STATEMENT By the Commission: — _ By the instant application, The Great Western Railway - Company seeks authority from the Commission to dismantle and abandon its railroad bridge No. 17, located near Loamy, Colorado, and sub- stitute' therefor a grade crossing. The *natter was regularly set for hearing, and heard, June 13, 1951, at the CommissionPs Hearing Room, 330 State Office Building, Denver, Colorado, with• due notice to all interested parties, and at the conclusion of the hearing,ithe matter vas taken under advisement. Applicant is a Colorado corporation, authorized to do business in the State of Colorado, with itw General. Office located at 506 Sugar Building, Denver, Colorado. Applicant owns and operates a • short-line railroad having approximately sixty-three (63) miles of main and branch line track, located in an agricultural area in northern • • Colorado and serving certsin beet factories and other industries located in paid area. No passenger trains are operated by this railroad and the • freight train operations consist principally of short hauls and switching • -1- /a✓/51 Et.2_, ak IIP 0= at the various beet receiving stations and industrial sites located in the area. Freight traffic consists of all commodities, but chiefly of sugar beets transported to sugar factories served by the railroad, • and of beet sugar and molasses manufactured at such factories. Located over the county road which nine north and south between Sections 4, 5, B and 9, Tup. 5-North, Range 67-West of the 6th P. N., in Weld County, Colorado, is applicant's wooden railroad bridge which it desires to remove and to construct thereat a railroad grade crossing. The location of the county road end the railroad bridge re- forted to herein are more fully shown on ra•hibit "6" attached to the instant application, and by reference made a part hereof. The testimony of the witness for applicant reveals that there are two daily daytime trains, avenging four care in length which pass over said railroad bridge during nine months of the year. During the months of October, November and December, when the movement of sugar beets occurs, four to six trains, avenging about thirteen cars in length, move over said railroad bridge, both day and night. Because of •the poor condition of the railroad bridge structure, the speed of trains crossing -- -- said bridge is presently five miles per hour. If permission is granted to remove this bridge and establish a crossing at grade, the maximum permissible speed over the crossing would not be in eauess of thirty miles per hour, and because of the grade, westbound trains would seldom attain a speed of sore than twenty miles per hour. Further testimony revealed that the existing railroad bridge has a vertical clearance over the county road of 12 feet and 6 inches, and a herizonta3 clearance between the wooden bents of 14 feet. Because of the restricted vertical clearance, farmers in the area have complained at various times to the railroad because it is necessary for them to make a detour of maaaraa miles when they want to move large pieces of fan equipment, such as combines. The grade on the present county road is such that vehicles going north under the bridge are going downgrade and shortly after passing under the bridge must again come upgrade. Vehicles traveling • _2- /acid K.Z • • • • north on the county road wanting to go to the Lorey beet dump must go downgrade under the bridge and shortly after passing under said bridge make an abrupt left hand turn into the beet dump road. Vehicles coming • from the beet dump have an added hazard because of the limited sight distance wader the bridge in having to approach nearly to the center of the county road. before turning. - If applicant is permitted to remove its wooden bridge, it .proposes to eliminate the hazard to motorists, due to the limited sight distance, •by filling the county road to bring it to the existing railroad grade from a point approximately 200 feet south of the proposed grade crossing extending over the grade crossing to a point approximately 100 feet north end continuing northward on about a 4$ down grade. By filling the road as outlined, the entrance of the Lorca beet road from the west will be located on that part of the fill which will be at railroad grade, thus providing good sight distance for all vehicles,approaching the county road from the Lorey road. The proposed_ fill_woui_d also reduce existing grades on the present county road which would be advantageous to motorists. Mr. Adolph Winter, County Commissioner from District No. 2 in Weld County, testified that "the county entered into an agreement with The Great Western Railway Company regarding the establishment of the railroad grade crossing, as proposed herein. Said Agreement, marked as Exhibit aB" • attached to the instant application, was identified by the witness and made a part of the record herein. By this Agreement the parties have mutually set out the portions of the work to be performed by each, the methods of said performance, and the division of maintenance to be per- formed by each party after completion. Mr. Winter further testified that ' by en actual count of vehicles, it was determined that 175 cars would use • this crossing in a 24-hour period. It was also his opinion that the elimination of the railroad bridge and the establishment of a crossing at improvement over thepresent setup. The county is willing grade would be an p up • to provide, install and maintain reflectorized advance warning signs in accordance with the Commission's specifications. In talking to the property `3" /oGA3 ref 67- � i •= = 3 • owners sdj .cent to the project, Mr. Winter said they not only had no objection, but most property owners agreed that something should be done because of the condition of the existing bridge. • Attorney for applicant, stated that if the railroad is per- mitted to remove tho existing bridge and install a crossing at grade, that said crossing would be installed in conformance with the specifications established by this Commission. Two reflectorieed standard railway- highway crossbuck signs would be installed adjacent to the crossing, said devices to be in conformance with the requirements of the Association of American Railroads, Bulletin No. ,3, as adopted by this Commission. It was estimated that the cost of the construction of the grade crossing would amount to 9,000.00, of which amount the railroad win pay approximately • .$8,000.00 and Meld County approximately $1,000.00. The railroad company contacted all adjacent property owners and public utilities. affected by the instant application, and has received from each a waiver of notice -and consent._to_famgrable action upon the application as filed. Said waivers and consents are attached to the • original application and were made apart of the record herein. The location of the railroad bridge is not within any corporate city or town . and does not crass any state highway. The State iighway Department of Colorado was notified of the instant application end replied in writing to the Commission that the crossing does not involve any highway over which the state has jurisdiction at this time, nor is it contemplated that this road is to be designated a state highway in the immediate future. No one appeared at the hearing in opposition to the. granting . of the authority sought. FINDINGS THE COMMISSION FINDS: 1.1. Exhibit "B" AGREEMENT THIS AGREEMENT, Made this 31st day of May, 1951, between The Great Western Railway Company, a Colorado corporation, (hereinafter called "Railway Company"), party of the first part, and The County of Weld, Colorado, (hereinafter called "Weld County"), party of the second part, WITNESSET H: WHEREAS, the parties hereto desire that a portion of the county road running north and south between Sections 4, 5, 8, and 9, Twp. 5 E., R. 67 W. of the 6th P. M., Weld County, Colorado, (hereinafter called "county road"), be improved, and that the railroad underpass located near Lorey, Colorado, be converted into a railroad grade crossing, all as shown on the plat, marked Exhibit "A", attached hereto and made a part hereof) and WHEREAS, incident to said program of improvement and con- version, it will be necessary to perform certain filling and grading operations upon the county road located immediately north of said underpass, which road leads to the so-called "Lorey beet dump" and beyond, (hereinafter called "Lorey road"), as indicated on said Exhibit "A"f WOW, THEREFORE, in consideration of the mutual promises of the parties hereto, it is agreed as follows: 1. The Railway Company shall at its expense perform the following operations at the aforesaid location: (a) Fill in and grade a temporary detour road around said county road and over the tracks of the Railway Company along such route as -1- 7- 5--2 the Weld County Supervisor of Roads and Roadeaster of the Railway Company may jointly select, but said filling and grading operations shall only be perform- ed in the event the said county road is kept open by The County of Weld, Colorado, during the time said improvements are being made. (b) Remove existing railroad bridge No. 17 shown at Railway I.C.C. Station 1391 plus 383 on Exhibit A". (c) Excavate and transport all dirt required for the fills to be made by the Railway Company to the work site. (d) Fill in and grade said county road and Lorey road to the elevation shown by the profiles on Exhibit "A". Said county road shall be 45 feet wide on top with slopes 1+ ' to 1 ' to the outside toes, and said Lore; road shall be 30 feet ride on top with slopes of 1 ' to 1' to the outside toes. (e) Upon completion of filling and grading opera- tions, construct standard track crossing over said county road and install two reflectorised crossbucks adjacent to said track crossing. (f) Relocate culvert south of railway bridge No. 17. 2. Weld County shall at its expense perform the following operations at the aforesaid location: (a) Provide all rights-of-ray for the completion of work in the manner herein specified. (b) Obtain from adjacent property owners and there- after make available to the Railway Company sufficient dirt for filling and grading said temporary detour road, (should one be establish- ed), county road and Lorey road. (c) Install such road signs as are required to direct traffic safely during the construction period. (d) Furnish and apply road surfacing material for those portions of the temporary detour road, (should one be established), county road and Lore; road which have been filled and graded by the Railway Company. (e) Install advance warning signs and bus stop signs upon said county road before it is reopened for use to the general public. (f) Remove culvert under county road north of rail- road bridge No. 17 and construct drain ditch along east side of said county road. -2- (g) Replace boundary fences along said county road. 3. All work hereunder shall be performed with due diligence and the operations of the Railway Company heretofor enumerated in paragraph 1 shall be under the direction and approval of the Weld County Road Supervisor, District Two. 4. Upon completion of the respective operations by the Railway Company and Weld County hereunder, it shall be the obligation of the Railway Company to keep said grade crossing in good condition and repair, and the obligation of Weld County to keep said county road and Lorey road in good condition and repair. 5. The Railway Company shall prepare and submit an applica- tion to the Colorado Public Utilities Commission seeking an order approving unconditionally the conversion of said underpass to a grade crossing as herein set forth. Failure of the Colorado Public Utilities Commission to approve said conversion as afore- said shall render this agreement null and void. 6. This agreement shall inure to the benefit of and be binding upon the successors and assigns of the respective parties hereto. The location of the railroad track, buildings, structures, property lines and roads in the vicinity of the proposed grade crossing, profiles showing ground lines and proposed grade lines of approaches on said county road, together with a plan view of said improvements when completed, are shown on said Exhibit "A" . 5. Two daily daytime trains averaging tour cars in length pass over said railroad bridge during nine months of the year. During the months of October, November and December, when the movement of sugar beets occurs, four to six trains averaging about thirteen cars in length move over said railroad bridge both day and night. Because of the poor condition of the rail- road bridge structure, the speed of trains crossing said railroad bridge is presently 5 miles per hour. Should a railroad grade crossing be established, the speed of eastbound trains at said crossing would not exceed a maximum of 50 miles per hour, and because of the grade, westbound trains would seldom attain more than 20 miles per hour. 8. Applicant has been informed by the Board of County Com- missioners of Weld County, Colorado, that approximately 175 motor vehicles per day pass under said railroad bridge at the aforesaid location. 7. The County of Weld, Colorado, has agreed to the removal of said railroad bridge and the construction of a railroad grade crossing over said county road at the location aforesaid, and has executed an agreement with Applicant in connection therewith, -2- all as set forth in Xxhibit "B". S. Independent of the aforesaid agreement, R,xhibit "B", the County of Weld intends to perform certain filling, grading and surfacing operations upon said county road as indicated by profile A-B on said Exhibit "A" . The aforesaid operations by said County of Weld will materially lessen the grade now existing to the north of said railroad bridge on said county road. 9. The elimination of said railroad bridge and its replaee- ment by a grade crossing is necessary and proper for the service, accommodation and convenience of the public for the following reasons : (a) Said railroad bridge crosses said county road at an oblique angle, thereby creating a dangerous turn in said county road where it passes under said railroad bridge. (b) The center supporting bent beneath said railroad bridge is a hazard to motor vehicles passing thereunder. (c ) The abrupt changes in grade now existing on said county road are a traffic hazard. The over-all improvement program contemplated by the removal of said railroad bridge, the construction of said railroad grade crossing, and the grading of said county road would decrease the percent of grade now *misting on said county road at the aforesaid location all as shown by the profile maps on Bxhibi t AA". (d) The 12 foot 6 inch overhead clearance on said rail- road bridge will not permit combines and other large pieces of farm machinery to pass thereunder, thereby requiring farmers in the area to mace lengthy detours as well as delaying farm operations in an important farming area. (e) A county road leading to the Lorey beet dump and beyond, (hereinafter called "Lorey road" ) , enters said county road immediately north of said railroad bridge. The present grade at said point of inter- section creates a serious traffic hazard because of the total lack of visibility to the south when entering upon said county road from said Lorey road. As shown by Exhibit "A", said Lorey road would be graded to the elevation of the established top of rail at said railroad bridge thereby eliminating the aforesaid traffic hazard. (t) The proposed improvement program would be superior in every respect to the replacement of said bridge in kind. (g) In view of the small amount of train and motor vehicle traffic passing said railroad crossing each day, Applicant cannot justify an expenditure of approximately $25,000.00 to replace said rail- road bridge with a steal structure. 10. The contemplated filling and grading program would materially increase the visibility of trains by motor vehicles traveling on said county road. Further, the aforesaid grading and filling operations would provide clear visibility of south- bound traffic by motor vehicles entering said county road from said Lorey road, which risibility is totally lacking at the present time. 11. The contemplated grads crossing to be constructed and maintained by Applicant is the standard county highway crossing for single track shorn on the attached drawing marked Nxhibit "C", heretofore approved by the Engineering Department of The Public Utilities Commission of the State of Colorado. 12. The proposed grade crossing is not located within the limits of any incorporated city or town within the State of Colorado, and does not cross any Colorado state highway. 13. Applicant proposes to install two highway crossing devices of the 50• reflector type adjacent to said grade crossing, which crossing devices have been recommended by the Association of American Railroads in its Bulletin No. 3. The County of Weld proposes to install reflectorised advance warning and bus stop signs at said grade crossing, all as set forth in Exhibit "B" . 14. It is estimated the total expense incident to the removal of said railroad bridge and construction of said grade crossing will amount to $9,000. Applicant' s share of said expense will approximate $8,000, all of which will be provided from its -4- / >'76 67 existing funds. The share of the County of Weld, Colorado, is estimated to be $1,000, all of which will be provided from county road funds. 15.
