Dear Sheri:
I had an opportunity to meet with representatives for Western Mobile last week to discuss their proposed concrete plant
near the intersection of State Highway(SH) 119 and Weld County Road(WCR 7).
Based upon that meeting and the traffic study,CDOT would have no objections to the proposal provided highway
improvements be built to accommodate the increased traffic volume and types. It is my understanding that Western is
agreeable to the necessary improvements.
As a result of this proposal,CDOT would like to request that the County participate in a discussion regarding the
signalization of WCR 7. Attendees of the meeting should include Monica Daniels Mika,Don Carroll,Drew Scheltinga,
Tess Jones,and Frank Hempen. I will be attempting to schedule that meeting for March 27,2002 at 9:00 am in our
offices.

Last month(February 2002), I copied you on a letter(dated January 29, 2002)
addressed to Mr. Carl Mount, with the Colorado Division of Minerals and Geology
(DMG). The purpose of my letter to Carl was to describe Western Mobile, Inc.'s
(WMI's) plans to develop a portion of the Heaton property for a ready-mix concrete plant
and how to demonstrate DMG permit compliance to Weld County.
Enclosed with this letter is a copy of Carl's written response (dated February 14,
2002)to the above-referenced letter. Based on this letter, it would appear that the DMG
would have no problem releasing the area under USR 1360 from the current DMG
permit. Therefore, please review the enclosed letter and let me know if the DMG's
approach in this matter is acceptable to Weld County.

Dear Mr. Hart:
This letter addresses your letter dated January 29, 2002 and received by the Division of Minerals and
Geology (DMG) on January 30, 2002. That letter requested whether placement of a concrete batch plant
on a parcel of land presently in Permit Area M-1987-176 is acceptable to DMG. Specifically, this batch
plant would be located directly south of Colorado State Highway 119 and directly west of Weld County
Road 7.
The DMG normally handles these types of cases by checking what the designated end land use is and
whether the proposed plans for development would fall within the proposed end land use designated in the
permit application form. In this case, the end land uses for the permit area are industrial, wildlife habitat
and developed water resource. These would allow the proposed land use under the DMG permit. Further,
this proposed ready-mix plant would be fed from a number of different sources of gravel thus making it a
"custom" ready-mix plant which would not need to be tied to a specific permit area ("captive" ready-mix
plant).
In the case of custom ready-mix plants, DMG normally allows release of the area that will be used for the
custom plant once County approval is demonstrated and release of the area from the DMG permit is
requested. The release request would have to follow the procedures outlined in Rule 4.16 of the
Construction Material Rules and Regulations.

This letter is in opposition to a request submitted by Western Mobile, Inc. (Lafarge). The
applicant is requesting a Special Review Permit for a Mineral Resource Development
Facility, including a Concrete Batch Plant. The proposed facility would be located on the
southwest corner of Highway 119 and Weld County Road 7.
The property in question is in an agriculturally zoned area. The existing Mining Permit
1199 that Western Mobile operates under is estimated to expire in 2003 and calls for the
land to revert to green belt and tow density housing. The permit also allows for a
concrete batch plant providing Western Mobile is still engaged in mining operations on
the property. The site in question has already been mined and any materials used by the
batch plant will have to be hauled in and out. The Special Review Permit would
therefore be, in essence, changing the zoning for the duration of the permit(recently
proposed as 15 years) and could open the door to permanent heavy industrial land use
at the site. At the very least, Western Mobile should be required to apply for a new
(PUD) zoning permit or the 1-V2 years left on the original permit should be followed.
This proposed change in zoning has already been addressed in this area and has been
rejected. Varra Mining Company established a wholesale and retail landscaping materials
business on the southeast corner of Highway 119 and Weld County Road 7. This
business was forced to cease operations because they were not in compliance with
existing zoning laws. A concrete batch plant, which was in operation on the Frontage
Road north and west of the intersection of Highway 119 and Interstate 25, was also
forced to close. It would be unjust to grant a permit to Western Mobile in light of these
previous decisions.
Colorado State Parks and Recreation has been in negotiations with Western Mobile and
other property owners in the area to buy land as part of proposed open space. This
open space includes a tract of land adjacent to the site in question that has already
been purchased by the City of Longmont. Western Mobile has ceased all negotiations
with the state pending approval of this Special Review Permit. In fact, in anticipation of
the approval of this permit, Western Mobile has been hauling riprap, recycled materials,
and other trash fill onto the site to build up the ground level. In addition they have left
several large unsightly earth mounds on the property purchased by the City of
Longmont. Western Mobile does not appear to be participating in any valid reclamation
plan.

The question of safety is an important factor to be considered. The intersection of
Highway 119 and Weld County Road 7 already experiences heavy traffic. There has
been some mention by Western Mobile of installing a traffic signal if warranted.
However, their history in this regard should be noted. Thirty years ago, when Western
Mobile began operations in the area, there was concern that the existing bridges on
WCR 7 would not withstand the weight of the gravel trucks. Western Mobile agreed to
provide for upgrades to the bridges. They then approached the St. Vrain Valley School
District claiming that the safety of its school buses must also be in question. Eventually,
the school district footed the bill for the improved bridges.
In summary, the zoning and land use as stated in the anginal mining permit should be
followed or Special Permit should be limited in duration to the length of the original
permit (an additional 1 1/2 years from now). Western Mobile has already been granted a
batch plant permit on Weld County Road 20 1/2, approximately two miles from the
property in question. To allow a Special Permit to be granted for the Weld County Road
7 site would cause traffic hazards, safety concerns, pollution, negative environmental
impact, and decreased property values. There is a very good reason why Weld County
received the Governor's Smart Growth Award in 2000. Western Mobile's application is
not good for Weld County or its residents.
I ask the County Commissioners to reject Western Mobile's application for a Mineral
Resource Development Facility,

SUBJECT Supplemental Turn Lane Analysis of Heaton Ready-Mix Concrete Plant

The purpose of this memorandum is to address comments received in the January 4, 2000
memorandum from Mr. Donald Carroll, Weld County Engineering Administrator regarding the
traffic impact study for the above referenced project. In that memo, it was requested that an
entrance analysis be conducted for the access driveways on Weld County Road 7 (WCR 7) to
determine any turn lane needs at those locations.
The Colorado Department of Transportation (CDOT) State Highway Access Code was used to
determine auxiliary lane needs. Category NR-C, non-rural arterial, was selected because it best
typifies the nature of WCR 7. NR-C describes roads with low to moderate travel speeds and
relatively moderate volumes over medium and short travel distances.
Based on NR-C standards for left turn lanes, for roadways with posted speed limits of 40 mph or
higher (WCR 7 has a posted speed limit of 45 mph in the vicinity of the project) a left turn lane
with storage length plus deceleration and taper length is required for any access with a
projected left turn volume greater than 10 vehicles per hour (vph). Less than 5 vehicles are
forecast for the northbound left turn movements during any hour at either driveway. Thus, a left
turn lane is not required at either location.
Based on NR-C standards for right turn lanes, for roadways with posted speed limits of 40 mph
or higher, a right turn lane with storage length plus taper length is required for any access with a
projected peak right ingress turning volume greater than 25 vph. Less than 10 vehicles are
forecast for the southbound right turn movements during any hour at either driveway. Thus, a
right turn lane is not required at either location.

Dear Carl:
This letter is written as a follow-up to our discussion last Friday, January 25,
2002, regarding Western Mobile, Inc.'s (WMI's) plans to locate a ready-mix concrete
plant on a portion of the above-referenced sand and gravel site.
As we discussed, WMI's current DMG and Weld County Permits allow the
company to locate and operate a ready-mix concrete plant at the Hamm Pit, specifically,
on a 23-acre parcel located in the northwest quadrant of the intersection of Colorado State
Highway 119 and Weld County Road (WCR) #7. For a variety of operational reasons,
WMI has applied to Weld County to relocate the approved ready-mix plant from the
north side of Highway 119 to the south side of 119 immediately west of WCR 7.
Because ready-mix plants are allowed as a use by special review(USR) in the "A"
Agriculture Zone in Weld County, independent of mining, WMI has applied for USR
approval (Permit#1360) specifically to operate a concrete plant at the location described
above. To date, USR 1360 has been heard and approved by the Weld County Planning
Commission and will soon be scheduled to come before the Board of County
Commissioners.
Assuming that the Weld County Commissioners approve USR 1360, the County
wants to know that the proposed use is acceptable to the DMG. The question is how to
indicate DMG Permit compliance to Weld County. In 1998, WMI sought to amend M-
87-176 to add additional land to the "Hamm Pit" Permit boundary. The "Heaton"
property is shown as Area"C" on the amended Mining and Reclamation Plans. The
DMG Permit Amendment submittal states that one of the post mining land uses for the
property is industrial/commercial. At¶6.1, Post-Mining Land Use indicates that a portion
of Area"C" (Heaton) is proposed for future development following reclamation.

As stated above, Weld County's Land Use Code allows concrete plants to operate
in the "A" Zone as a Use by Special Review;therefore, if WMI receives approval for
USR 1360, the Company will have the zoning authorization necessary to request removal
of the 16.4 acre concrete plant area from DMG Permit M87-176. If this approach is
acceptable to the DMG, a letter to me indicating that fact would likely meet the County's
need in this instance.

Dear Commissioners,
This proposed plant will result in more traffic on WC R 7, sout h of Hwy 119. This road is already
heavily traveled by gravel semi-trucks. The intersections of WCR 7 and Hwy 119 and WC R 7 and
Hwy 52 are not traffic signal light controlled and do not have adequate turn and acceleration lanes
which will further be a public endangerment with additional truck traffic from this site. There are
inadequate shoulders on WCR 7 aid t is our experience that even with aroad maintenance agreement
with the Weld Department of Public Works, road surfaces will deteriorate with the increased traffic
on the ncluded n the agreement. Further,unnecessarily increasing truck traffic to the proposed plant
will result from the fact that sand and gravel to be batched will be imported to the plant from remote
locations, since this site has already been mined out. A plant located on an active mining site does not
create this additional traffic. Compounding the traffic problems on WCR 7 isthe relocation underway
of the Camas operations on the Rademacher property north of Hwy. 119 to the pit on WCR 7 on the
Camenisch propert y. The number of trucks that will be using WCR 7 between Hwy. 119 and Hwy.
52 is simply incomprehensible. What kind of traffic studies have been done to det ermine the true
impact of both batch plants on the areas roads?
Although the elevation of the site has been raised,there is no assurance that it is above the base flood
elevation of the flood plain since:
1. There has never been a study determining that elevation at the site, only an estimate.
2. So many changes to the flood plain have been permitted since the estimate was made,
any elevations, had they been determined, would have significantly changed.

COMMENTS: As you know Weld County Public Works and Planning Services held a meeting with
Tess Jones and Gloria Hice Idler with the Colorado Department of Transportation. The meeting was in
regards to signalization at Weld County Road 7 and Highway 119. All were in agreement that a light is
warranted at the intersection. Funding the project was discussed but not resolved. You indicated at the
Planning Commission hearing that you were in agreement with funding a portion of the light. As
requested at the Planning Commission hearing,Weld County Staff would like you to submit a proposal
which would include what funds you are willing to offer towards the project prior to the Board of County
Commissioners hearing.

Dear Ms. Lockman:
This letter is written in response to your request for a proposal from Western
Mobile, Inc. (WMI), a subsidiary of Lafarge North America, Inc. (Lafarge) regarding the
signalization of the intersection of Weld County Road 7 (WCR 7) and Colorado State
Highway 119 (SH 119).
After due consideration of your request, WMI offers the following for Weld
County's consideration, assuming that the Weld County Board of Commissioners
approves USR 1360 for a period of not less than fifteen (15) years from the date of the
Board of County Commissioners' resolution:
1. In order to signalize the intersection of WCR 7 and SH 119 as soon as possible
following County approval of USR 1360, WMI proposes to pay 100% of the cost of
construction for said signalization provided that:
a. The Colorado Department of Transportation (C-DOT) provides the
engineering, design, and all necessary construction documentation for
signalization and,
b. There is a mechanism by which WMI is reimbursed for their up-front cost of
construction within a period of not more than six (6) months after construction
is completed, less the Company's prorated percentage of the cost.
2. WMI will be authorized by Weld County to construct and operate their ready-mix
concrete batch plant prior to signalization of the intersection of WCR 7 and SH 119.
3. Weld County will delete road improvement requirements C.(2), C.(4), and C.(5) if
the intersection of WCR 7 and SH 119 is signalized.

file in the Weld County Planning and Zoning regarding this issue, as well as the addendum
following this petition, express our objections in allowing this facility under no circumstances to
be built in the location south of and adjacent to State Highway 119 and west of and adjacent to
Weld County Road#7.
We the undersigned landowners and residents want to state the following firmly and without any

complaint regarding the applicant Western Mobile, Inc. They are requesting a specific
development plan and use by special review permit #1360 for a mineral resource development
facility to include building a cement batch plant and an asphalt plant on the below property in an
"A" agricultural zoned district and low density housing. The numerous complaints that are on
file in the Weld County Planning and Zoning regarding this issue, as well as the addendum
following this petition, express our objections in allowing this facility under no circumstances to
be built in the location south of and adjacent to State Highway 119 and west of and adjacent to
Weld County Road#7.
We the undersigned landowners and residents want to state the following firmly and without any
compromise whatsoever. We are absolutely opposed to the building of such plants on this site.

To Whom It May Concern:
This letter, signed by the area residents (attached), is in opposition to a request
submitted by Western Mobile, Inc. (Lafarge). The applicant is requesting a Special
Review Permit for a Mineral Resource Development Facility, including a Concrete Batch
Plant. The proposed facility would be located on the southwest corner of Highway 119
and Weld County Road 7.
The property in question is in an agriculturally zoned area. The existing Mining Permit
1199 that Western Mobile operates under is estimated to expire in 2003 and calls for the
land to revert to green belt and low density housing. The permit also allows for a
concrete batch plant providing Western Mobile is still engaged in mining operations on
the property. The site in question has a/ready been mined and any materials used by the
batch plant will have to be hauled in and out The permit would therefore be changing
the zoning for the duration of the permit(recently proposed as 15 years) and allow for
permanent, heavy industrial land use at the site. At the very least, Western Mobile
should be required to apply for a new (PUD) zoning permit or the 1-1/2 years left on the
original permit should be followed.
This proposed change in zoning has already been addressed in this area and has been
rejected. Varra Mining Company established a wholesale and retail landscaping materials
business on the southeast corner of Highway 119 and Weld County Road 7. This
business was forced to cease operations because they were not in compliance with
existing zoning laws. A concrete batch plant, which was in operation on the Frontage
Road north and west of the intersection of Highway 119 and Interstate 25, was also
forced to close. It would be unjust to grant a permit to Western Mobile in light of these
previous decisions.
In anticipation of the approval of this permit, Western Mobile has been hauling riprap,
recycled materials, and other trash fill onto the site to build up the ground level. This
practice is not permissible under the existing permit. In addition, they have left several
large unsightly earth mounds on the adjacent property. This is disturbing a tract of land
that is legally outside of the permit area. This issue and the failure of Western Mobile to
comply with the original permit, needs to be addressed by the State of Colorado,
Division of Minerals and Geology before they will allow release of the area.
The question of safety is an important factor to be considered. There are numerous
school bus stops along Weld County Road 7. School children in all three levels of
education are picked up and dropped off six times per day, during peak hours for truck
traffic. Who will be responsible for monitoring the safety of these children? In addition,
who will be accountable for monitoring pollution levels, ground water contamination,
noise, and dust? What levels will be considered acceptable? Who will be responsible for
insuring that the agreed upon hours of operation are adhered to?
In summary, the zoning and land use as stated in the original mining permit should be
followed ora Special Permit should be limited in duration to the length of the original
permit (an additional 1 1/2 years from now). To allow a Special Permit to be granted for
the Weld County Road 7 site would cause traffic hazards, safety concerns, pollution,
negative environmental impact, and decreased property values. There is a very good
reason why Weld County received the Governor's Smart Growth Award in 2000. Western
Mobile's application is not good for Weld County or its residents.
We ask the County Commissioners to reject Western Mobile's application for a Mineral
Resource Development Facility.
