Subject: Condition of Approval 1.D. for 2nd AmUSR-1125
Dear Commissioners:
This letter is a request for a change to Condition of Approval 1.D. which states,"Prior to recording the
plat, the applicant shall apply, and receive approval, for a Flood Hazard Development Permit from the
Department of Planning Services." We are requesting that this condition be changed to prior to the
release of building permits, rather than prior to recording the plat. The reason for this request is due to
the change in the Weld County Code that addresses construction in the Flood Plain. Our current,
approved Flood Hazard Development Permit (FHDP) includes the structures that are currently on site
and at the time of approval of this FHDP, the requirement was flood proofing of those structures. It is
our understanding that our new office structure has to be constructed one foot above the flood plain,
on a permanent foundation. The problem with this scenario is there has been no established base flood
elevation in this area, therefore a very intensive flood study is required by Hall-Irwin Corporation to
meet the current requirements for structures in the Flood Plain. This intensive flood study will take
some time to accomplish and so we are formally requesting that this condition be changed to prior to
release of building permits, so that we can record the Mylar plat. All other conditions of approval
have been met at this time.
If you have any questions, please feel free to contact me. Thank you for your consideration in this
matter.
Sincerely,
