Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the Use
by Special Review Standards,Weld County Code, Chapter 23,Article II, Division 4, Section 23. Our comments
and requirements are as follows:
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the State Highways. ,/
Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any
additional requirements that may be needed to obtain or upgrade the permit.
Both Weld County Roads 17 an 19 are designated on the Weld County Transportation Plan Map as collector
status roads.
The average daily traffic (ADT) count for WCR 17 is 1536 vehicles, taken in a 24 hour period on May 7, 1999.
WCR 19 has an ADT count of 1767 vehicles, taken March 6, 2001. The ADT for the State Highway(SH 66)at
WCR 17 reflects 5400 vehicles, taken in 1995.
The applicant is referring to the old County ordinances and design standards, and their application. Please
advise the applicant that we are utilizing the new County Code.
REQUIREMENTS:
Traffic Study: Weld County Public Works Department is reviewing your submittal of the traffic study. Diane
Houghtaling, Traffic Engineer, will contact you if revisions are required.

The applicant shall supply a copy of the traffic study to CDOT for any additional requirements that may be b '
necessary to obtain or upgrade the permit.
Access/Off-Street Parking: The access road within the facility shall be a minimum of 24 feet in width to
accommodate two-way traffic.
The off-street parking spaces at the,main office parking lot, including the access drive, shall be surfaced with ✓
asphalt, concrete, or equivalent, and shall be graded to prevent drainage problems.
Storm Water Drainage: The storm water drainage will be directed to a detention pond to allow sedimentation, /
prior to discharging. Prior to discharging, the applicant shall obtain the appropriate discharge permit from the
State of Colorado and show it on the plat.
Improvements Agreement:The applicant shall enter into a Road Maintenance and Improvements Agreement /
with the Weld County Public Works Department for the upgrade and paving or maintenance of Weld County
roads which are associated with the pit and any additional intersection improvements associated with the heavy
ra, hauling that may be identified in the traffic study.

The Weld County Public Works Department has reviewed the Traffic Study for this Special Use Permit. Comments
made during this phase of the USR process may not be all-inclusive,as other concerns or issues may arise during
the remaining application processes.
COMMENTS:
This study estimate 50 trips per hour. Although this seems high,the Weld County Department of Public Works has
accepted this number. However,we do not agree that only 10 vehicles leave this site in the A.M.peak hour. It is more
reasonable to assume 80-90%of the trips leave in the A.M.peak hour and return in the P.M.peak hour.
Since this operation will access directly to SH 66,an access permit from CDOT will be required. The engineer and
developer should be aware that the left turn bay will require a 65:I redirect taper. Please investigate the possibility of
installing a left turn bay crossing the railroad and the bridge.
This traffic study is required to bear the stamp of a professional engineer,licensed in the State of Colorado.
Please resubmit the traffic study addressing the above concerns.

TRAFFIC IMPACT STUDY
The applicant shall complete a traffic impact study.
All new residential developments with expected ADT>200 and all new commercial
developments will be required to submit a traffic study as part of the review process. This study
shall include a description of the project, vehicle trip generation and distribution, verification of
adequate acceleration, deceleration, and storage facilities at all impacted intersections, review of
bridge capacity, intersection level of service analysis for existing and proposed conditions and
® recommendation for needed upgrades to transportation infrastructure to support the development.
Weld County Public Works Department will review your submitted traffic study. The traffic
study needs to be submitted no later than two weeks prior to scheduling with the Planning
Commission to allow our traffic engineer time to review and comment.

SUBJECT: USR-1347, Kurtz Ranch Sand and Gravel
Environmental Health Services has reviewed this proposal for an open pit gravel mining
operation, concrete and asphalt batch plant. We have no objections to the proposal,however, in
reviewing the application we observed that the applicant is proposing bottled water as the
facility's source of water. We do not believe that bottled water is an"adequate"source of water
for this type of operation. The facility plans to operate at this location for at least 20 years,thus
we believe a permanent water supply i.e. community system, well, etc. is more appropriate to
serve the sanitary needs of the staff and visitors to the facility. We do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to
the Air Pollution Control Division, Colorado Department of Health and Environment for
emissions of criteria, hazardous or odorous air pollutants.
2. Submit a dust abatement plan to the Environmental Health Services, Weld County
Department of Public Health& Environment, for approval prior to operation.
3. An individual sewage disposal system is required for the proposed aggregate processing
plant, asphalt plant and the concrete plant and shall be installed according to the Weld
County Individual Sewage Disposal Regulations. The septic system is required to be
designed by a Colorado Registered Professional Engineer according to the Weld County
Individual Sewage Disposal Regulations. The installation of the septic system shall
comply with the Weld County I.S.D.S. flood plain policy.
4. If applicable, a CPDS Permit shall be obtained from the Water Quality Control Division
of the Colorado Department of Health for any proposed discharge into State Waterways.

5. The applicant shall submit a waste handling plan, for approval,to the Environmental
Health Services Division of the Weld County Department of Public Health&
Environment. The plan shall include at a minimum,the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed(including the
facility name, address, and phone number).
6. The applicant shall provide evidence that the facility has an adequate water supply. (i.e.
commercial well, community system, etc.)
We recommend that the following requirements be incorporated into the permit as"development
standards":
1. The facility shall operate in accordance with the approved dust control plan. The facility
shall have sufficient equipment available to implement appropriate dust control.
Additional control measures shall be implemented as required by the Weld County Health
Officer.
2. In the event the facility utilizes the existing structures on the property for commercial
purposes,the septic system shall be reviewed by a Colorado Registered Professional
Engineer. The review shall consist of observation of the system and a technical review
describing the systems ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County Department
of Public Health and Environment. If the system is found to be inadequately sized or
constructed,the system must be brought into compliance with current Regulations.
3. The facility shall provide an adequate water supply for drinking and sanitary purposes.
(i.e. commercial well, community system, etc.)
4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
5. In accordance with the Above Ground Storage Tank Regulations (7 CCR 1101-14) a
spillage retention berm shall be constructed around the tank battery. The volume retained
by the spillage berm should be greater than the volume of the largest tank inside the berm.
Alternative protective measures may be allowed provided they comply with the Above
Ground Storage Tank Regulations.
6. No permanent disposal of wastes shall be permitted at this site. This is not meant to

include those wastes specifically excluded from the definition of a"solid waste"in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
7. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris,and other potential nuisance conditions.
8. Fugitive dust shall be controlled on this site.
9. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
10. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from
the facility area in a manner that will prevent nuisance conditions.
11. If applicable,the applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health&Environment, Water Quality Control Division.
12. The operation shall comply with all applicable rules and regulations of the Colorado
Division of Minerals and Geology.
13. All fuel tanks, septic tanks,temporary buildings, and any other hazardous items that
might wash away during flooding shall be securely anchored and adequately flood
proofed to avoid creation of a health hazard.
14. Adequate hand-washing and toilet facilities shall be provided for employees and the
public.
15. The operation shall comply with the Occupational Safety and Health Act(OSHA).
16. The operation shall comply with the Mine Safety and Health Act(MSHA).
17. Portable toilets may be utilized on sites that are temporary locations of the working face
and portable processing equipment, etc. for up to six months at each location.

Dear Mr. Anderson:
We have reviewed your June 18, 2001 submittal for a proposed gravel pit
operation. While this office generally does not comment on land use actions that do not
involve the subdivision of land, we can offer the following opinion. Since the submittal
documents show that groundwater maybe intercepted due to pit operations, it will be
necessary for the applicant to secure a well permit from this office.
For this office to issue a well permit, a water court plan for augmentation or a
substitute water supply plan issued by this office is necessary. We have no record of
either of these actions being completed. Therefore, they could not receive a well permit
from this office.
For the applicant to secure the necessary permit from the Colorado Division of
Minerals & Geology(DMG), they defer to this office in matters of potential injury to
existing water rights. We typically review proposed gravel pit operations and provide
comments to DMG. The County is recommended to state that the gravel pit operator
shall secure all necessary permits from both DMG and this agency.

Dear Robert,
The Division of Wildlife received the request from you agency for comments concerning
the Kurtz Ranch sand and gravel referral(USR-1347). Habitat Biologist Mike Sherman
and I have reviewed the proposal and made a field visit to the project site on July 3, 2001.
The area within the project proposal lies adjacent to and east of St. Vrain Creek,
containing a significant amount of wetland and riparian habitat. This type habitat is
extremely important in terms of diversity and abundance of wildlife species. Many
species including white tail deer and mule deer,waterfowl, shorebirds,raptors(including
Bald Eagles),turkey,pheasant,coyote, cottontail rabbit,red fox,raccoon,beaver,fish
and herpoles are directly dependant on wetland-riparian habitat. Dense, mature stands of
cottonwood trees provide nesting,perching, and roosting cover for numerous avian
species. This canopy also provides important travel corridors for wildlife. Mr. Sherman
and I observed a Wood duck hen and brood,Killdeer, Swainson's hawks,Kestrel, Great
Horned owl,Eastern and Western King Birds,Great Slue Heron,and Blade Billed
Magpie during our brief visit to the site on July 3`d.
The maps in this proposal indicate wetland mitigation. None ofthe written material that
you provided for our review explains in detail exactly what that mitigation consists of A
phone conversation with Faith Savage(Savage&Savage)on July 9,2001,revealed that
61.35 acres of wetlands will be impacted on this site. The Division of Wildlife is very
concerned about an impact of this immensity ofhigh quality wildlife habitat. We would
Sequest that the developer provide a detailed wetland mitigation plan as soon as possible.

The Division highly recommends that the wetlands, including St. Vrain Creek and the
Last Chance ditch and the riparian-cottonwood areas within this proposal be preserved as
open space with a minimum set back of 200 feet from mining activities. St. Vrain Creek
meanders through the property,providing oxbows and sloughs that sustain the riparian
ecosystem. The river and its channel must be given room to meander. I have indicated,
on the aerial photo,the areas where gravel mining should be prohibited. Additionally,
because this site contains high quality wildlife habitat,we highly recommend that the
amount of land disturbed at one time be limited to those areas needed for processing,
hatching and stockpiles, 15 acres;stripped pre-mining area, 10 acres;and no more than
10 acres of partially reclaimed areas needing reclamation. This would mean that there
would me 35 acres or less needing some type of reclamation at any one time.
The proposal states that ground water monitoring wells are to be installed at various
locations throughout the project. The Division feels that this is very important in
measuring the water table decline due to the mining operation and the subsequent effect
that might have on the overstory vegetation. The developer should be required to follow
through with this proposal and provide scientific data from these wells.
Prebles meadow jumping mouse and the Ute Ladies-tresses Orchid are found in riparian
areas and have the potential to occur at the proposed site of this development. Both
species are federally protected and surveys may need to be conducted to determine the
^ occurrence ofthese species. The U.S. Fish and Wildlife Service should be contacted at
E the Lakewood office(303-275-2370)for coordination of both species.
The Division of Wildlife appreciates the opportunity to review and comment on this
project proposaL Consideration for wildlife and critical wildlife habitat are essential in
minimizing negative impacts on the resource.
