Dear Sheri:
On behalf of our client, Mobile Pre-Mix Concrete, Inc., this letter is to update you on our
progress to complete the conditions outlined in the resolution from the Weld County Board of
County Commissioners. Although most of the conditions required prior to recording the plat
have been completed, we are still in negotiations with mineral rights owners/lessees to
adequately incorporate oil and gas activities into the design of the site. In addition, one of the
septic systems on the site will require repair prior to obtaining a permit with the Weld County
Department of Public Health and Environment. We are currently in the process of performing
the septic system repairs.
Sheri, we want to assure you that we are making every effort to comply with the conditions in
the resolution and are hoping to be able to complete these tasks in the near future. If you have

Dear Sheri:
On behalf of our client, Mobile Pre-Mix Concrete, Inc., this letter is to provide supporting
information for submittal of the final plat. Changes were made to the Pre-Mining/Mining Plan
Map and Reclamation Plan Map consistent with requirements established by the Weld County
Commissioners. Specifically, the processing area illustrated on the Pre-Mining/Mining Plan
Map was edited slightly for final plat submittal. The changes were necessary to accommodate
potential oil and gas drilling activities on the site as required by the County Commissioners.
Associated changes to the final reservoir design have also been made on the Reclamation Plan
Map. In addition to the Pre-Mining/Mining Plan Map and Reclamation Plan Map, the Landscape
Screening Plan Map was added to the submittal materials as requested by the Weld County
Planning Staff.

Conditions 3.B (Dust abatement plan) and 3.G. (Waste handling plan) submitted have been approved.
Conditions 3.E. (NPDES) and 3.F. (APEN) applications have been submitted. The applicant will need to
submit permits in order for approval. At this time I am not in receipt of these permits. Conditions (3.E. &
3.F.) are not approved.

Dear Sheri:
On behalf of our client, Mobile Pre-Mix Concrete, Inc., please find attached a revised
Landscape Screening Plan for the Riverbend Operation. Initial conditions for the
screening plan were outlined in the resolution from the Weld County Board of County
Commissioners. In addition, edits to the preliminary plan were made based on staff's
recommendations contained in the e-mail from Kim Ogle dated October 29, 2001. For
simplicity, the text portion of the preliminary plan has been included on the attached
Landscape Screening Plan map.
The screening plan will concentrate on views from residences located northeast of the
mine processing area, Weld County Road (WCR) 6, and WCR 8. The plan will use
permanent and temporary berms, new vegetation, and will take advantage of preserving
existing landscape screening features such as trees along the South Platte River.

Dear Kim:
In response to the Board of County Commissioners conditions prior to recording the final plat,
please find enclosed an Individual Sewage Disposal System (ISDS) installation permit from the
Weld County Department of Public Health and Environment. Following inspection of the
existing ISDS at 2269 Hwy 85 by Weld County staff, it was determined that the system needed
to be brought into compliance with Weld County regulations. We believe that installation of the
new system at this address fulfills the Board of County Commissioners condition prior to
recording the plat.

NOTICE
This permit is granted temporarily to allow construction to commence. This permit may be revoked or suspended by the Weld
County Department of Public Health and Environment for reasons set forth in the Weld County Individual Sewage Disposal System
Regulations including failure to meet any term or condition imposed thereon during temporary or final approval. The issuance of
this permit does not constitute assumption by the department or its employees of liability for the failure or inadequacy of the sewage
disposal system.
This permit is not transferable. Before issuing final approval of this permit the Weld County Department of Public Health and
Environment reserves the right to impose additional terms and conditions required to meet our regulations on a continuing basis.
Final permit approval is contingent upon the final inspection of the completed system by the Weld County Department of Public
Health and Environment. This permit expires one year from theapplication date.

This office is in receipt of a letter addressed to Sheri Lockman specific to the above specified case. The
letter states "... please find attached the Landscape Screening Plan for the Riverbend Operation." Staff is
in receipt of descriptive narrative that pertains to the Landscape Screening Plan, but are not in receipt of a
graphic representation to scale for the proposed plan. Should staff be reviewing the reclamation plan for
this site to determine the location of plant material?
Staff requests that a graphic plan be submitted for our review prior to any implementation of the proposed
landscape treatment that may be associated with this site specific to addressing the concerns brought to
light at the Board of County Commissioners hearing.
Historically staff has not permitted Populus angustifolia as they are known to have aggressive root
systems and are weak wooded. Further, some hybrid species of Populus spp. are known to disperse
"cotton". In the rocky mountain region, this tree is good in higher elevations. Perhaps this specific tree
may not be the best selection given the growth habit.
One inch calipher stems on trees is considered a "whip" by many nurseries. Bare root plantings do not
have as high of a survival rate as trees grown in 5-10 gallon cans and having a 1.5 inch calipher stem.

At the County Commissioners hearing, and in previous discussions with Weld County
Planning Department staff, it was agreed that complete screening of the site from State
Highway 85 was not practical because of the highway being elevated relative to the site.
The screening plan would concentrate on views from residences located northeast of the
mine processing area and take advantage of preserving existing landscape screening
features such as trees along the South Platte River.

RIVERBEND OPERATION
LANDSCAPE SCREENING PLAN
Elements of the landscape screening plan will be consistent with the reclamation plan
presented in the Construction Materials Regular (112) Operation Reclamation Permit
received from the Colorado Mined Land Reclamation Board. The landscape screening
plan also includes preservation of existing vegetation, including trees located along the
South Platte River. Where practical, the grading and vegetation activities outlined in the
reclamation plan will commence during the mining operation to incorporate them into the
screening plan.
As detailed in the reclamation plan, stripped topsoil and overburden from mining
operations will be stockpiled parallel to the flow of water in order to reduce the risk of
inhibiting the flow of a flood. The stockpiles will be located around the perimeter of the
site and, if left in place longer than one growing season, will be revegetated. These
stockpiles will act as temporary berms for visual screening. In addition to the stockpiles,
permanent berms may be constructed to supplement plant material for visual screening.
Details for the planting of trees and shrubs are presented in the reclamation plan. Trees
and shrubs will be planted in areas where tree/shrub clusters are illustrated on the
reclamation plan map. The tree and shrub species will be selected from the list provided
below. The exact species used will be determined at the time of planting based upon
availability and associated costs of specific trees and shrubs.
TREES — No more than 25% of any one species. Trees and deep-rooted plants will not
be planted near the reservoir liner to avoid problems with roots compromising the
integrity of the liner.

The planting will consist of 50 trees and 50 shrubs around the east, northeast, and
southeast side of Lake 1 (mine processing area) and 30 trees and 30 shrubs around the
north side of Lake 2 throughout the life of the project. Trees will be at least 1 inch in
diameter at the time of planting. The success standard used will be 80% survival at the
time of Mined Land Reclamation Board bond release.
