RE: ACTION OF THE BOARD CONCERNING ABATEMENT OF DANGEROUS BUILDING
-STANLEY HILLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Department of Building Inspection informed the Board that Stanley
Hiller has a building on his property which is considered to be dangerous to persons under
Section 302 of the 1997 Uniform Code for the Abatement of Dangerous Buildings, as adopted
by Chapter 29 of the Weld County Code, and
WHEREAS, said property is described as 13539 Weld County Road 4, Brighton,
Colorado, 80601; being further described as part of the S1/2 of Section 29, Township 1 North,
Range 66 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, after hearing all of the testimony and statements of those present and the
recommendation of staff, the Board deemed it advisable to authorize the Department of
Buildings and Grounds to secure the building by installing weather resistant plywood to all
windows and door openings, and that the final costs of such abatement work become a lien on
the subject real property, pursuant to Section 29-2-60.M of the Weld County Code (adding
Section 801.2.1 to the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition).
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Department of Buildings and Grounds to secure the building
by installing weather resistant plywood to all windows and door openings, and that the final
costs of such abatement work become a lien on the subject real property, pursuant to
Section 29-2-60.M of the Weld County Code (adding Section 801.2.1 to the Uniform Code for
the Abatement of Dangerous Buildings, 1997 Edition).

Subject: Authorization to Abate a Dangerous Building
The building located at the above cited address was determined to be a dangerous building as
defined by Section 302 of the 1997 Uniform Code for the Abatement of Dangerous Buildings as
adopted by Chapter 29 of the Weld County Code. A Notice and Order to cause the building to
be vacated and secured against entry was posted on the building on November 2, 2001. A
copy of this Notice and Order was sent to the owner, Mr. Stanley Hiller, by Certified Mail on
November 2, 2001. An attempt to deliver the Certified Letter was made on November 9, 2001,
December 6, 2001 and December 11, 2001. The Certified Letter was returned to the
Department of Planning Services marked "Unclaimed" on December 27, 2001. The Weld
County Sheriffs Office attempted to personally serve Mr. Hiller on at least six occasions without
success. A copy of the Notice and Order was also sent by regular mail.
An inspection of the property on November 2, 2001 showed that the property was vacated,
however the property was not secured against entry as required by the Notice and Order.
Subsequent drive by inspections confirm that the building remains vacant but unsecured.
Although the Notice and Order required that the building be demolished, it is my
recommendation that the Board of County Commissioners authorize Weld County employees to
secure this building by installing weather resistant plywood to all windows and door openings.
Since the building is vacant, it will not pose a danger to the public as long as it is secured
against entry. Steve Boeck estimated that it would take two employees from Buildings and
Grounds one day to secure the building at an estimated cost of$500.00. The necessary
materials will cost approximately $200.00 and the labor is estimated to cost $300.00.
I request that the Board of County Commissioners authorize the expenditure of up to $500.00
to complete the abatement of this building by securing it against entry.

Dear Mr. Hiller.
This letter is to inform you that an inspection of the residence located at 13539 WCR 4 was conducted on
September 4,2001 and also on October 11,2001. Due to the conditions that appear below,I have determined
that the property at 13539 WCR 4 is a dangerous building as defined by Section 302 of the 1997 Uniform Code
for the Abatement of Dangerous Buildings as adopted by Chapter 29 of the Weld County code;
1.Faulty electrical wiring
2.Substandard plumbing
3.Failing septic system
Based upon the above items I have determined that this residence is a dangerous building and that it must be
abated. You are hereby ordered to take the following steps necessary to abate this residence by the dates that
appear below.
1. This building must be vacated,secured and maintained against entry. The building must be secured in such
a manner that prevents entry by unauthorized personnel. Vacation shall be completed and the building secured
by November 15,2001.
2. It is further ordered that this building be demolished. Prior to demolishing the building,a demolition permit
shall be required. The demolition permit Shall be obtained by January 2, 2002. The building shall be
demolished and a final inspection of the property approved within 180 days of the demolition permit issuance.
Be advised that an inspection for the presence of asbestos may be required by the State of Colorado.
This building has been posted with a notice prohibiting entry, This notice was issued due to the following
conditions: faulty electrical wiring; substandard plumbing; failing septic system. The above conditions are
considered dangerous and therefore the building must be abated.
Failure to comply with this order may result in the abatement work being performed underthe direction of Weld
County and the costs thereof charged to you as the owner of the property.
You,or any person having any record title or legal interest in this building,may appeal this action to the Weld
County Building Code Board of Appeals provided the appeal is made in writing,as provided in Chapter 5 of the

Uniform Code of the Abatement of Dangerous Buildings, as adopted by reference in Chapter 29 of the Weld
County Code. Such notice shall be filed in our office within 30 days from the date that this notice is served to
you, either personally or by certified mail. Failure to appeal will constitute a waiver of all rights to an
administrative hearing and determination of this matter.

Subject: Hiller
On November 2, 2001, I posted the property with a "Do not occupy" sign and with a
letter that was written that same day. That letter was also sent through regular mail, because
Mr. Hiller will not pick up certified mail. That certified letter came back to our office marked
unclaimed on December 28,2001. In the past Mr. Hiller has responded to all letters that were
sent through regular mail and has left all certified letters unclaimed. The letters that are posted
on the door are also not taken off.
