RE: ACTION OF BOARD CONCERNING SUBSTANTIAL CHANGE#22 REGARDING
RECORDED EXEMPTIONS #2259 AND#2260 - BRET HARDER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 9th of
December, 2002, at the hour of 10:00 a.m. in the Chambers of the Board, on behalf of Bret
Harder, 435 North 35th Avenue #430, Greeley, Colorado 80631, for the purpose of considering
whether or not there has been a substantial change in the facts and circumstances regarding
the application for Recorded Exemptions #2259 and #2260, which were denied by the Board of
County Commissioners by Resolution dated July 27, 1998, and
WHEREAS, said action was taken concerning property described as:
N1/2 N1/2 S1/2 of Section 19, Township 9 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, said applicant was present, and
WHEREAS, said hearing was conducted pursuant to the Board's policy concerning
applications for land use for property previously denied, as set forth in Section 2-3-10 of the
Weld County Code, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and, having been fully informed, finds that said
request to apply for a Recorded Exemption shall be approved for the following reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has
demonstrated that a substantial change in facts and circumstances has
occurred.
a. The applicant has submitted a copy of a sixty (60)foot easement for
access and utilities along the west side of Section 19. The applicant has
also identified upgrades along Weld County Road 13 section line which
represents a substantial change.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that there has been a substantial change in the facts and
circumstances regarding the application of Bret Harder for a Recorded Exemption.

13 section line; 1/2 mile north of Weld County Road 102

1. It is the opinion of the Department of Planning Service's staff that the applicant has demonstrated
that a substantial change has occurred and recommends approval of the applicant's request.
2. The Weld County Board of County Commissioner's Resolution dated July 27, 1998 denied
Recorded Exemptions 2259 and 2260 on the subject property for the following reasons:
A. The proposal evades the purpose of the Weld County Subdivision Ordinance as defined
in Section 1.3.
B. The division would be inconsistent with efficient and orderly development.
C. The proposal is not consistent with the Weld County Comprehensive Plan.
D. The proposal increases the need for more urban-type services in the area.
E. The conflict between rural and urban activities is evident in this request. When an urban
growth pattern is established without regard to long range comprehensive planning, the
outcome lacks the essential elements of long term desirability. Higher costs are incurred
by providing many public services to urban sprawl area. As urban areas develop and
expand they inadvertently influence surrounding areas. These areas are either converted
to urban uses themselves or are in direct conflict and competition with agricultural area.
F. The applicant has failed to comply with the A(Agricultural)Zone District intent.This parcel
is located outside of an Urban Growth Boundary Area. Continued division of this parcel
emphatically opposes the intent of the A (Agricultural) Zone District. The potential to
interfere and encroach upon the agricultural activities of this area is evident. The A

(Agricultural)Zone District was established to promote and maintain agriculture as a vital
support element for Weld County citizens,and not to be continually decrease for residential
development. The A (Agricultural) Zone District policies discourage the conversion of
agricultural land for residential uses within an area located outside of an urban growth
boundary.The intent is to eliminate incompatibilities that exist and minimize costs to Weld
County taxpayers.
3. Pursuant to Chapter 2, Article II, Section 2-3-10 of the Weld County Code, the Board of County
Commissioners shall consider the applicant's request for a Hearing of Substantial Change and
whether within the concept of a new application, the facts and circumstances of which are
substantially changed from the initial application:
Criteria 1. --Has the land-use application substantially changed? (e.g., substantial changes in lot
size or density, in internal or external roads, or, in the case of a rezoning, in the uses proposed)
Criteria 2.—Have the surrounding land-uses substantially changed ? (e.g., has the adjacent land
use changed during the period of time since the last application such that what would be compatible
with the adjacent use has changed)
Criteria 3. — Have applicable provisions of the law substantially changed? (e.g., the applicant is
proposing using a different procedure so a different set of criteria apply or the applicable ordinance
has been amended by the Board so the criteria have substantially changed)
Criteria 4. — Within the concept of rehearing the previously denied application, is there newly
discovered evidence that the applicant could not have discovered with diligent effort at the time of
the original application ?
4. The applicant has submitted a copy of a sixty(60)foot easement for access and utilities along the
west side of Section 19. The applicant has also identified upgrades along Weld County Road 13
section line which he propose to represents a substantial change.
Weld County Planning Staff has determined that the submitted information does meet the intent of
a substantial change as outlined in the Weld County Code.

1.)Is there newly discovered evidence that the applicant could not have discovered with diligent
effort at the time of the original application?
Since the last application which was applied for in 1998, many changes have taken place. On the 24th of
April 1998 an easement was granted by Bryan Sidwell(owner)which conveyed the owners of the property
of the south'/:of Section 19 township 9 North,Range 67 West of the 6th P.M.Weld county CO. A 60 foot
easement for the access of road or utilities. County road 13 has also been created and upgraded on the west
end of the property along with electric up to the property border. This new evidence should prove that there
has been substantial change since the original application.

COMMENTS:
WCR 13 is designated on the Transportation Plan Map a section line. There is presently a 30-foot right-of-
way. This road is NOT maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-
of-way line.
WCR 15 is designated on the Transportation Plan Map a section line. There is presently a 30-foot right-of-
way. This road is NOT maintained by Weld County. Pursuant to the definition of SETBACK in the Weld

REQUIREMENTS:
The applicant shall complete a Nonexclusive License Agreement for the upgrade and maintenance of Weld
County right-of-way. (WCR 13 and WCR 15)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

August 29, 2000
Weld RE-9 School District with district offices located in Ault Colorado
has adopted a methodology to determine the in-lieu payment for
residential dwelling units sufficient to provide adequate educational
opportunities to new residential developments. The School District
Methodology has been developed in a manner so as to fairly
apportion the cost of acquiring school sites made necessary by
residential development.
The total in-lieu payment per dwelling unit is $759. Payment should
be hand delivered or mailed to Weld RE-9 School District, Box 68,
Ault, Colorado 80610. A receipt will be mailed to the party
requesting the exemption and a copy to Weld County Officials.

remaining on the property herein transferred or conveyed has been taken
before the date of this transfer or conveyance.
If Harold F. and/or Marlene K. Sidwell find(s) that additional remedial
action is necessary to protect the human health and the environment after
the date of this transfer or conveyance, the United States, acting through
the Farmers Home Administration, will conduct such action.
The hazardous substance remediation requirements described herein do not
apply when the property is transferred or conveyed to a potentially
responsible party.
