RE: APPROVE CREATING FUGITIVE PARTICULATE EMISSIONS REMEDIATION TRUST
FUND
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Colorado Department of Public Health and Environment can and does
levy penalties on individuals and companies found guilty of violating certain environmental laws
and regulations relating to air pollution, and
WHEREAS, the Colorado Department of Public Health and Environment authorizes the
proceeds from such fines to be used for supplemental environmental projects (SEP) in the
county where the violation occurred, and
WHEREAS, the Colorado Department of Public Health and Environment has identified
dust control on Weld County roads to be a recommended SEP they would approve, and
WHEREAS, as a condition for receiving the funds for the use of dust abatement
purposes, a trust fund (Fugitive Particulate Emissions Remediation Trust Fund)for the monies
must be created to insure that the funds are used only for the intended purpose of dust
abatement on county roads.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Fugitive Particulate Emissions Remediation Trust Fund be,
and hereby is, created for the above stated purpose, and the Weld County Treasurer and
Controller are hereby directed to account for these monies in the said fund as required by the
Colorado Department of Public Health and Environment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 13th day of March, A.D., 2002.
