ZONE DISTRICT -VIRTUS AND AMY BANOWETZ
A public hearing was conducted on May 8, 2002, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 19, 2002, and duly published April 24, 2002,
in the Tri-Town Farmer and Miner and the Greeley Tribune, a public hearing was conducted to
consider the request of Virtus and Amy Banowetz for a Site Specific Development Plan and Use
by Special Review Permit #1374 for a use permitted as a Use by Right, an Accessory Use, or a
Use by Special Review in the Commercial or Industrial Zone Districts(septic/cement contractor and
storage building) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney,
made this a matter of record. Chair Vaad advised Virtus Banowetz, applicant, that he has the
option of continuing this matter to a date when the full board will be present. However, if he
decides to proceed today, it will require three affirmative votes, or in the case of a tie vote,
Commissioner Masden will listen to the record and make the determining vote. Mr. Banowetz
indicated he would like to proceed today.
Carla Angeli, Department of Planning Services, presented a brief summary of the proposal and
entered the favorable recommendation of the Planning Commission into the record as written. Ms.
Angeli stated the site is located on Lot A of Recorded Exemption #2358, which is 10 acres in size.
She gave a brief description of the location of the site and surrounding uses. Ms. Angeli stated the
applicant contracts to do concrete work and install septic systems, and the proposed building will
be used to store equipment and supplies. i here will be no outdoor storage on the site. She stated
four referral agencies responded with no conflict to their interests, three agencies did not respond,
four responded favorably with proposed conditions, and no correspondence has been received
from surrounding property owners. Ms. Angell stated there is an existing septic system and
domestic water is provided by the Central Weld County Water District.

In response to Commissioner Geile, Virtus Banowetz, applicant, stated the electric pole is a wood
pole. Commissioner Geile commented he wanted to ensure this was not a large transmission line.
No public testimony was offered concerning this matter. In response to Chair Vaad, Mr. Banowetz
stated he has reviewed and agrees with the Conditions of Approval and Development Standards
as proposed. Commissioner Jerke commented he is pleased that the site is accessed from Weld
County Road 50 rather than Weld County Road 49, which has more traffic.
Commissioner Long moved to approve the request of Virtus and Amy Banowetz for a Site Specific
Development Plan and Use by Special Review Permit#1374 for a use permitted as a Use by Right,
an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts
(septic/cement contract and storage building) in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Jerke, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:15 a.m.
This Certification was approved on the 13th day of May 2002.
