RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2340 -
ANGEL HICKEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 18th
day of November, 2002, considered the request of Angel Hickey, 440 Wall Street, Eaton,
Colorado 80615, for a mobile home to be used as a temporary use during a medical hardship,
and
WHEREAS, said mobile home to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Parts of Lots 3 through 5, Block 3, East Side
Addition to the Town of Eaton, Weld County,
Colorado
WHEREAS, the Board of County Commissioners, having heard all of the testimony,
finds that, pursuant to Section 23-4-180 of the Weld County Code, said request should be
denied for the following reasons:
1. The applicant has failed to prove that the mobile home will be occupied by a
person(s)who is required to provide supervision or care to those persons in the
principal dwelling unit on the property.
2. The applicant has failed to prove that adequate water and sewage disposal
facilities are available to the mobile home.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Angel Hickey for permission to place a mobile home
to be used as a temporary use during a Medical Hardship on the above described parcel of land
be, and hereby is, denied.

REQUEST: This is a request for a Mobile Home to be used as a Temporary Use During a Medical
Hardship.
LEGAL DESCRIPTION: Lots 3 through 5, Block 3, East Side Addition, Weld County, Colorado.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be denied for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 23-4-180 of the Weld County Code, as follows:
a. A medical hardship exists in which the person to be living in the mobile home requires the
supervision and care of those persons residing in the principal dwelling unit on the property
(or the reverse). Documentation of the medical hardship shall be established in a letter
from the subject's medical doctor or other evidence deemed suitable by the Department of
Planning Services. The letter shall be submitted as a part of the zoning permit application
and shall verify that the subject is physically impaired and requires full-time care.
The Department of Planning Staff reviewed the information provided by the applicant, and
concurred that an additional home is not justified as full time care in not required.
b. Adequate water and sewage disposal facilities are available to the mobile home.
The East Eaton Water and Sanitation district requires a separate tap for each home. The
applicant has not obtained a separate tap for the mobile home, therefore not meeting the
requirement for water and sewer facilities.
2002-3017
Should the Board of County Commissioners approve this request,the Department of Planning Services'staff
recommends the following conditions be attached:
1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home
on the property.
2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved
sewer system and a legal water supply.
3. The mobile home shall not be occupied until such time that the applicant has complied with
Conditions 1 and 2 stated above.
4. All zoning permits for mobile homes during a medical hardship are temporary. Such permits shall
be subject to review annually on the anniversary of the original permit's issuance. Such permits
shall be extended only if the use continues to be in conformance with the criteria set out in Section
23-4-180. Any permit fora medical hardship use shall automatically expire, and the mobile home
shall be removed upon cessation of the medical hardship or at any such time as the mobile home
is used for other than the permitted use.
5. The applicant shall submit documentation to the Department of Planning Services by December
1st of each year describing the status of the medical hardship. This permit is temporary and shall
terminate once the medical hardship ceases to exist, at which time the applicant shall have thirty
(30) days to remove the mobile home from the property.
6. All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future right-of-way line.
7. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or totally
damaged by fire, earthquake,wind, or other natural causes, or is in a state of general dilapidation,
deterioration,or decay resulting from improper lack of maintenance, vandalism, or infestation with
vermin or rodents. Any such derelict manufactured (mobile) home shall be returned to and
maintained in the condition as originally established on site and as inspected by the Weld County
Building Inspection Department, or it shall be removed from the site.
8. Any future structures or uses on site must obtain the appropriate zoning and building permits.
9. 5th Street is designated on the Weld County Transportation Plan Map as a paved road, which
requires 75 feet of right-of-way at full build out.There is presently 75 feet of right-of-way.This road
is maintained by Weld County.
10. The applicant shall use the existing access to this parcel.
11. Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant
to Section 15-1-10 of the Weld County Code.
12. The applicant shall maintain compliance with Section 23-4-180 of the Weld County Code at all
times.

Your zoning permit for a mobile home application is being processed by our office. If it is determined that
the application meets the approval criteria of Chapter 23, Article IV, Division 3, of the Weld County Code,
you will be notified that the zoning permit is approved. If the staff determines that the application does not
meet the approval criteria, you will be notified and asked to appear before the Board of County
Commissioners at a public hearing. You will be informed of the hearing date at least a week prior to the
hearing. The Board of County Commissioners will then consider your application and make a final decision
on the zoning permit for the mobile home.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality, Therefore, our office has forwarded a copy of the
submitted materials to the Eaton Planning Commission for their review and comments. It is iecommended
that you and/o-a representative be in attendance at the Eaton Planning Commission meeting to answer any

To Whom It May Concern:
Ms. Hickey is a patient of ours. She has requested a letter stating the need for a second
residence on her property due to her medical conditions. The patient has a history of
seizure disorder and is on Tegretol, Phenobarbital and Primidone. Her seizures are well
controlled and she's been seizure-free since 1982. The patient also has hypertension and
is on Enalapril and Covera for that. Control has been good. We do follow periodically to
adjust medications. The patient also has right shoulder pain from an injury, has about
75% range of motion of the shoulder,but does state she needs help with some of her
activities of daily living. She has lost her job because of the shoulder pain and inability
to work with it. The patient also has a history of some depression and is on
antidepressant and stable. She has history of some syncopal episodes in the past but
nothing of any significance recently. Given these medical conditions the patient asks that
consideration be given for zoning variance to allow a second residence on her property.
You may wish to consider these medical conditions in making that decision.

The Weld County Public Works Department has reviewed this proposal. Our comments and
requirements are as follows:
COMMENTS:
5th Street is designated on the Transportation Plan Map as a paved road, which requires a 75-
foot right-of-way at full build out. There is presently a 75-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code,
Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-
of-way line. See the attached East Eaton Plat.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The applicant shall utilize the existing residential access to this parcel.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.
