Memorandum TO: Carla Angeli, Weld County Planning DATE: January 28, 2002 COLORADO FROM: Charlo e Davis, Environmental Health Services SUBJECT: USR-1369 Cowan, Lona and David Environmental Health Services has reviewed this proposal for a Kennel. We have no objections to the proposal, however, if the applicant falls under the Pet Animal Care Facilities Act (PACFA), the existing residential septic system shall be reviewed by a Colorado Professional Engineer to ensure that the septic system can meet the increased hydrologic load required to satisfy the housing and sanitary standards of the PACFA rules and regulations. We do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 2. The applicant shall submit a manure and stormwater management plan to the Weld County Department of Public Health and Environment for review and approval. The plan should describe how manure generated on site will be stored, managed, removed, etc. The plan should also describe the fate of any stormwater that may come into contact with manure. 3. The applicant shall provide written evidence to the Weld County Department of Public Health and Environment that the applicant has contacted the Colorado Department of Agriculture (CDA), Division of Animal Industry. This contact shall determine if a license under the Pet Animal Care Facilities Act (PACFA), as defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide evidence that the applicant is not subject to the PACFA requirements. 4. In the event, the applicant intends to utilize the existing septic system and is required to be licensed under the Pet Animal Care Facilities Act (PACFA), the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. EXHIBIT I /a USR-1369 Cowan, Lona and David Page 2 We recommend that the following requirements be incorporated into the permit as "development standards": 1. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. 2. The facility shall operate in accordance with the approved dust control plan. 3. Animal and food wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards and nuisances are minimized. Such wastes shall be removed at least weekly, or more frequently, from the facility and hauled by a commercial hauler. 4. If applicable, the applicant shall comply with the Colorado Department of Agriculture, Division of Animal Industry, as defined in the Pet Animal Care Facilities Act, 35-80-101 through 117, C.R.S. 5. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. -- 6. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a "solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 7. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 10. The facility shall utilize the existing septic system. 11. The facility shall utilize the existing public water supply. Our comments and requirements are as follows: COMMENTS: Both Lamb Avenue and Henry Street are located within the Aristocrat Ranchette Subdivision. Both are identified on the Transportation Plan Map as local gravel subdivision roads, which require 60 feet at full build out. There is presently a 60-foot right-of-way. These roads are maintained by County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department has concerns on access and circulation throughout the site, i five c.,rs Access: The applicant indicated and I have field verified that there are two existing accesses to the property. The main access is from Lamb Avenue. Both locations are gated to keep the dogs on the property. I recommend closing the second access off Henry Street to have one access per legal parcel. No circle drives are allowed in accordance with Chapter 8, Article 3 of the Weld County Code. Another reason is that the location is 25 feet from the intersection. Our minimum distance is 75 feet from any County intersection, which relates to local residential/agricultural accesses. Off-Street Parking: By closing the access point from Henry Avenue, this area inside the fence could be utilized for guest parking. Storm Water Drainage: There is no defined drainage pattern on site. It appears that water from the site might flow on to the utility easement at the rear of the site. The applicant did not indicate any new structures, which would displace any additional storm water. Any storm water occurring on site should be retained and released at a historical flow. Circulation: Once you leave the driveway and parking area, the remaining portion of the one-acre lot is fairly congested with structures and trees. There is no reference to storage facilities to house these animals. There is no reference to livestock feeding, no watering for these animals, nor what to do with their waste other than to use it for fertilization. There is no reference to sound mitigation from the twenty- five dogs. There is no plan in reference to how they will obtain these dogs or horses as a rescue society nor what they will do with them after they have them. The Sheriffs Office has serious concerns regarding this becoming a significant nuisance in the Aristocrat Acres area. The Sheriffs Office also has significant limitations as to what enforcement can be done after a permit is issued to check on the welfare of animals, the number of animals, and the care of animals. Until a more detailed plan is presented, the Sheriffs Office will oppose this USR. The Commission would like to ensure that the animal waste is handled properly to prevent off-site odor, dust, runoff and migration of contaminants into the groundwater. 2.
