HomeMy WebLinkAbout20020571.tiff RESOLUTION RE: APPROVE PLANNING AGREEMENT AND AUTHORIZE CHAIR TO SIGN - NORTHEAST BEHAVIORAL HEALTH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Planning Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and Northeast Behavioral Health, commencing March 1, 2002, and ending December 31, 2002, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the Planning Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and Northeast Behavioral Health be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Griego, Director, Social Services a RE: Planning Agreement Between Northeast Be avioral Health and Weld County Department of Social Services Enclosed for Board approval is a Planning Amendment between Northeast Behavioral Health and Weld County Department of Social Services. The Board reviewed the Planning Agreement at a February 13, 2002, Work Session. The non-financial agreement is to assist North Range Behavioral Health to meet their Mental Health Assessment and Services Agencies (MHASA) contract requirements and to begin a planning process between North Range Behavioral Health and the Weld County Department of Social Services. The term of the agreement is from March 1, 2002 through December 31, 2002. If you have any questions, please telephone me at extension 6510. 2002-0571 PLANNING AGREEMENT BETWEEN NORTHEAST BEHAVIORIAL HEALTH AND WELD COUNTY DEPARTMENT OF SOCIAL SERVICES INTRODUCTION Colorado Mental Health Services (MHS) supports community-based mental health treatment by purchasing services through contracts with Mental Health Assessment and Service Agencies (MHASAs), Community Mental Health Centers (CMHCs), and Specialty Clinics. Colorado's Public Mental Health System is comprised of the Colorado Mental Health Institutes and the Community-Based Mental Health Programs overseen by MHS. Community Programs provide the majority of the services delivered in the Public Mental Health System. MHASAs manage the delivery of mental health services to the Medicaid population. CMHC's plan and provide services to individuals who are not Medicaid eligible, and the clinics serve populations such as members of ethnic/linguistic minority groups. Both CMHCs and MHASAs are responsible for services within defined geographic service areas. MHS provides leadership and oversight of the community mental health system. MHS has accepted a proposal from Northeast Behavioral Health (NBH), which has resulted in an Agreement being entered into for NBH to develop and manage mental health services for Weld County Medicaid recipients (the "Master Contract"). NBH, for the purpose of this agreement, is assumed to be any or all of the mental health centers serving the counties of Northeast Colorado, including Weld County. NRBH is a CMHC and MHASA provider. Colorado has a State-Supervised/County-Administered Services Delivery System for Social Services Programs. That means that County Board of Commissioners, acting in their capacity as the County Board of Social Services, have the primary responsibility to fund through its county share, staff, and administer Social Services programs. Counties have statutory duties as agents of the State. The Weld County Department of Social Services (WCDSS) is a department of Weld County Government and under the direction of the Board of County Commissioners, Weld County. The Weld County Department of Social Services provides a variety of programs and services including the Colorado Works Program and the Child Welfare Services. As part of NBH's requirements under the "Master Contract", NBH wishes to enter into a Planning Agreement with the Weld County Department of Social Services. The Weld County Department of Social Services is willing to enter into such a Planning Agreement. This Agreement seeks to define, coordinate and integrate, as appropriate, the planning activities and responsibilities of NBH and WCDSS in order to: • Support the ability of families and children involved with WCDSS to gain access to clinically necessary mental health services which are quality-driven, cost-effective, community based and delivered in the least restrictive setting; 1 • Support the commitment of WCDSS to family preservation and case-management programming; • Broaden the continuum of mental health services available for children and families; • Ensure service availability from NBH prior to, during and after children and family involvement with WCDSS in order to assist tem in functioning successfully without ongoing intervention from WCDSS; • Ensure availability of appropriate services for WCDSS families and children at the earliest appropriate time for intervention. • Ensure that clinically necessary services including treatment are available in a timely manner so that WCDSS may complete investigations and assessments within its legal mandate; • Provide the structure for inter-agency communication and appropriate involvement regarding the provision of mental health treatment services for shared NBH/WCDSS clients; • Support provision of residential services by WCDSS by timely communication and coordination between NBH, WCDSS, and other involved agencies; • Clarify WCDSS' and NBH's respective clinical, program/operational and financial responsibility. NBH and WCDSS hereby agree to the following: I. PLANNING PRINCIPLES NBH and WCDSS share a commitment to ensure that each entity maximizes available resources for the provision of needed services for children and families within the constraints of applicable legislation, regulation and contractual obligation; improve the quality and the availability of necessary assessment, evaluation and treatment services. NBH and WCDSS recognize that accessible services at the earliest appropriate time help prevent family disruption that may result in out-of-home placement and in-patient treatment. Shifting resources from these costly services to community-based alternatives when in the best interests of the involved clients is critical to progress in supporting the functional integrity of the family unit. NBH and WCDSS also recognize that when out- of-home placement must occur appropriate and timely services are necessary for reunification of the family. NBH and WCDSS agree to work together with one another to develop and to ensure the timely delivery of such services that are outcome-based and quality services for specific clients. II. ACTION PLAN A. NBH and WCDSS recognize that modification in the design or operation of either system may lead to cost shifting. Each organization will continue to identify and track such shifts, to share the resultant information and to present such information to all concerned Departments. Cost shifting occurs when clients are not provided services according to Items II, D, E, and F of this Planning Agreement. NBH and WCDSS agree to work together to prevent cost shifting by developing joint projects or joint treatment plans for clients. 2 B. To facilitate ready access to mental health treatment of Medicaid beneficiaries (including individuals receiving Colorado Works Assistance), upon request, NBH will provide training to WCDSS staff in the identification of mental health issues and the protocol of referral to an NBH provider at no cost to WCDSS. In like fashion, WCDSS will provide training, at no cost to NBH, to NBH staff in the identification of child protection issues and the protocol of referral to WCDSS. C. To make access to services easily accessible to individuals involved with WCDSS in out of home placement(including individuals receiving Colorado Works Assistance), NBH will, as requested and when the number of people needing services make it feasible, provide on-site services at no cost to WCDSS. D. NBH will not deny timely authorization for medically necessary, acute mental health treatment solely on the basis of the person's past or current involvement in a WCDSS funded service. E. WCDSS will not refuse timely placement of a child in its custody in an appropriate service on the basis of the child's eligibility for Medicaid funded services. F. NBH and WCDSS will jointly develop a timely process for the review and resolution of individual cases in which one organization believes a Medicaid recipient or a non-Medicaid recipient eligible for HB00-1116 services has been denied access inappropriately to services funded by the other. G. NBH and WCDSS agree to seek the most appropriate, cost-effective level of care available. H. NBH and WCDSS will regularly review and clarify funding responsibilities for services accessible to clients, both from WCDSS and NBH, as necessary. NBH and WCDSS will work together to ensure that treatment services ordered by the Court are promptly provided to children and families. NBH will be bound by an order of a court of competent jurisdiction directed at NBH. When NBH decides that service/program is not medically necessary or appropriate, it will cooperate with WCDSS in providing the clinical basis for its decision, which WCDSS may use to address a court's requirement that WCDSS provide these services. J. NBH shall continue its responsibility for funding medically necessary outpatient services for all recipients included under NBH's contract. Similarly, WCDSS shall maintain its funding of alternative in-home and residential services subject to available appropriations and decisions of the governing bodies overseeing these funds. 3 K. NBH will actively involve WCDSS staff in discharge planning for children who are in the custody of WCDSS or may need out of home placement upon or after discharge in psychiatric hospitals provided that both agencies ensure that appropriate releases and/or court orders are in place if necessary. III. Services Planning In order to facilitate the treatment process, WCDSS and NBH agree to these service- planning procedures. A. NBH and WCDSS agree to develop a timely review process to allow WCDSS social worker to present service needs directly to NBH's staff, if necessary. B. WCDSS and NBH will recognize the special service needs of the Weld County population, including, but not limited to: • Persons of different cultures and who have a primary language other than English; • Persons who are HIV infected or have other serious infectious diseases; • Persons who are deaf or otherwise hearing impaired; • Persons who have developmental disabilities; • Persons who suffer from post-traumatic stress syndrome; or • Persons who have been affected by physical or sexual abuse and/or by domestic violence. IV. CLINICAL COORDINATION-CASE MANAGEMENT A. NBH's utilization review clinicians shall determine if any inpatient care or exceptional outpatient service for Medicaid eligible children or families is reimbursable on the basis of medical necessity. WCDSS staff are expected to influence these decisions by sharing their clinical data and recommendations with NBH's clinical reviewers, subject to client's signature on appropriate releases. B. WCDSS staff will participate in the NBH discharge planning for WCDSS children. Responsibility for participation will begin upon admission to inpatient services and will be a priority professional activity. C. WCDSS will provide, as appropriate, case management services to all families who are eligible for services through an abuse and neglect report or court action or a voluntary application. 4 V. DATA SHARING To the extent possible, NBH; and WCDSS will collaborate in the collection of utilization data and client profile information. When use of the same data collection processes is impossible, the organizations agree to share client and service data as freely as possible within statutory and regulatory limits regarding confidentiality and within the constraints of resources, especially staff time. VI. TERM 1404.41(-11 This Agreement will take effect on January 1, 2002 and shall continue through December 31, 2002. This Agreement shall terminate immediately upon termination of the NBH's Master Contract. Either party may terminate this Agreement prior to expiration of this term upon thirty (30) days' written notice. No amendment or modification of this Agreement shall be valid unless in writing and approved by each of the parties. VII. NO THIRD PARTY BENEFICIARY Nothing in this Agreement is intended to create rights in any third party beneficiary.
