Long, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 28, 2002, and duly published July 10, 2002, in the Tri-Town Farmer and Miner and the Greeley Tribune, a public hearing was conducted to consider the request of Saddler Arena, LLC,do Richard McMahan,fora Site Specific Development Plan and Use by Special Review Permit #1380 for a Site Specific Development Plan and Use by Special Review Permit#1380 for an Equestrian Events Center (commercial roping/rodeo arena, animal training and boarding, livestock sales facility, equestrian events, and concession sales), as well as a Commercial Recreational Facility (antique shows and auctions, canine events, and boat and recreation vehicle shows) in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney, made this a matter of record. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light stated the site is 34 acres in size, and the applicant is proposing a 151,000 square-foot arena for equestrian events, as well as other events, such as dog and boat shows. She gave a brief description of the location of the site, and stated there are no homes within the immediate vicinity of the site and the applicant owns the two adjacent parcels. Ms. Light stated the Conditions of Approval address possible improvements to State Highway 14, and the areas designated as stall envelopes will be approximately 29,000 square feet and will be enclosed. She stated they will be used for short-term horse boarders in training or attending events. Ms. Light described the site layout, which will include a concession and retail area in the main arena, a barn with housing, outdoor arena, hay barn, cattle pens, and a required 364 parking spaces. She stated Condition #1.H requires the applicant to submit a plan for landscaping, lighting, screening, and signage. Condition of Approval #1.K requires the applicant to enter into a Private Improvements Agreement and post adequate collateral. She stated Development Standard #5 requires the applicant to limit number of entrants to 500 persons until the facility is connected to a public sewer system, and Condition #1.L requires the applicant to address the concerns of the Poudre Fire Authority. Ms. Light gave a brief description of the %fL-fit?) /0 2002-1974 PL1616 HEARING CERTIFICATION - SADDLER ARENA, LLC, CIO RICHARD MCMAHAN (USR#1380) PAGE 2 surrounding uses, and stated although this is a large facility, the proposal is compatible with the other uses in the area. She stated this permit allows the applicant to host six commercial events per year; any additional events will require a Temporary Assembly Permit. She further stated the hours of operation for all events are limited to 7:00 a.m. to 10:00 p.m. This excludes care of the facility and any livestock. Ms. Light stated 14 referral agencies reviewed this case,four responded with no comments, eight included comments that have been incorporated into the Conditions of Approval and Development Standards, two agencies did not respond, and the Towns of Windsor and Severance indicated no conflicts with this request. She stated when Condition #1.A.4 was modified at the Planning Commission, the number of parking places was inadvertently removed and they need to be added back into the language to state, "A minimum of 364 parking spaces, which meet the requirements of Section 23-2-240.A.6 and Chapter 23,Article 4, Division 1, of the Weld County Code." She stated the applicant has indicated they are in agreement with this request. In response to Commissioners Jerke and Geile, Ms. Light stated the parking lot will be surfaced with a gravel equivalent, and the facility will allow for approximately 400 horses; however, they are not proposing permanent boarding. She further stated there will be a restaurant in the main arena and Development Standard #18 requires the applicant to comply with the Colorado Food Establishment Rules and Regulations. Responding to Commissioner Geile, Don Carroll, Department of Public Works,stated Condition of Approval#1.A.7 requires the applicant to indicate any additional information required by CDOT on the plat; however, CDOT is not requesting any improvements at this time. Char Davis, Department of Public Health and Environment, stated based on the use of a septic system, the applicant will be restricted to 500 attendees, with the ability to increase that amount once the site is connected to public sewer. Todd Hodges, Todd Hodges Design, LLC, represented the applicant and displayed photographs of views taken from the property. He stated the applicant is proposing numerous trees throughout the site, and they will be working with CDOT for any improvements needed in the future as the activities increase at the site. Richard McMahan, applicant, stated this project was started several years ago, and based upon research of the equestrian industry he felt this type of facility was needed and in high demand because there are not enough places to host horse shows. In response to Commissioner Geile, Mr. McMahan stated most of the people and their livestock will be coming in for one to five days to participate in horse shows. He stated the stall envelopes will be covered steel buildings, with portable stalls and sawdust shavings on the floors,and the animals will be transported from the site once the events are over. He further stated the livestock will be fed and watered by the competitor and caretakers, and the only horses that may remain on the site for an extended period of time would be those working with a professional trainer. He stated the cattle will be held off the site at a ranch near the Town of Pierce. They will be held in the cattle pen during the events and then trucked back to the ranch again. Responding further to Commissioner Geile, Mr. McMahan stated they are still finalizing the Manure Management Plan; however, they have discussed storing the manure in an open concrete structure and then hauling it to a professional composting facility once the containment area is full. In response to Commissioner Jerke, Ms. Light stated the facility will be allowed unlimited equestrian events, and they will only be restricted to six events for the commercial types of shows, such as dog, boat, and tractor shows. Responding to Commissioner Masden, Mr. McMahan stated they will not be hosting adult rodeo events; however, he is interested in supporting events sponsored by the National Little Britches Rodeo, 4-H, etcetera. He further stated the arena is not designed for a large spectator base; rather, it is more for the competitors and exhibitors. 2002-1974 PL1616 HEARING CERTIFICATION - SADDLER ARENA, LLC, C/O RICHARD MCMAHAN (USR#1380) PAGE 3 Fred Walker, President of Water Supply and Storage Company, stated the Larimer County Canal is the main irrigation canal. Mr. Walker expressed concern with the proposed landscaping. He stated there is a noxious weed problem along the canal and they have been doing a lot of spraying to control the situation. He stated he wants to ensure the proposed landscaping and trees will not be in the maintenance right-of-way, and requested the applicant be required to contact the Company or ditch owner to discuss these issues. He requested the applicant also be required to record a prescriptive or fee-simple right-of-way. He further stated there is a history of ditch washouts which need to be fixed with culverts, and there is a lot of maintenance work, which he feels the applicant should be required to complete bringing the right-of-way back into proper condition. Ms. Light suggested adding a Condition of Approval which requires the applicant to work with the Larimer County Canal Company to address these concerns. In response to Chair Vaad, Mr. Morrison stated the maintenance of the right-of-way is typically the responsibility of the ditch company; however, the land owner is responsible for providing adequate access to the ditch. He stated staff should note that the Landscaping Plan needs to address the condition of the ditch and may be used to stabilize that area. There being no further comments, Chair Vaad closed public testimony. Mr. Hodges stated the applicant is willing to work with ditch company regarding the engineering to address drainage issues. He explained the area of concern is actually located on an adjacent property; however, the applicant owns that land, as well, and they will work to ensure the landscaping is appropriately placed. In response to Commissioner Geile, Mr. Hodges stated they would be in agreement with adding a Condition of Approval requiring the applicant work with the Larimer County Canal Company. Responding to Chair Vaad, Mr. Hodges stated he and the applicant have reviewed and agree with the Conditions of Approval and Development Standards as proposed and modified. Ms. Light stated Condition of Approval #1.N could be added to state, "The applicant shall contact the Larimer County Canal Company to address its concerns, evidence of such shall be submitted in writing to the Weld County Department of Planning Services." In response to Commissioner Jerke, Mr. Walker indicated it would be more appropriate for Condition #1.N to reference the Water Supply and Storage Company. Commissioner Geile moved to approve the request of Saddler Arena, LLC, do Richard McMahan, for a Site Specific Development Plan and Use by Special Review Permit#1380 for a Site Specific Development Plan and Use by Special Review Permit #1380 for an Equestrian Events Center (commercial roping/rodeo arena, animal training and boarding, livestock sales facility, equestrian events, and concession sales), as well as a Commercial Recreational Facility(antique shows and auctions, canine events, and boat and recreation vehicle shows) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included adding a sentence to Condition#1.A.4 to state,"A minimum of 364 parking spaces,which meet the requirements of Section 23-:2-240.A.6 and Chapter 23, Article 4, Division 1, of the Weld County Code," and adding Condition of Approval #1.N to state, "The applicant shall contact the Water Supply and Storage Company to address its concerns, evidence of such shall be submitted in writing to the Weld County Department of Planning Services." The motion was seconded by Commissioner Long, and it carried unanimously.
