RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST OKEY DOKE FARMS c/o JAMES DOKE FOR VIOLATION
OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Okey Doke Farms do James Doke, VI #0200043, is allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on June 4, 2002, a public hearing was held before the Board of County
Commissioners for the purpose of hearing testimony relating to said violation, at which time the
matter was continued to July 9, 2002 to allow adequate time for the property owner to screen or
remove the noncommercial junkyard and remove or obtain Building and Zoning Permits for the
six mobile homes stored on the property. On July 9, 2002, a public hearing was again held
before the Board of County Commissioners, at which time the matter was continued to August
13, 2002, to allow adequate time for staff and the County Attorney to meet with the property
owner and discuss the items that still needed to be completed.
WHEREAS, on the 13th day of August, 2002, a public hearing was again held before
the Board of County Commissioners for the purpose of hearing testimony relating to said
violation, and
WHEREAS, Okey Doke Farms c/o James Doke, was not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until November 13, 2002, to allow adequate time for the property
owner to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0200043 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Okey Doke Farms do James Doke, to remedy the

violation of the Weld County Code, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until November 13,
2002, to allow adequate time for the property owner to bring the subject property into
compliance.
BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County,
Colorado, that a receipt will be required to show possession of the mobile homes after they are
removed from the Doke's property.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 13th day of August, A.D., 2002.

Currently, there is a violation of Chapter 23, Article III (3) , Division 1 of
Sections 23-3-20, 23-3-20.P, 23-3-30 and 23-3-30.I, Chapter 23, Article IV(4) ,
Division 3 of Section 23-4-140 and Chapter 29, Article VII (7) of Section 29-7-10
of the Weld County Code. To bring the property into compliance the property
owner shall remove or completely screen the Noncommercial Junkyard from all
adjacent properties and public rights-of way. Additionally, a Building Permit
and Zoning Permit for a Mobile Home shall be obtained for the 6 (six) mobile
homes currently stored on the property.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

Dear Mr. Doke:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting with
the Board of County Commissioners on June 4, 2002, at 10:00 a.m.,to consider the violations occurring on the
property. The above mentioned property is in violation of the following Section(s) of the Weld County Code:
Chapter 23,Article Ill, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-20.P "Mobile home subject to the additional requirements of Article IV,Division 3 of this Chapter."
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
Chapter 23,Article IV, Div 3 "Mobile Homes"
-No mobile home maybe located or relocated in the County after August 25, 1981,except in accordance with this
Division,including the issuance of any zoning permit which may be required by this Section. Each mobile home
located or relocated in the County after said date must have a building permit for a mobile home issued pursuant
to Chapter 29 of this Code....
Section 23-4-140 "Mobile homes permitted in the A Zone District"
Chapter 29,Article VII "Mobile, Manufactured or Factory-Built Home Permits"
Section 29-7-10 "Permit required."
-No mobile, manufactured or factory-built home, as defined in this Building Code, may be located or relocated
within the County without a building permit issued by the Building Official.
To bring the property into compliance the following option(s) are available:
The"Noncommercial junkyard"consisting of derelict vehicles,wood,pallets,barrels and miscellaneous debris shall
be removed or screened from all adjacent property owners and public rights-of-way. Any semi trailers shall have
current license plates (tags) or they shall be removed. Additionally, our records indicate that we have not yet
received the required Weld County applications for mobile homes that are already located on the property. In order
to have a mobile home, a Zoning and a Building permit must be approved. Derelict Mobile Homes are not an
allowed use in Weld County.
DERELICT MANUFACTURED(MOBILE)HOME: A MANUFACTURED(MOBILE) HOME that is partially or totally
damaged by fire,earthquake,wind or other natural causes,or is in a state of general dilapidation,deterioration or
decay resulting from improper lack of maintenance, vandalism or infestation with vermin or rodents. Any such
DERELICT MANUFACTURED (MOBILE) HOME shall be returned to and maintained in the condition as originally
established on site and as inspected by the Building Inspection Department,or it shall be removed from site.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might nave about the violations.

or as soon as possible to the above mentioned Violation Hearing date:
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
