HomeMy WebLinkAbout20021493.tiff RESOLUTION RE: APPROVE REQUEST TO AUTHORIZE RECORDING OF PLAT FOR SECOND AMENDED USE BY SPECIAL REVIEW PERMIT#1125 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Second Amended Use by Special Review Permit#1125 was approved by the Board of County Commissioners by Resolution dated April 24, 2002, and WHEREAS, Condition of Approval 1.D. of Seconded Amended Use by Special Review Permit#1125 requires that prior to recording the plat, the applicant shall apply, and receive approval, for a Flood Hazard Development Permit (FHDP) from the Department of Planning Services, and WHEREAS, the applicant, Hall-Irwin Corporation, has submitted a letter to the Board, dated May 30, 2002, which states that the company has submitted the application for the FHDP and has complied with all of the other Conditions of Approval of Seconded Amended Use by Special Review Permit #1125, and then requests that the company be allowed to record the plat prior to the approval of the FDHP, deferring the requirement of approval to prior to the issuance of building permits for the new office building, and WHEREAS, the Board is satisfied that the applicant has made every effort to comply with the Conditions of Approval for Seconded Amended Use by Special Review Permit #1125, and is certain that the applicant will work with the Department of Planning Services in case any additional information or corrections to the plat are required in the course of the FHDP review, and WHEREAS, the Board now deems it advisable to authorize the recording of the plat, with the understanding that the FHDP must be approved prior to the issuance of building permits for the new office building. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Board hereby authorizes the recording of the plat for Seconded Amended Use by Special Review Permit#1125, with the understanding that the FHDP must be approved prior to the issuance of building permits for the new office building. Masden Date of signature: 8 2002-1493 PL1143 CONSTRUCTION • AGGREGATES • LEASING • GOLF May 30, 2002 Weld County Board of County Commissioners 915 10th Street Greeley, CO 80631 Subject: Condition of Approval 1.D. for 2nd AmUSR-1125 Dear Commissioners: This letter is a request for a change to Condition of Approval 1.D. which states,"Prior to recording the plat, the applicant shall apply, and receive approval, for a Flood Hazard Development Permit from the Department of Planning Services." We are requesting that this condition be changed to prior to the release of building permits, rather than prior to recording the plat. The reason for this request is due to the change in the Weld County Code that addresses construction in the Flood Plain. Our current, approved Flood Hazard Development Permit (FHDP) includes the structures that are currently on site and at the time of approval of this FHDP, the requirement was flood proofing of those structures. It is our understanding that our new office structure has to be constructed one foot above the flood plain, on a permanent foundation. The problem with this scenario is there has been no established base flood elevation in this area, therefore a very intensive flood study is required by Hall-Irwin Corporation to meet the current requirements for structures in the Flood Plain. This intensive flood study will take some time to accomplish and so we are formally requesting that this condition be changed to prior to release of building permits, so that we can record the Mylar plat.
