This site plan review is approved with the attached conditions:
1. Prior to recording the Site Plan Review plat,the applicant shall address the following to the
Department of Planning Services' satisfaction:
A. The plat shall be amended to delineate the following:
1. The applicant shall prepare a Site Plan Review map per Section 23-2-160.V
and Section 23-2-160.W of the Weld County Code. (Department of

X This site will be required to meet all requirements of the American Disability
Act (ADA). ADA parking spaces are twenty (20) feet by eight (8) feet with
five (5) foot aisles. A minimum of one space must be van accessible with
an eight (8) foot aisle. An accessible path shall be required from the
building to the public right-of-way. Further, a portion of the structure will also
be required to meet accessibility requirements. (Department of Planning

e The parking area shall adhere to off-street Parking and Loading
Requirements, per Appendix 23-A, 23-B, Section 23-3-350.B of the Weld

.4� The applicant shall delineate thirty-six(36) parking stalls for the warehouse
facility and one space for every two employees plus one space per each five
hundred square feet of office space. The office scales at 4500 square feet,
thus nine parking spaces at a minimum are required, in addition to the ADA
parking stalls discussed in item 1.A.1. The dimensions of the parking stalls
shall adhere to Appendix 23-A of the Weld County Code. The proposed off-
street parking shall be sufficiently screened and paved parking areas shall
be provided in the industrial zone districts to meet the requirements of
employees, company vehicles, visitors and customers of the uses allowed

The applicant shall place a typical cross-section of the parking lot on the plat
and identify the depth of base material according to Chapter 24.

The vehicle parking and office area shall adhere to the Off Street Parking
and Loading Requirements, per Appendix 23-A, 23-B, Section 23-3-350.5

7. The off-street parking spaces, including the access drive, shall be surfaced
with gravel, asphalt, concrete, or equivalent and shall be graded to prevent
drainage problems. The circulation appears to be adequate for the
proposed facility. The Department of Public Works notes that the existing
asphalt office parking is in place and appears to be adequate. The overflow

Weld County Road 66 is designated on the Weld County Transportation
Plan Map as a local road,which requires sixty(60)feet of right-of-way at full
build out. There is presently sixty (60) feet of right-of-way. A total of thirty
(30) feet from the centerline of Weld County Road 66 shall be delineated
right-of-way on the plat. (Department of Public Works)
,8( The applicant shall utilize the existing access point to WCR 66. The
applicant has posted a "no left turn" sign for trucks at this location. The
access is parallel to the Union Pacific tracks and right-of-way. Trucks are
routed to the next intersection, which is signal controlled. Further, The
applicant shall utilize the existing access from WCR 62, that is directly east

10. Existing and proposed fences identified on the site plan shall be in

\n conformance with Sections 23-3-350.F.1 and 23-3-350.F.2 of the Weld
County Code at all times. Due to the nature of the facility, the entire
property shall be screened with an opaque screen material at least six feet

facility from WCR 66 and SH 85. The buffer strip shall be a minimum of ten

The storm water detention area proposed in the extreme south portion of
Big R's layout, and partly on Railroad property is in violation of the lease
Vt agreement between Big R(WSW, Inc.and the Union Pacific Railroad). This
use of the Railroad's property is neither allowed under Big R's lease nor
authorized by the Railroad, and the Railroad will not approve of this use.
The applicant shall modify the drawing to reflect the requirements of the

Q 18. The applicant shall delineate a fence at the property line serving as a
separation between the activity located on the Big R Manufacturing site and
��✓ the existing rail line and railroad property as outlined in the e-mail received
December 17, 2002 from the Union Pacific Railroad.
B. The following notes shall be placed on the plat:
1. In accordance with the Weld County Code, no land, building or structure
shall be changed in use or type of occupancy, developed, erected,
constructed, reconstructed, moved or structurally altered or operated in the
Industrial Zone District until a Site Plan Review has been approved by the

2. The application does not propose any portion of the site to be leased to
another party. In the event that a portion of the building is proposed to be
leased to another party in the future,the applicant shall submit a copy of the
lease agreement and information regarding the proposed use of the leased
portion to the Weld County Attorney's office, Weld County Building
Inspection Department, Eaton Fire Protection District and the Department
of Planning Services for review. Based upon the proposed use and/or
impacts of the leased portion, the Department of Planning Services may

3. There shall be no parking or staging of trucks allowed on WCR 66.

4. The facility shall operate in accordance with the approved dust control plan.

5. Any septic system located on the property must comply with all provisions
of the Weld County Code, pertaining to Individual Sewage Disposal

9. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and
removed for final disposal in a manner that protects against surface and

10. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-

11. Waste materials shall be handled and stored and disposed of in a manner
that controls fugitive dust, blowing debris and other nuisance conditions.

12. Fugitive dust shall be controlled and confined on this site. The facility shall
be operated in accordance with the approved dust abatement plan at all

13. This facility shall adhere to the maximum permissible noise levels allowed
in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended.

14. Adequate handwashing and toilet facilities shall be provided for employees

15. In accordance with the Above Ground Storage Tank Regulations (7CCR
1101-14) a spillage retention berm shall be constructed around the tank
battery. The volume retained by the spillage berm shall be greater than the
volume of the largest tank inside the berm. Alternative protective measures
may be allowed provided they comply with the Above Ground Storage Tank

16. Any vehicle washing area(s) shall capture all effluent and prevent
discharges from the washing of vehicles in accordance with the Weld
County Code, the Rules and Regulations of the Water Quality Control

be maintained at all times. Dead or diseased plant materials shall be
replaced with materials of similar quantity and quality at the earliest possible

Health Services Division of the Weld County Department of Public Health &

include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number). Evidence of such shall be
submitted in writing to the Weld County Department of Planning Services.

/ the septic system serving the maintenance shop. The septic system shall be

to handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately sized
or constructed the system shall be brought into compliance with current

The Am5PR-188 plat was reviewed by staff on February 27, 2004 specific to meeting
the Conditions of Approval. Staff has annotated the conditions providing a status
report of approval for the specific condition.
It should be noted that the applicant and the site shall be in compliance based on the
current set of referral documents received per this application.

if there are yard lights that illuminate the storage yard. If
additional lights are present,these fixtures shall be delineated on
the plat.
14. The sign shall be located, and designed in accordance with the
requirements of Section 23-4-100 and Section 23-4-110 of the Weld County

delineated on the west side of the building. Additionally the size
and illumination, if any shall also be discussed and identified.
15. In accordance with Section 23-3-350.H of the Weld County Code, the
applicant shall screen all trash receptacles from adjacent rights-of-way and
adjacent properties. Further,the areas shall be designed in such a manner

constructed, reconstructed, moved or structurally altered or operated in the
Industrial Zone District until a Site Plan Review has been approved by the

2. The application does not propose any portion of the site to be leased to
another party. In the event that a portion of the building is proposed to be
leased to another party in the future, the applicant shall submit a copy of the
lease agreement and information regarding the proposed use of the leased
portion to the Weld County Attorney's office, Weld County Building
Inspection Department, Eaton Fire Protection District and the Department
of Planning Services for review. Based upon the proposed use and/or
impacts of the leased portion, the Department of Planning Services may

removed for final disposal in a manner that protects against surface and

10. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-

11. Waste materials shall be handled and stored and disposed of in a manner
that controls fugitive dust, blowing debris and other nuisance conditions.

12. Fugitive dust shall be controlled and confined on this site. The facility shall
be operated in accordance with the approved dust abatement plan at all

13. This facility shall adhere to the maximum permissible noise levels allowed
in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended.

14. Adequate handwashing and toilet facilities shall be provided for employees

15. In accordance with the Above Ground Storage Tank Regulations (7CCR
1101-14) a spillage retention berm shall be constructed around the tank
battery. The volume retained by the spillage berm shall be greater than the
volume of the largest tank inside the berm. Alternative protective measures
may be allowed provided they comply with the Above Ground Storage Tank

16. Any vehicle washing area(s) shall capture all effluent and prevent
discharges from the washing of vehicles in accordance with the Weld
County Code, the Rules and Regulations of the Water Quality Control

from this referral agency.
F. The applicant shall address the requirements (concerns) of the Union Pacific
Railroad, as stated in the e-mail referral response received December 17, 2002.
Evidence of such shall be submitted in writing to the Weld County Department of

written evidence as requested and provide written evidence of approval
from this referral agency.
G. The applicant shall submit a plan describing any proposed on-site signs. Any
proposed sign shall adhere to Section 23-4-100 of the Weld County Code. All

2. Prior to Recording the Plat:
A. The applicant shall submit a Landscape Plan to the Department of Planning
Services for review and approval. Upon approval the Landscape Plan shall be

submit written evidence as requested and delineate the location(s) on
the plat. See referral comments from City of Greeley, Union Pacific Rail
Road and Weld County Government statements.
B. If applicable, the applicant shall apply for an Underground Injection Control (UIC)
Class V Injection Well permit,for the maintenance shop,through the Environmental
Protection Agency(EPA)or provide evidence that the applicant is not subject to the
EPA Class V requirements. (Department of Public Health and Environment) The
applicant shall submit written evidence as requested and provide written
evidence of approval from this referral agency.
C. The applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and
Emissions Permit application to the Air Pollution Control Division, Colorado
Department of Health and Environment for emissions of criteria, hazardous or
odorous air pollutants. Evidence of such shall be submitted in writing to the Weld
County Department of Planning Services.(Department of Public Health and
Environment) The applicant shall submit written evidence as requested
and provide written evidence of approval from this referral agency.
D. Submit a dust abatement plan to the Environmental Health Services, Weld County
Department of Public Health & Environment, for approval prior to operation. This
plan shall include the measures to be taken to prevent sandblast material from
blowing off of the property. Evidence of such shall be submitted in writing to the
Weld County Department of Planning Services.(Department of Public Health and
Environment) The applicant shall submit written evidence as requested
and provide written evidence of approval from this referral agency.
E. The applicant shall submit a waste handling plan,for approval,to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including

the facility name, address, and phone number). Evidence of such shall be
submitted in writing to the Weld County Department of Planning Services.
(Department of Public Health and Environment) The applicant shall
submit written evidence as requested and provide written
evidence of approval from this referral agency. The applicant
shall provide a list of the waste haulers associated with this
facility, even sporadic waste haulers.
F. The Environmental Health Services Division was unable to locate a septic permit for
the septic system serving the maintenance shop. The septic system shall be
reviewed by a Colorado Registered Professional Engineer. The review shall consist
of observation of the system and a technical review describing the systems ability
to handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately sized
or constructed the system shall be brought into compliance with current
Regulations. Evidence of such shall be submitted in writing to the Weld County
Department of Planning Services. (Department of Public Health and Environment)
The applicant shall submit written evidence as requested and provide
written evidence of approval from this referral agency.
G. The applicant shall ensure that the Above Ground Storage Tanks meet the
requirements of Regulations (7 CCR 1101-14) in regards to the construction of the
spillage retention berm around the tank battery. The volume retained by the
spillage berm should be greater than the volume of the largest tank inside the berm.

J. The applicant shall enter into an Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for parking and
landscaping requirements. The agreement and form of collateral shall be reviewed
by County Staff and accepted by the Board of County Commissioners prior to
recording the plat. (Department of Planning Services) For all on-site
improvements, collateral is held by the County until such improvements
have been completed. Should the applicant make improvements on the
property to bring the facility and the property into compliance, no
collateral will be required for work completed. All other improvements
associated with the facility will require collateral to be posted.
4. Prior to the release of building permits:
a. Upon approval by the Department of Planning Services, the Site Plan Review shall
be prepared per Section 23-2-160.W of the Weld County Code and submitted to the

IMPROVEMENTS AGREEMENT
LANDSCAPE IMPROVEMENTS
THIS AGREEMENT, made and entered into this day of
20 , by and between the County of Weld, State of Colorado, acting through its Board of
County Commissioners, hereinafter called "County," and
hereinafter called"Applicant.
WITNESSETH:
WHEREAS, Applicant is the owner of or has a controlling interest in the following
described property in the County of Weld, Colorado:
WHEREAS, a final Site Plan of said property, to be known as
Case Number SPR- , has been submitted to the County for approval; and
WHEREAS, § 2-3-30 A.1.of the Weld County Code provides that a final Site Plan shall
be accompanied by collateral guaranteeing the construction of landscape improvements shown
on the plans and supporting documents of the Site Plan, which improvements are listed in
Exhibit "A" of this Agreement.
NOW, THEREFORE, IN CONSIDERATION OF the foregoing and the acceptance and
approval of said final Site Plan and subsequent issuance of required building permit(s), the
parties hereto promise, covenant and agree as follows:
1. Construction: Applicant shall furnish and install, at its own expense, the private
improvements listed on Exhibit"A"which is attached hereto and a part hereof by this
reference.
A. Construction shall be in strict conformance to the approved Site and
Landscape Plans.
B. At all times during the construction, the County reserves the right to inspect
the work. Any work not meeting the intent of the plan shall be replaced to
conform to the approved plans at the Applicant's expense.
C. The work shall be completed within nine months of the applicant being
provided notice of the recording of a Site Plan for the property to the I-3 zoned
property to the North East [ W2NW4 29-6-65 Lying E OF UPRR Main Track
except 11.25 ac deeded to UPRR Book 292 Page 523; also except beginning NW

D. The Applicant intends to develop the Site in accordance with the approved
Landscape plans.
2. Request for Release of Obligation: Prior to release of the obligation to construct
the improvements set forth in Exhibits "A", the Applicant will present a
statement of Substantial Compliance from a Landscape Architect or allied
Professional stating that, to the Professional's best knowledge and belief, the
improvements or portion thereof, have been completed in substantial compliance
with approved plans and specifications. Said Statement(s) of Compliance will be
issued to the Weld County Department of Planning Services for review and
preparation of a recommendation to the County Commissioners.
This agreement may be released only by resolution of the Board of County
Commissioners approved in a regularly scheduled business meeting.
3. Successors and Assigns: This Agreement shall be binding upon the heirs,
executors, personal representatives, successors and assigns of the Applicant, and
upon recording by the County, shall be deemed a covenant running with the land
herein described, and shall be binding upon the successors in ownership of said
land.
4. Enforcement: In lieu of the posting of collateral, the Applicant agrees that this
agreement may be enforced by the Board, at the discretion of the Board, in the
following manner:
(A) By specific performance to require the installation of landscaping
(B) By injunction or other equitable relief to preclude the further use of
the subject property without installation of the landscaping
(C) The parties agree that the damages in the event of a breach by
applicant are difficult to ascertain at this time, and that they intend
to provide liquidated damages in the amount of$
which is a reasonable estimate of the cost of installing the
landscaping.
(D) The Applicant shall be responsible to pay all costs and attorney
fees incurred by County.
(E) No action to enforce this agreement shall be filed without first
providing applicant 60 days notice and opportunity to cure.

I am attaching the latest e-mail from the UP Railroad. Their track maintenance manager has still not come out to inspect the storm
water detention pond. I have called and left messages for him repeatedly with out a response.
I believe we have met all of the requirements of the site plan review with the exception of a few items. One of the items preventing
our recording of our plat is the sign off by the railroad as required by the conditions set forth by Mr. Kim Ogle's letter of 4/12/04.
We have been working with the UP Railroad on the final sign off since March of this year. It took 3 months to get the real estate
manager out here from Omaha, NE.
It took another month to get an informal e-mail response from him, which we copied you on and we are still waiting on a formal
response that is dependent upon the track maintenance managers inspection.

We received your letter of 9/16/04. We are still working towards complying with all of the requests of the site plan
review staff. We have not received approval for our site plan review and therefore have not submitted a final site
plan review plat for the County Clerk and Recorders office as stated in sec. 23-2-160W. The last correspondence
I received from the Weld County planning office was dated 4/12/04 and conditionally approved our site plan
review as long as we supplied some additional documentation and incorporated some of that into the final
drawings. We have submitted the site review plan twice and are looking forward to a third and final submission
soon.
Some of the items we are waiting on are not with in our control and seem to be dragging on. I am attaching a
copy of correspondence that has been ongoing with the UP railroad that illustrates what we have been
experiencing.

Good Morning Kim:
Yes, I have been meaning to write you/Weld County to object to Big R's
plans on three counts. This is of course in response to your note below
and the County's notice dated November 12, 2002.
First, a storm water detention area is proposed in the extreme south
portion of Big R's layout, and partly on Railroad property. This use of
the Railroad's property is neither allowed under Big R'S lease nor
authorized by the Railroad. And the Railroad will not approve of this use.
Secondly, the Railroad's property extends 100 feet to the east of the
centerline of its main line track. On the east side of this line, Big R
has an access road which extends south from County Road 66 to its
offices/plant. There is little room between the property line and this
road yet Big R insists on storing pipes, culverts and beams in this area
and partly on the Railroad's property. Too often this use continues to
crowd our spur track in this area which is 14 feet west of the property
line, yet storage is many times within a few feet of this track. This is a
safety concern that needs to be addressed.
Despite our numerous requests to Big R to cease this activity, they
continue to crowd our track. To alleviate this situation, the Railroad
would be interested in seeing Big R required to fence the property line to
keep them within their plan grounds. This might also help to keep
sandblasting activities at bay as well.
And thirdly, the sand blasting activity area seems to have been moved it
Big R's layout in regard to where they have sandblasted in the past. If
this activity remain and stays on the east side of its access road, I think
it might not cause any problems. However, my fear is that they will slowly
expand this area to include the area they use west of the road which will
likely cause problems or interfere with our track.
Please let me know how these items might be addressed to not cause the
Railroad any adverse impact.

Dear Mr. Ameling:
The Weld County Department of Public Health and Environment(WCDPHE)received a report concerning the
blowing of spent sandblast waste onto the railroad tracks. Big "R" Manufacturing is located 19060 Weld
County Road 66, in Weld County. In response to the report, on April 30, 2002, Bethany Salzman and I
observed the facility and spoke with you concerning the sandblast material and location of the spent sandblast
waste material.
As discussed during the site investigation, this letter is to clarify the disposition of the used and unused sand
blast material. Spent (used) sandblast material may contain heavy metals causing it to be considered a
hazardous waste. An analytical profile would verify that the waste is not a hazardous waste, and does not
require alternative disposal practices. When it has been determined that the spent sandblast material is not
a hazardous waste,then it is considered a solid waste that may be required to be disposed of at a solid waste
facility. Additionally,the material used to sandblast metal and paint maybe considered a hazardous material.
A Material Safety Data Sheet(MSDS)would show whether the sandblast material is considered a hazardous
material, requiring special handling.
Disposal of the spent sandblast waste on the ground could be considered a violation of the Regulations
Pertaining to Solid Waste Disposal Sites and Facilities(the Regulations)(6 CCR 1007-2)as promulgated by the
Solid Waste Disposal Sites and Facilities Act,Article 20, part 1, C.R.S., as amended, and Section 23-4-380 of
the Weld County Code. Depending upon the analytical results,disposal of waste materials in this fashion may
be a violation of the Colorado Hazardous Waste Regulations (6 CCR 1007-3).

Additionally, we have referred your facility to the Phil Brewer in our Air Quality Control Section. He will
review any pertinent air permits or the need for any necessary air permits for your facility. You may contact

submitted to the Weld County Department of Planning Services. Please provide provisions for the above
mentioned potential violations into the permit application for our review.
Meanwhile, measures should be taken to prevent wind blown sandblast material from leaving the property.

The existing build-up of sand blast material on the railroad tracks should be removed immediately. The
railroad company is concerned that the build up of sand blast material could cause a train to derail.
Please provide,within five(5) days, a time-line and plan of correction describing the measures you will take
to remove the sandblast material from the tracks and prevent additional blowing of the material off the

1-3 Zone District certify and state that the performance standards and district requirements that are applicable to the
development and use of property zoned 1-3 have been or shall be complied with according to the intent of Article II,
Division 3 of this Chapter. This shall be accomplished through the Site Plan Review application process. Uses listed in
Subsection D above as Uses by Special Review in the 1-3 Zone District shall be exempt from the Site Plan Review process

we have no discretion in this matter if you fail to correct this violation. You have 30(thirty)days from,May
15, 2002,to correct this zoning violation. Failure to do so will result in this office scheduling the violation

1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. Any required Emissions Permit is obtained from the Air Pollution Control
Division, Colorado Department of Health for emissions of criteria or
hazardous air pollutants.
3. No permanent disposal of wastes shall be permitted at this site.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
6. An I.S.D.S. Evaluation on any existing septic systems will be necessary,
prior to issuing the required septic permits on the existing systems.
7. Adequate toilet facilities shall be provided for the public.
8. An individual sewage disposal system, is required for the proposed
facility and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
9. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage
Disposal Regulations.
10. Any existing septic system is required to be reviewed by a Colorado

I have reviewed the application materials and have the following comments.
Traffic count information is not supplied. However, because of the industrial
nature of the site, the access drive and the access onto WCR 66 should be
designed accordingly. In order to accommodate multi unit vehicles, the access
onto WCR 66 should be 35' wide with 50' radius' and the internal access road
should be 24' wide. Those dimensions should be reflected on a site plan.
The drainage report is adequate but should be certified by a registered
professional engineer. The outlet structure should be detailed on the site
plan as well as elevations shown for the detention ponds and siphon. Water in
detention ponds usually carries silt and is very slow moving. I suspect the
siphon between the two detention ponds will have a tendency to silt up. If
possible, a straight tube should be placed between the detention ponds.

WSW Site Plan Review and Building Permit
Dear Ed:
The Greeley Planning Division has reviewed the landscape and
irrigation plans for the WSW Facility and has no concerns with the
building landscaping as approved in their contract with Alpine
Gardens. We have agreed to the following for the landscaping
adjacent to the highway:
1) WSW will plant clusters of Sabin Junipers, Goldcoast Junipers,
and Compact Pfitzers along the leased 50-foot right-of-way
between the facility and the highway.
2) The clusters of juniper shrubs will not be planted between the
building and the highway.
3) The junipers which are used to screen the storage area north of
the building will be placed on a 3-foot berm.
4) A drip irrigation system will be installed for irrigation of
the junipers.
5) The spacing of the juniper clusters will be no more than ten
feet . At planting, plants will be five gallon in size .
6) Planting of the junipers will be accomplished within 30-45
days .
After discussion with Sid Wilke, President, WSW, Inc . , the plan has
been approved and we have no problem with Certificate of Occupancy
issuance.

This is a submittal for an amended site plan review.The original was filed with the County in 1993.This
amended review is to clarify what some of the uses are on this site that we thought were understood as
part of the manufacturing and fabrication that is done here which includes, the outside storage of raw
materials,finished materials, sand blasting and painting of some of our products.
What we have included in this package is an amended site plan review application adding the outside
storage, sand blast and painting and an up to date site map of the layout of this facility. All of the other
materials requested for submittal were submitted in the original submittal of 1993 and are on file with
the County as are all the building permits for the additions to our facility that have taken place since we
began occupying this site in 1995.
We recently traded some land with Hoshiko Farms and that amended plat was filed with the county on
5/13/02.

5. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
6. Adequate toilet facilities shall be provided for the public.
7. An individual sewage disposal system, is required for the proposed
facility and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
8. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage
Disposal Regulations.
9. All pesticides, fertilizer, and other potentially hazardous chemicals must
be stored and handled in a safe manner. Reference 25-8-205.5, Colorado
Water Quality Control Act and Rules and Regulations thereof.
10. Individual Sewage Disposal System permit must be finalized and approved by
an Environmental Protection Specialist within one (1) year of the
application dated.
11. All construction activities that disturb more than five (5) acres will be
required to obtain a stormwater discharge permit form the Colorado
Department of Health, Water Quality Control Division.
12. This facility shall utilize an existing public water supply.
13. The access onto Weld county Road 66 should be 35' wide with 50' radius'
and the internal access road shall be a minimum of 24' wide. These
dimensions shall be reflected on a site plan plat.
14. The drainage report shall be certified by a registered professional
engineer and shall be submitted prior to the issuance of building permits
on the site.
15 . The outlet structure shall be detailed on the site plan plat as well as
elevations shown for the detention ponds and siphon. The site plan plat
shall be amended prior to the issuance of building permits.
16. Prior to final inspection and issuance of the Certificate of Occupancy for
the manufacturing and office facility structure, evidence shall be
submitted from the City of Greeley indicating that the requirements for
screening, landscape, and irrigation plans have been met.

INTRODUCTION
The site is part of the west half of Section 29 . T6N. . R65W. ,
containing approximately 18 . 29 acres:, It—lies to the east of the
railraod line and north of railroad sour . The southwesterly portion
is proposed for development of a manufacturing facility, consisting of
approximately 13 . 12 acres . The remainder of the site . which consists
of a narrow strip along the east side of the railroad and the farthest
east portion of the site , will be undeveloped . The strip will be used
as an access to the facility. The strip has an existing access road
on it . which will be improved with a gravel surface but will not
significantly alter the storm runoff . Therefore the strip is not
considered developed for the purposes of this report . Also , the far
east portion of the site will be undeveloped . The site is not in a
flood district .
The development of the facility is planned to be in two phases , which
are classified in this report as "Proposed" and "Future" . The
proposed development consists of one main building and the future
development consists of an additional three buildings . Calculations
were performed for both cases , and it was found that the future
condition controls the design . Therefore the drainage design used . s
for the future condition.
DRAINAGE BASIN
The site and surrounding area generally slopes toward the north-west
at approximately 0 . 5% slope . The existing drainage of the access
strip and the developed portion of the site is generally into a ditch
along the east side of the railroad , and a ditch along the south side
of the railroad spur . The east undeveloped portion drains into an
existing siphon which crosses the railroad spur , and will continue to
do so. The access strip drains into the railroad ditch and will
continue to do so . Therefore , for the purposes of this report , the
drainage basin consists only of the developed portion , which contains
approximately 13 . 12 acres .
The developed portion of the site is split into three basins . A, B ,
and C. (See Exhibit A) . Basin C consists of an area between the
proposed crane rails , extending south to the railroad spur . Design
constraints and the existing railroad spur elevations prohibit this
area from being drained into the detention pond . Therefore basin C is
drained directly off of the site , across the existing railroad spur
and into the historic drainage . This area is relatively small and
unpaved , therefore does not create a significant alteration to the
historic storm runoff . The runoff from basin C , however , is
considered to be part of the allowable 5 year historic runoff in the
design. In other words , the calculated allowable runoff was reduced
by the amount of the 100 year runoff produced by basin C .
Basin B drains toward the south west into an extension of the
detention pond , which is connected to the main detention pond by an
underground siphon below the proposed new railroad spur . The
detention pond is designed to detain runoff from basins A and B , and
release water into the existing ditch at a rate equal to the 5 year
historic runoff of basins A, B , and C less the developed 100 yr .
runoff from basin C .
DRAINAGE CRITERIA
The Rational Method has been utilized to determine peak runoff rates
and required detention pond volumes . The 5 year undeveloped historic
runoff rate was used to determine the release rate of the detention
pond , and the detention pond was sized to detain a 100 year storm
after development . The runoff coefficients used in the design are :

The rainfall intensity-duration data used in the design was taken from
Greeley Comprehensive Drainage Plan, 1974 .
CONCLUSIONS
The attached calculations show that the coefficient of runoff for the
proposed development for a 100 year storm is 0 . 33 . Based on an area
of 13 . 12 Acres and the calculated allowable discharge rate of 0 . 82
CFS , a storm water detention volume of 33 , 277 CF is required .
The storm detention is provided will be approximately 36 , 700 CF.
Discharge from the site will be through a 12" diameter pipe with a
controlled inlet , discharging into the historical drainage way at the
south west corner of the site . Overflow discharge will be provided
over a concrete spillway at elevation 100 . 50 located above the
discharge pipe .
The proposed and future drainage includes the use of a new drainage
ditch which runs along the west side of the development . Design
constraints require the slope in this ditch to be rather flat .
producing a velocity of less than 2 . 0 fps . Therefore it will be
necessary to maintain the ditch, cleaning it periodically to remove
weeds and silt that may accumulate .
The proposed siphon below the new railroad spur will also need to be
cleaned out periodically.

Dear Ed:
The Greeley Planning Division has reviewed the landscape and
irrigation plans for the WSW Facility and has no concerns with the
building landscaping as approved in their contract with Alpine
Gardens . We have agreed to the following for the landscaping
adjacent to the highway:
1) WSW will plant clusters of Sabin Junipers, Goldcoast Junipers,
and Compact Pfitzers along the leased 50-foot right-of-way
between the facility and the highway.
2) The clusters of juniper shrubs will not be planted between the
building and the highway.
3) The junipers which are used to screen the storage area north of
the building will be placed on a 3-foot berm.
4) A drip irrigation system will be installed for irrigation of
the junipers .
5) The spacing of the juniper clusters will be no more than ten
feet . At planting, plants will be five gallon in size .
6) Planting of the junipers will be accomplished within 30-45
days .
After discussion with Sid Wilke, President, WSW, Inc . , the plan has
been approved and we have no problem with Certificate of Occupancy
issuance.

Dear Ms. Adler:
Enclosed are four documents that relate to our landscaping plans at our new location. There
is a copy of our contract with Alpine Gardens, as well as their landscape drawing of the work
they will be doing around our office. They are planning on beginning the landscaping work
on Monday, March 20, 1995, with completion within two weeks.
Also included is a copy of a letter to Chuck Cunliffe at Weld County from Greg Flebbe with
the City of Greeley. The fmal document is a copy of our lease agreement with Union Pacific
Railroad. Greg Flebbe's letter to Weld County indicates the City warns 6'-8' tall pine trees
on I5'-20' centers across the front of our property. The City response to the County request
for input during our site plan review was not made promptly. On March 9, 1993, we were
led to believe that all concerns had been addressed. This was prior to the County's receipt of
Mr. Flebbe's letter.
Our lease agreement with Union Pacific Railroad was for a 50' strip of land across the front
of our property and parallel to U.S. Highway 85. This land was to be used for parking and
landscaping. I have highlighted a sentence in the lease which discusses the landscaping and
the fact that we are permitted to plant low-growing shrubs but no trees.
In order to dress up the front of our property and present as good as appearance as possible,
we would propose to plant a mixture of Sabin Junipers, Goldcoast Junipers, and Compact
Pfitzers. We would plant groups of 5 to 7 of each specie and mix them up along the front of
our property. They will grow to a maximum height of approximately 5 feet. We would plant

these trees in a row from just south of the point where a railroad spur comes off on the north
end of our property to the south end. The third page of the Union Pacific lease shows the
land that we are leasing from the railroad for landscaping and parking purposes. The shrubs
would be planted in this area. We plan to interrupt the planting for a length of approximately
200 feet directly west of our office. The landscaping around our office is expected to be
quite attractive and will feature some larger trees. We plan on installing a drip irrigation
system to ensure the health and rapid growth of the shrubs.
We hope that this landscaping plan will be acceptable to the City of Greeley. Had we been
aware of the City's wishes at an earlier date, we could have set our building back further to
the east and possibly accommodated some of those wishes. We think this will provide an
attractive and reasonable solution to the concerns of the City.

This Agreement made and entered into this

corporation (hereinafter "Lessor") , and WSW, INC. a Colorado corporation to be
addressed at P.O. Box 1290, Greeley, Colorado 80632 (hereinafter "Lessee") .
IT IS MUTUALLY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS:
Article I. PREMISES; LOCATION; USE.
A. The Lessor, for and in consideration of the rental to be paid and
the covenants and conditions to be performed by the Lessee as hereinafter
provided, does hereby lease and let unto the Lessee, for the period and subject
to the terms and conditions herein stated, that portion of the premises of the
Lessor (hereinafter "Premises") , at or near Gill, Weld County, Colorado, shown
on the plat dated March 3, 1993, marked Exhibit A, or described in the
description, or both, hereto attached and hereby made a part hereof. The
Premises leased under this agreement (hereinafter "Lease") may be used by the
Lessee for a parking lot, fence, and for landscaping purposes only (the planting
of low growing shrubs, flowers and grass, no trees) and for other purposes
incidental thereto, but shall not be used for any other purpose unless the
Lessee has received the prior written consent of the Lessor.
B. The grant of right herein made to the Lessee is subject to each
and all of the terms, provisions, conditions, limitations and covenants set
forth herein and in Exhibit B, hereto attached.
Article 2. TERM.
A. The term of this lease is for the period of one year, commencing
on the 1st day of June, 1993, unless sooner terminated as hereinafter provided.
B. Thereafter, so long as neither party is in default, this Lease
will renew itself without further documentation from year to year until
terminated as provided herein. Each renewal term will be upon the same terms
and conditions set forth herein, including, without limitation, the Lessor's
right to reevaluate the rental as provided in Article 3B below.
Article 3. RENTAL; RENTAL REEVALUATION.
A. The Lessee covenants and agrees to pay to the Lessor, as rental
for the use of the Premises during the leasehold term, or any renewal thereof,
rental of ONE THOUSAND TWO HUNDRED DOLLARS ($1,200.00) per annum payable
annually in advance for each and every year, subject to reevaluation as provided
in Paragraph B below.

B. The Lessor may annually reevaluate the rental base upon which the
above rental is computed. In the event the Lessor shall determine that the
rental paid is no longer representative of a fair market rental, the Lessor may
adjust the rental and shall advise the Lessee by written notice of such change.
Such written notice shall be served at least_ thirty (30) days prior to the
effective date of the new rental, it being understood however that rental
adjustments shall not be made more often than once every twelve (12) months.
Article 4. SPECIAL PROVISIONS.

FENCE
A. The Lessee agrees to construct and maintain at
its sole expense a fence of a design satisfactory to the Lessor
in the location shown on the plat hereto , with the understanding
that upon the expiration or termination of this Lease , howsoever,
or whenever required so to be by the Lessor in its sole discretion ,
the Lessee shall -remove the fence from the Premises at the
Lessee 's sole cost and expense , and if the Lessee fails to
remove the fence , the Lessor may perform the work and the Lessee
shall reimburse the Lessor for the cost of such removal within
thirty (30) days after bill rendered.

PARKING LOT
A. In consideration of the covenants and agreements herein
contained to be by the Lessee kept , observed and performed , the
Lessor hereby grants to the Lessee , subject to the terms and
conditions herein stated , the right to install and thereafter,
during the term hereof and any extension thereof , to maintain and
use a parking lot (hereinafter the Parking Lot) in the location
shown on the attached plat.
The Parking Lot shall be installed , maintained, repaired ,
renewed, modified and reconstructed by and at the expense of the
Lessee, and all work in connection therewith, on the Premises
shall be done under the supervision of and in accordance with
plans approved by the Lessor.
The Lessee shall notify the Lessor at least seventy-two (72)
hours in advance of the commencement of any work on the Premises
in connection with the installation, maintenance, repair, renewal ,
modification, reconstruction, relocation or removal of the Parking
Lot.
The Parking Lot shall be installed, maintained, repaired ,
renewed, used, modified, reconstructed, or removed in such manner
as to cause no interference whatsoever with the constant , contin-
uous and uninterrupted use of the tracks and other property of the
Lessor, and nothing shall be done or suffered to be done by the
Lessee that would in any way impair the safety of said tracks or
other property.
In its installation of the Parking Lot, the Lessee shall
insure that the surface thereof shall not create a stumbling
hazard and that any drainage will flow away from the tracks of the
Lessor.
B. In addition to all other covenants of indemnity
contained in this Lease, the Lessee agrees to indemnify and hold
harmless the Lessor, its officers , agents and employes , against
and from any and all liability, loss , damages , claims , demands ,
costs and expenses of whatsoever nature, including, but not
limited to, court costs and attorneys ' fees , which may result
from injury to or death of persons whomsoever or damage to or
loss or destruction of property whatsoever, including, but not
limited to, damage to the roadbed, tracks , equipment or other
property of the Lessor or property in its care or custody, when
such injury, death , loss , destruction, or damage is due to or
arises because of the existence of the Parking Lot regardless of .
any negligence on the part of the Lessor, its officers , agents
and employes , or the installation , maintenance, operation,
repair, renewal , modification, reconstruction, relocation or
removal of the Parking Lot , or any portion thereof or accessory
thereto, and the Lessee does hereby release the Lessor from all
liability for damages on account of injury to or destruction of
the Parking Lot from any cause whatsoever, regardless of any
negligence on the part of the Lessor, its officers , agents or
employes.
C. The Lessee shall , at its expense , remove the Parking
Lot or portion thereof in the event it becomes necessary due to
maintenance by the Lessor of its tracks .
Within thirty days after the termination or expiration of
this Lease howsoever, the Lessee shall , at the sole expense of the
Lessee , remove the Parking Lot from the Premises and restore to
the satisfaction of the Lessor the Premises to as good condition
as they were in at the time of the construction of the Parking
Lot ; and if the Lessee fails so to do , the Lessor may do such work
of removal and restoration at the expense of the Lessee. In the
event of the removal of the Parking Lot, as in this Section
provided, the Lessor shall in no manner be liable to the Lessee
for any damage sustained by the Lessee for or on account of such
removal , and such removal shall in no manner prejudice or impair
any right of action for damage or otherwise that the Lessor may
have against the Lessee.

Amended Site Plan Review No. 188 is submitted together with this report. The following
comments are responses to stated conditions for approval of this Site Plan Review. The
comments are hereby established in order and match the number and subtitle of the
conditions of the County.
A. "The plat shall be amended to delineate the following:"
1. A Site Plan Review map has been prepared.
2. The existing striped parking is shown. Two HC parking spaces exist.
3. Existing parking areas are as shown.
4. Parking is as shown and was approved previously.
5. Typical parking lot cross-section is shown.
6. Same as#3, existing parking is as shown.
7. The access drive and off-street parking spaces are either gravel or asphalt
as shown.
8. WCR 66 is 60' wide as shown, 30' from centerline.
9. The existing access point at WCR 66 is utilized.
10. Landscape has replaced the necessity for opaque fence and approved since
1995. (Also see#18)
11. The property is served by Northern Colorado Water District and the water
meter is adjacent to WCR 66 as shown on the map.
12. The lighting requirements are met and locations shown.
13. The parking lights are attached to the main building at locations shown.
14. The existing sign is attached to the west face of the building.
15. Trash receptacles are screened from adjacent right-of-ways and prevent
trash from scattering.
16. The landscape plan was approved in 1995 and has been maintained since
and the site is in compliance.
17. The storm water detention area was designed and approved in 1995. Big
R has an agreement with the Railroad for the portion of the detention area
that lies within the lease parcel of the Railroad right-of-way.
18. There is a 50' wide lease parcel that would conflict with fencing the
property line.
B. Notes 1-22 as listed have been added to the plat.
C. Sheriff had no concerns.
D. Applicant has drawn permit for completed addition and is awaiting comments.
E. This conflicts with items covered and approved in 1993. Please see attached
letter from City regarding Landscaping.
F. The concerns of the railroad were approved in 1993. See attached letter and
lease agreement from Railroad.
G. There are no proposed signs at this time. Any future signs will adhere to the
Weld County Code.

F. The septic system serves the office portion of the complex. The office
restrooms are used by all employees, staff, customers and visitors.

H. Discharge is reported annually. There is no discharge of storm water.
I. Vehicles are not washed on this site.
J. Applicant does not understand this requirement and seeks further explanation.

unloading at rail spurs adjacent to Big R's property. We have two railroad sidings
where we receive raw materials. Our south spur runs under a rail crane, and our
north spur is where we unload materials with forklifts. Occasionally Big R loads
large bridge structures on rail cars at its north spur.

Proposed Use;
Big R Manufacturing, LLC is a fabricator of steel girder bridges, steel truss pedestrian bridges, bridge
railing, cattle guards and miscellaneous steel fabrications associated with road/highway and drainage
construction projects. Big R also operates two roll form mills to produce galvanized steel culverts,
galvanized sheet, sheet piling, steel deck and cattle guard cap. As part of this fabrication process we
blast clean and paint some of our finished products.
In addition to our fabrication and roll forming Big R is also a distributor of finished products produced by
others such as, plastic culvert, irrigation canal head gates, highway guardrail and guard rail parts,guard
rail posts, structural plate, steel bottomless arch culverts, bolt a bin abutments, geo-textiles, steel deck
and deck forms.
Big R also maintains its'own fleet of over the road tractor trailer rigs used in the delivery of our products
to various locations throughout the western states.

The sheriffs office has no concerns with this Special Use Permit. The sheriffs office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the site plan review standards, County Code, Section 23-2-150, in the industrial zoned district. Our
comments and requirements are as follows:
COMMENTS:
The Big R Manufacturing site has been in existing for many years. The applicant is amending the Site Plan
Review to accommodate additional storage areas, sand blasting, and painting areas.
The existing access from WCR 62 is directly east of U.S. Highway 85.
Our most current average daily traffic count for WCR 66 reflects 321 vehicles taken February 2000 in a 24-
hour period. The count for U.S. Highway 85 at this intersection reflects 5,950 vehicles taken in 1995.
REQUIREMENTS:
The applicant shall utilize the existing access point to WCR 66. The applicant has posted a "no left turn" sign
for trucks at this location. The access is parallel to the Union Pacific tracks and right-of-way. Trucks are
routed to the next intersection, which is signal controlled.
The existing asphalt office parking is in place and appears to be adequate. The over flow employee parking is
gravel with adequate circulation.
The existing storm water detention areas on both sides of the rail spur appear to be operating efficiently.
The access and access lanes on site should have adequate gravel and should be graded to prevent drainage
problems.

Upon review of my computer and files, the following violation was noted (VI-0200131). The violation is in
regards to the expansion of "Big R Manufacturing" from the original recorded Site Plan Review (SPR-188);
therefore, if approved and once recorded this violation would be closed.
Throughout the Violation Process, I have been working with Phil Brewer (Air Quality Control), Department of
Public Health and Environment and Cindi Etcheverry, Department of Public Health and Environment. This case
has not yet appeared before the Board of County Commissioners.
Since an amended "SPR"application was submitted,this case was put on hold, pending the outcome. If denied
this case will be presented to the Board of County Commissioners through the Violation Hearing Process.

The letter states that the 2-1,000 gallon fuel tanks on site will be removed and replaced with 2-500 gallon tanks (one has already
been removed the other will be removed when the contents are used up).
The Above Ground Storage tank permit requirement is for tanks 660 gallons and up. Since the 500 gallon tanks do not require a

Environmental Health Services has reviewed this proposal for an existing Steel & Bridge
Fabrication/Manufacturing Facility. We have no objections to the proposal, however, we
do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. If applicable, the applicant shall apply for an Underground Injection Control (UIC)
Class V Injection Well permit, for the maintenance shop, through the
Environmental Protection Agency (EPA) or provide evidence that the applicant is
not subject to the EPA Class V requirements.
2. The applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and
Emissions Permit application to the Air Pollution Control Division, Colorado
Department of Health and Environment for emissions of criteria, hazardous or
odorous air pollutants.
3. Submit a dust abatement plan to the Environmental Health Services, Weld
County Department of Public Health & Environment, for approval prior to
operation. This plan shall include the measures to be taken to prevent sandblast
material from blowing off of the property.
4. The Environmental Health Services Division was unable to locate a septic permit
for the septic system serving the maintenance shop. The septic system shall be
reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
5. The applicant shall ensure that the Above Ground Storage Tanks meet the
requirements of Regulations (7 CCR 1101-14) in regards to the construction of
the spillage retention berm around the tank battery. The volume retained by the
spillage berm should be greater than the volume of the largest tank inside the
berm. Alternative protective measures may be allowed provided they comply
with the Above Ground Storage Tank Regulations.
6. If applicable, the applicant shall obtain a stormwater discharge permit from the
Water Quality Control Division of the Colorado Department of Public Health and
Environment.
7. In the event the washing of vehicle(s) will occur on site, the applicant shall
ensure that any vehicle washing area(s) shall capture all effluent and prevent
discharges from the washing of vehicles in accordance with the Weld County
Code, the Rules and Regulations of the Water Quality Control Commission, and
the Environmental Protection Agency.
8. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled and stored and disposed of in a manner that
controls fugitive dust, blowing debris and other nuisance conditions.

4. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Weld County Code, the
Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
5. Fugitive dust shall be controlled and confined on this site. The facility shall be
operated in accordance with the approved dust abatement plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. The facility shall utilize the existing public water supply.
8. The applicant shall remove and handle, sandblast materials in a manner that will
protect public health and the environment.
9. All potentially hazardous chemicals, materials and waste must be stored and
handled in a safe manner in accordance with product labeling.
10.The applicant shall operate in accordance with the approved "waste handling
plan".
11.Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
12.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
13.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
14.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.

This letter is in response to a phone call that I received from Mr. Duane Ameling, Plant Manager
for WSW, Inc. concerning the letter that was sent by the City of Greeley, dated December 11,
2002, to Weld County Planning in response to the amended site plan submitted by WSW, Inc.
When the amended site plan was sent to the City of Greeley for review, the City of Greeley was
under the impression that there was an expansion of the building and use on the subject site.
After discussing the issue with Mr. Ameling, the City of Greeley was informed that an expansion
was not the case, but in fact, the amended site plan was to clarify what was approved in 1993. In
1993 and 1995 letters from the City of Greeley were sent as part of the referral stating what was
acceptable for landscaping. The City of Greeley does not have any concerns with the amended
site plan as long as the landscaping was installed as proposed by WSW, Inc in 1995.

Thank you for the opportunity to comment on this amended site plan review for WSW, Inc. The City of
Greeley has reviewed the application and has the following comments:
1. The outdoor storage of all materials should be screened from view of the public right-of-way.
Screening could be accomplished through the use of a solid fence or wall of sufficient height to
fully screen all of the stored materials, or through the use of landscaping which provides year-
round screening, or berming, or through a combination of fencing, walls and landscaping.
2. Outdoor storage shall not be permitted within any setback, public right-of-way, or in landscaped
areas.
3. Items not customarily used or stored outside or made of material that is resistant to damage or
deterioration from exposure to the outside environment shall not be placed, stored, or maintained
outside for a period in excess of twenty-four (24) hours.
4. No parking shall occur on unpaved surfaces or open spaces or landscaped areas.

Good Morning Kim:
Yes, I have been meaning to write you/Weld County to object to Big R's
plans on three counts. This is of course in response to your note below
and the County's notice dated November 12, 2002.
First, a storm water detention area is proposed in the extreme south
portion of Big R's layout, and partly on Railroad property. This use of
the Railroad's property is neither allowed under Big R'S lease nor
authorized by the Railroad. And the Railroad will not approve of this use.
Secondly, the Railroad's property extends 100 feet to the east of the
centerline of its main line track. On the east side of this line, Big R
has an access road which extends south from County Road 66 to its
offices/plant. There is little room between the property line and this
road yet Big R insists on storing pipes, culverts and beams in this area
and partly on the Railroad's property. Too often this use continues to
crowd our spur track in this area which is 14 feet west of the property
line, yet storage is many times within a few feet of this track. This is a
safety concern that needs to be addressed.
✓Despite our numerous requests to Big R to cease this activity, they
continue to crowd our track. To alleviate this situation, the Railroad
would be interested in seeing Big R required to fence the property line to
keep them within their plan grounds. This might also help to keep
sandblasting activities at bay as well.
✓And thirdly, the sand blasting activity area seems to have been moved it
Big R's layout in regard to where they have sandblasted in the past. If
this activity remain and stays on the east side of its access road, I think
it might not cause any problems. However, my fear is that they will slowly
expand this area to include the area they use west of the road which will
likely cause problems or interfere with our track.
Please let me know how these items might be addressed to not cause the
Railroad any adverse impact.
