impact the surrounding property values, and therefore, the County's tax base. The
County has benefited significantly from the increased taxes assessed properties in
Country Estates and nearby subdivisions. Why would the County wish to jeopardize
this increased tax flow?A salvage yard will not generate even a fraction of the revenue it
stands to detract from surrounding properties.
We strongly urge you to stop and prevent any such zoning violations, both now and in the

This letter is in regards to Subject - VI-0200052 . Lot B of Am

of the 6th P.M. , Weld County, Colorado.
We live at 2872 Tate Avenue, Ft . Lupton, Co. & there is a "junk
yard" of trailers & old buses going up in the property adjacent
to the east of ours . This is quite an eye sore along with the
possibility of being very dangerous.
We were under the assumption that our area is not zoned for this
kind of activity and the majority of the neighborhood (at least
the ones adjacent to the property) would have to be notified
about any of these kind of changes & get our vote (approval)
before doing any of this. We were not notified nor do we
approve .
Questions & or things we would like you to concider:
1 . How can a farm business all of a sudden turn into a trailer,
old bus, etc. storage area?
2 . What is going to happen to all the trash that is blown from
there into our yards? This will happen! We have strong winds
that are not broken up by the housing as it is in a city. So
anything loose will by flying.
3 . What about the contamination of our wells from the leaking oil
and gasoline from the old buses that were brought in?
4 . There is also the possibility of more chance of fire & the
insulation from all of the beat up buildings flying into our
properties . More Hazard! ! !
5 . I also believe this will bring on more rodents, & a
possibility of transients .
6 . If some children or others find this "out of the way" spot for
partying - whats to keep them from coming into our area &.causing
trouble?
To close, we have lived here for almost 30 years & have had a
beautiful view. Now it is being ruined daily by the sight of
trash.

Junk mobile homes are being hauled to the above-mentioned property creating the appearance of a
mobile home salvage yard.
If this is allowed to continue, we feel the value of our property and properties surrounding the acreage
with the derelict mobile homes will be reduced. As a homeowner in close proximity to this site, we are
totally against a salvage yard in our neighborhood.

We wish to express our opinion in favor of enforcement of county zoning ordinances. In
particular the storage and accumulation of junk automobiles, trailers and other unsightly
items. South central Weld county has become primarily residential acreage.
Accumulation of"junk" detracts from the beauty of the country side and decreases the
appeal of property resulting in lower property values.
We support any action the Commissioners deem appropriate to enforce zoning
ordinances. We support the Commissioners in keeping land use in accordance with

We have since discovered that this is a trailer salvage business moving from Commerce City. The
property Mr. Parker is moving to is located between two housing developments and we feel it is
inappropriate to allow ANY type of salvage or dumping operation this close to housing. There are many
commercial areas where this type of operation can be located and not have the impact on property values
and way of life.
Mr. Parker has also brought in a large herd of horses. This area is known as "The Sand Hills" and with
good reason. We have huge problems with erosion and blowing sand whenever the grass is disturbed or
destroyed. A few hoses would have no significant effect on the land but we worry about the effects of a
large herd. If Mr. Parker has such little regard for the law and the impact the trailers are having to our area
then we doubt he would abide by the regulation of limited livestock per acre.
If Mr_Parker is and has been in the trailer salvage business he should be held to a higher standard of
compliance when it comes to building codes when choosing a property to relocate his business. He is
simply ignoring the building codes and putting the burden of compliance on the adjacent property owners
and the resources of Weld County.

To Whom It May Concern:
I am writing this letter to voice my strong opposition to a recent development in our
neighborhood. It has come to our attention that an individual leasing property at 17200
Weld County Road 8 is moving old, unusable mobile homes onto the property for
storage. This is unacceptable for several reasons. First, it is my understanding this area
is not zoned for this type of activity. Placing mobile homes on acreage for storage is
therefore a violation of county regulations. Secondly, and most importantly, many of the
residents in this area purchased acreage and have constructed attractive, expensive homes
which we plan to live in for many years. We, as a neighborhood, have been trying to
improve the area, and to ensure that our homes and property are well maintained. Placing
an eye sore such as this in our neighborhood will devalue our property and certainly
create an image none of us want.
I strongly encourage you to further investigate this situation, and to do whatever it takes
to ensure that this activity is terminated as soon as possible. We are willing to pursue
whatever avenues may be necessary to rectify the situation. Please let me know if there

what appears to be a derelict mobile home salvage yard on the SW corner of the
NW quarter of Section 24, Township 1 N, Range 66W.
We understand that this is in violation of existing Building Code and Zoning
regulations.
An enterprise such as this has no place in a community of acreage type homes.

Junk mobile homes are being hauled to the above mentioned
property creating the appearance of a mobile home salvage yard.
If this is allowed to continue , I feel the value of my property, ;�

There is evidence that Mr. Parker is the owner at the Roggen site. Because of a conversation with the County
Attorneys office, the Roggen site has been added to the violation. In the hearing on March 27, 2002, Mr. Parker
did admit to owning the mobile homes in question. At the hearing on the 27u1 of March, Mr. Parker did admit
that those mobile homes were his.
