Environmental Health Services has reviewed this proposal for a mineral resource development facility including an asphalt and concrete batch plant. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. In the event that the proposed the maintenance/garage facility is equipped with a floor drain system, the applicant must apply for an Underground Injection Control (UIC) Class V Injection Well permit through the Environmental Protection Agency (EPA), or provide evidence that the applicant is not subject to the EPA Class V requirements. 2. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Health and Environment for emissions of criteria, hazardous or odorous air pollutants. 3. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health& Environment, for approval prior to operation. 4. If applicable, a CPDS Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways. 5. The applicant shall provide evidence that any vehicle washing area will be designed and constructed to capture all effluent and prevent any discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission and the Environmental Protection Agency. 6. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include EXHIBIT / Header Page 2 expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed(including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as "development standards": 1. The facility shall operate in accordance with the approved dust control plan. The facility shall have sufficient equipment available to implement appropriate dust control. Additional control measures shall be implemented as required by the Weld County Health Officer. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a "solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,blowing debris, and other potential nuisance conditions. 5. Fugitive dust shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 7. The facility shall utilize the existing municipal sewage treatment system. (St. Vrain Sanitation District) 8. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 9. The facility shall utilize the existing public water supply. (Left Hand Water District) 10. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 11. The operation shall comply with all applicable rules and regulations of the Colorado Division of Minerals and Geology. Header Page 3 12. Adequate hand washing and toilet facilities shall be provided for employees. 13. The operation shall comply with the Occupational Safety and Health Act(OSHA). 14. COLORADO The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 7 is designated on the 1-25 Mixed Use Development Area Structural Plan as an arterial, four-lane road with a painted medium with secondary road, which requires a 100-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code,Chapter 23,Article III, Section 23-3-50,the required setback is measured from the future right- of-way line. Traffic Counts: The average daily traffic (ADT) count for WCR 7 is 781 vehicles, taken in a 24-hour period on September 19, 2000. The ADT for State Highway 119 at the intersection of WCR 7 reflects 12,900 vehicles, taken in 1995. REQUIREMENTS: Future Right-of-Way: The applicant shall reserve an additional 20 feet of property parallel to WCR 7 right-of-way for future build out. Traffic Impact Study: All new commercial developments with expected ADT of more than 200 will be required to submit a traffic study as part of the review process. This study shall include a description of the project, vehicle trip generation and distribution, verification of adequate acceleration, deceleration, and storage facilities at all impacted intersections, review of bridge capacity, intersection level of service analysis for existing and proposed conditions, and recommendation for needed upgrades to transportation infrastructure to support the development. The Weld County Public Works Department will review your submittal of the traffic study. If it is determined that additional review is necessary,we will forward your study to Felsburg, Holt&Ullevig,our traffic engineer consultant, for their recommendation. The applicant shall be charged the consultant's fee. Improvements Agreement: The applicant has an existing Improvements Agreement for the haul route in the Rinn area along with other heavy haulers. If the traffic study identifies any additional intersection improvements associated with heavy hauling, the Improvements Agreement will be amended to reflect those items. Off Street Parking: The off-street parking spaces for trucks and equipment shall be surfaced with gravel, asphalt, concrete or equivalent and shall be graded and drained to prevent drainage problems. The approach road and circulation pattern shall be asphalt or concrete. .-- Storm Water Drainage: The applicant indicated that the storm water drainage will be contained on site. The plant will be sloped from the east to the west to drain into the storage reservoir on the west side of the site. Any discharge points shall be indicated on the plat. COLORADO One of the requirements from my previous memo, dated October 16, 2001, was to complete a traffic impact study at the new location. The study has been submitted by Felsburg, Holt, and Ullevig and is complete with exception. The access on WCR 7 was not analyzed for turning lanes. An entrance analysis and recommendations should be submitted. In review of the study, it will be required of the applicant to enter into a new Long-Term Maintenance and Improvements Agreement with the Weld County Public Works Department. The Agreement shall cover the following issues: • The designated haul route. • Improvements for the acceleration/deceleration or left turn slot at the entrance, if warranted. • A prorated percentage towards the total cost of the signalization at State Highway 119 and WCR 7. This will be based on your impact and background traffic for the lift of the pit. The applicant shall provide that percentage to the Weld County Public Works Department for review and approval. • Construct a 550-foot acceleration lane with a 160-foot taper (13:5:1 taper ratio) west of the State Highway 119/WCR 7 intersection to facilitate the northbound left-turn movement, appropriate for heavy vehicles leaving the site. • Extend the existing 150-foot acceleration lane east of the intersection to 550 feet with a 160- foot taper (13:5:1 taper radius) to facilitate the northbound right turn movement. Proposed Access: WCR 7 is designated in the Mixed Use Development Area as a four-lane undivided-secondary, which would require a raised medium or turn slots and 100 feet of right-of- way at full build out. With extended widening and tapers at this intersection, we feel strongly that the entrance should be relocated farther south of the intersection to avoid conflict. Also, we feel that one access should be granted to the site to minimize additional access points on to WCR 7. The principal applications of the Code to this type of facility will be for tank installations for flammable or combustible liquids, fueling operations, vehicle repair, welding, and any use of hazardous materials. Tanks installed for flammable or combustible liquid storage or dispensing, either temporary or permanent, need to be installed in accordance with the requirements of the Code and plans for the installation must be reviewed and approved by the Fire District prior to installation. Batch Plant:Immediately Southwest of the Intersection of S.H. 119 and C.R. 7,Barbour Ponds State Park Area, Weld County Dear Ms. Lockman: At your request,we have reviewed the materials submitted for and made a field inspection of the site of the proposed concrete-processing facility indicated above. The following comments summarize our findings. (1)This site is part of a partially reclaimed gravel mine and is located in a district of active and past gravel mining. There is a residence and its appurtenant structures immediately to the south of the site and it appears as if the site has been recently regraded,possibly to accommodate the proposed use.It is not known if gravel mining has taken place on the parcel. Gravel of probable economic quality is found at the surface. Possibly, some of this gravel is fill and some in-place native material. The site is nearly level and flat and was essentially barren of vegetation at the time of site visit in early October 2001. (2)From what could be ascertained in the field by surface observations,there is no geology- related reason why this proposal should not be approved. One concern,however, is that if this site is partially or completely underlain by fill material,this fill should have been properly placed to support the structural and vehicular loads that will result from the batch-plant operation. Typically,native in-place gravels present minimal foundation-engineering problems for activities of this sort. According to the submitted documents,the operator has agreed to conform to all governmental regulations applicable to this activity. If this is done,then we have no objection to your approval of this proposal as planned. Sincerely, James M.
