Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The Applicant has proposed a well as the source of adequate water for Lots A and B. Property
owners are advised that the quantity of water available for usage may be limited to specific uses, i.e.,
"Domestic Use Only," etc. Because each situation is unique, the Department of Planning Services
encourages property owners to contact the Office of the State Engineer,Division of Water Resources
(1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581),to discuss each
individual situation.

3. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 0453-24-4 RE-3272
B. In accordance with Chapter 8, Article II of the Weld County Code, Lot A and Lot B shall be
granted one residential/agricultural access each. Direct access from a public road shall be
limited to one access per legal parcel for residential use, no circle drives or additional accesses
shall be granted.The road shall be graded and drained to provide all weather access.Accesses
shall be placed in such a location as to have adequate sight distance in both directions, shall
not be placed below the crest of a hill or where physical obstructions are present and shall be
a minimum distance of 75 feet from any intersecting County or State roadway.
C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
D. Weld County Roads 25 and 102 are designated on the Weld County Transportation Plan Map
as local gravel roads, which require 60 feet of right-of-way at full build out. There is presently
60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Roads25 and 102
shall be delineated right-of-way on the plat. These roads are maintained by Weld County.
E. The West Greeley Soil Conservation District has provided information regarding the soils on the
site.The applicant shall submit written documentation that they have reviewed the information
and will use it to positively manage on site soils.
F. The applicant shall address the requirements of Weld County School District RE-9 as stated in
the referral response dated August 29, 2000. Evidence of such shall be submitted in writing to
the Weld County Department of Planning Services.
G. Lot A shall comply with the less than thirty-five (35)acre maximum lot size required by Section
24-8-10.B of the Weld County Code.
H. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
4) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot A and Lot B have an adequate water supply
of sufficient quality, quantity and dependability.
5) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
6) Potential purchasers should be aware that approval of this Recorded Exemption does
not guarantee that well permits will be issued for the lots. Any lot may be deemed non-
buildable if the lot owner is unable to obtain a well permit. The State Division of Water
Resources issues all well permits.
7) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
8) Recorded Exemptions on adjacent properties may raise the issue of compliance with the
intent of the Recorded Exemption Process. Approval of this Recorded Exemption does
not guarantee approval of future applications on adjacent properties.
9) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads; odor from animal confinement, silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
4. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days
from the date the Administrative Review was signed. The applicant shall be responsible for paying
the recording fee.
5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is.tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to nppskco_weld.co us.
6. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

The following is supporting written material for a proposed 2-Lot Recorded Exemption
situate in the East Half of the Southeast Quarter of Section 24, Township 9 North, Range
67 West of the 6Th P.M., Weld County, Colorado. The succeeding format is based upon
the requirements as set forth in the Recorded Exemption Submittal Checklist.

RECORDED EXEMPTION QUESTIONNAIRE
1. Water Supply Statement:
Domestic water shall be supplied by a domestic well on both Lots A and B. Lot A has
an existing well, (please see attached well permit). Lot B is a proposed well, (please
see attached well permit application). Irrigation water does not exist on the property.
2. Sewage Disposal:
No sewage disposal systems exist on the property. Upon approval of construction both
Lot A and B shall utilize Individual Sewage Disposal Systems. The septic systems shall
be installed in compliance with the requirements and regulations of the A
(Agricultural) Zone District and the Weld County Health Department.
3. Present Land Usage:
This property contains 81.80± acres of pasture/dryland ground. This land is not
considered "Prime" agricultural ground and has no existing outbuildings or
improvements.
4. Reason for Exemption:
The applicant would like to create two separate buildable lots so that he may sell one
or both of the proposed parcels to insure a safe retirement. Mr. Barnes is reaching
retirement and is maximizing his land investments with the RE Process. Both lots will
be used for the residential or agricultural needs of the future owners. Lot A will be
approximately 34.5± acres, with Lot B containing the approximate remaining 47.3±
acres.
5. Property Description:
This property is located in the East Half of the Southeast Quarter of Section 24,
Township 9 North, Range 67 West of the Sixth Principal Meridian, County of Weld,
Colorado. The subject parcel is bounded on the East by Weld County Road 25, and on
the South by Weld County Road 102. The total area of the subject ground is 81.80±
acres. Proposed Lot A is now vacant ground with no existing irrigation. Proposed Lot
B is also vacant land with no existing irrigation.
6. Physical Characteristics:
No unique physical characteristics exist on this site.
7. Setback and Offset Statement:
All proposed structures are to meet the minimum setback and offset requirements as
regulated within the Agricultural Zone District.
8. Conservation Statement:
The property owner does not wish to place a conservation easement on the property at
this time.
9. Building Envelopes:
No building envelopes shall be placed on the property at this time. If at the time of
approval, the Planning Department requests a building envelope on parcels, then the
present owner shall designate one.
10. Consistent with Chapter 22:
A total of two lots are being created with this proposal. With only two parcels being
created, this proposal is not considered urban in scale. Therefore this proposal would
not damage the integrity of the farming industry but rather allow for the owner to
better secure his families financial future and allow for other people to enjoy the

country living and agricultural activities Weld County has to offer. All required utilities
(water, electric and telephone) are existing and/or available bordering this property.
The two county roads bordering this property are adequate means of transportation.
We feel this proposal is consistent with Chapter 22 of the Weld County Code.
11. Surrounding Land Uses:
With the possibility of only two new building sites created, this proposal will coexist
nicely with other residences that are on small acreages located near this proposal.
Dryland/pasture exists in all directions of this proposal. By utilizing non-prime ground
of this property, the integrity of the agricultural community will not be greatly altered.
12. Consistent with the intent of the Zone District:
A.Goal 1: This proposal will not interfere with the agricultural value of the land.
Considering that the property is not considered "Prime" agricultural this proposal will
coincide well with the surrounding area and single family residences.
A.Goal 2: The land is currently vacant and is not being used for any agricultural
purposes at this time. As stated before, this land is not considered "Prime" agricultural
property. This proposal, with the overall size of its lots will coincide well with
surrounding properties.
A.Goal 3: This proposal will contain a total of two lots. A proposal with nine lots or
less is considered non-urban in scale. The utilities required for a single-family
residence exist and/or are available to this property.
A.Goal 4: Uses by Right within the Agricultural Zone District allow residential units
and farming activities. The soil classifications for this property are not considered
"Prime" agricultural, but with engineered foundations and septic systems the proposed
lots would make good single family residences with the ability to participate in 4-H
type agricultural activities. This would be consistent with the provisions of the A
(agricultural) Zone District.
As mentioned earlier, utilities are existing and adjacent to the site relieving the impact
on utility providers to extend services.
This proposal is considered non-urban in size therefore we feel this is a low-level
development on this site.
Minimal fiscal impact on the County will occur due to the size of this proposal. The
transportation system is adequate as both roads bordering this proposal are gravel and
County maintained.
A.Goal 5: There aren't any existing Oil/Gas facilities on this site so therefore this
does not apply to this proposal.
A.Goal 6: Public facilities and services such as water, electric, telephone, roads,
schools, fire and police are existing and in place for this proposal. Utilities exist
adjacent to the site as well as an adequate road system. The Sheriff's Department will
provide police protection as in the past.
A.Goal 7: The "Right to Farm Covenant" will be placed on the Final Maps of this
proposal making all associated people aware of the importance of the agricultural
industry within Weld County.
A.Goal 8: There is an existing well permit for Lot A of this proposal. Lot B shall also
use a well for domestic water supply. (please see attached well permit and
application).
A.Goal 9: The parcels of this proposal are for residential use as well as light or hobby
like agriculture and/or animal husbandry activities.
13. Efficient and Orderly Development:
We feel that this proposal will be a good asset to the County while safeguarding the
interests of the public with a proposal that does not take away from the natural
beauty of the county. With the safety of fire and rescue in close proximity; the
convenience of utilities, such as a well water, electricity and telephone; and without
hindering any of the surrounding farming operations by keeping existing irrigation
ditches and/or pipelines in use for the needs of the existing farms and ranches; and by
protecting the interests of all the surrounding farm producers, this proposal will be
consistent with efficient and orderly development as defined in the Weld County Code.

Weld RE-9 School District with district offices located in Ault Colorado
has adopted a methodology to determine the in-lieu payment for
residential dwelling units sufficient to provide adequate educational
opportunities to new residential developments. The School District
Methodology has been developed in a manner so as to fairly
apportion the cost of acquiring school sites made necessary by
residential development.
The total in-lieu payment per dwelling unit is $759. Payment should
be hand delivered or mailed to Weld RE-9 School District, Box 68,
Ault, Colorado 80610. A receipt will be mailed to the party
requesting the exemption and a copy to Weld County Officials.

WCR 25 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
WCR 102 is designated on the Transportation Plan Map as a local gravel road,which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert.
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No circle
drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall apply
to all new and existing accesses within the unincorporated areas of Weld County. Properties within municipalities
or other counties that access Weld County roads are also subject to this policy.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no Injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2,unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92.602(3)(b)(ll)(A)as the only well on a tract of land of 40 acres described as the E 1/2, E
1/2, SE 114,Sec.24,Twp.9 N, Rnu.67 W, Sixth P.M.,Weld County.
4) The use of ground water from this well is limited to fire protection,ordinary household purposes inside not more than
three(3)single family dwellings,the irrigation of not more than one(1)acre of home gardens and lawns, and the watering
of domestic animals.
5) The maximum pumping -ate of this well shall not exceed 15 GPM.
6) The return flow from the use of this well must be through an Individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
7) This well shall be constructed not more than 200 feet from the location specified on this permit.
NOTICE:This permit has been approved for a change in the 1/4, 1/4 from which you applied for on Item 4 of your well
permit application. You are hereby notified that you have the right to appeal the issuance of this permit,by filing a written
request with this office within sixty(60)days of the date of Issuance, pursuant to the State Administrative Procedures Act.
