RE: APPROVE ENTRY UPON VARIOUS LANDS BY WELD COUNTY VEGETATION
MANAGEMENT SPECIALIST
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on May 30 and 31, and June 5, 6, or 7, 2002, the Weld County Vegetation
Management Specialist mailed notices to various landowners within Weld County advising them
that lands owned or occupied by them contain Canada thistle, musk thistle, and/or Scotch
thistle, noxious weeds, and
WHEREAS, said notices stated that said noxious weeds must be controlled or
eradicated within ten days from the date of said notices and gave recommendations as to what
methods are to be used for such control or eradication, and
WHEREAS, a copy of said list, containing the legal descriptions of the lands and the
names of those landowners who have failed to comply with said recommendations, is attached
hereto and incorporated herein by reference, and
WHEREAS, the County Vegetation Management Specialist has requested that the
Board approve his entry upon lands, as set forth in the abovementioned list, to affect the control
or eradication of noxious weeds, and
WHEREAS, at its meeting of June 17, 2002, the Board did Find as follows:
1. That those landowners mentioned on the list are the owners of said land within a
pest control district.
2. That Canada thistle, musk thistle, and/or Scotch thistle, noxious weeds, are
found upon said lands.
3. That said landowners received appropriate notice and such notice specified the
best available means for control or eradication of said noxious weeds.
4. That said landowners have not complied with the requirements as stated by the
County Vegetation Management Specialist.
WHEREAS, pursuant to said Findings, the Board deems it advisable to approve the
entry by the Weld County Vegetation Management Specialist upon said lands described in the
list attached hereto, to affect the control or eradication of the abovementioned noxious weeds.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Board does hereby approve the entry upon various lands as
set forth in the list attached hereto by the Weld County Vegetation Management Specialist to
affect the control or eradication of Canada thistle, musk thistle, and/or Scotch thistle, noxious
weeds.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 17th day of June A.D., 2002.

Dear Weld County Commissioners:
Under the Colorado Weed Management Act,CRS,35-5.5-109 and Weld County Code,Chapter 15,Section15-2-20,
I must seek approval or right of entry from the Board of County Commissioners to enter on private land to carry out
weed control measures.
Below is a list of landowners,and the legal description of their land,that we may have to enforce on. I am seeking
your approval to enter upon these lands.

weed species: Canada thistle (Cirsium arvense), musk thistle (Carduus nutans), or Scotch thistle (Onopordum
acanthium). Enclosed is a copy of a notice sent under the Colorado Weed Management Act.

Dear Landowner:
Under provision of the Colorado Weed Management Act(35-5.5-109 CRS)and Weld County Code, Chapter
15, Article II, this letter is to serve as notice that the presence of noxious weeds has been observed on
properties which are owned, leased, and/or occupied by you and located in Section 24 , Township 1 North,
Range 67 West of the 6`h P. M., in Weld County, Colorado. The property is designated in the Weld County
Assessor's Office as parcel number 146924400028.
The noxious weed present on the property is: Scotch thistle (Onopordum acanthium), and musk thistle
(Carduus nutans).
Because these weeds are nearing bloom stage, they must be controlled and kept from going to seed.
Presently, the best methods of control are: 1) to mow as necessary throughout the year to keep the weeds
from going to seed (3-5 times)and then spray with herbicides in the fall,2)to mow throughout the season to
keep the plants from going to seed, 3) to spray with herbicides up to the early flower stage.
Section 35-5.5-109,C.R.S. and Weld County Code, Chapter 15 requires you to control the weeds by using at
least one of these methods. Please be advised that if you do not control or eradicate these weeds by June
10. 2002, I will ask the Board of County Commissioners of Weld County for permission to enter the property
to use one of these methods of control or eradication at your expense,as provided in Section 35-5.5-109 (5a)
C.R.S. and Weld County Code, Chapter 15.
I will be glad to answer any questions you may have regarding the control or eradication of the noxious weeds
on the property. lam also available to assist you in developing short and long term weed management plans.
