The Weld County Public Works Department has reviewed this proposal;this piojje t fal fr marily
under the purview of the Use by Special Review Standards,Weld County Code, Chapter 23,Article
II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
Access: The existing access to the facility is from US Highway 85 in Laramie County, Wyoming.
The access is a shared access with an existing bar and residence. The access is shown through
the parking lot or a through an emergency service road. The access is dimensioned at a 40-foot
wide gravel driveway with four inches of gravel base.
REQUIREMENTS:
Off-Street Parking: The location of the off-street parking area shall be defined on the plat
indicating the parking spaces and the circulation pattern.
Off-street parking spaces including the access drive shall be surfaced with gravel or an equivalent
and shall be graded to prevent drainage problems.
Each space should be equipped with wheel guards or curb blocks where necessary to prevent
vehicles from extending beyond the boundaries of the 'spaces and from coming into contact with
other vehicles, walls, fences, or landscaping.
The parking lots shall conform to all standards of the American with Disability Act.
Refer to Section 23-4-10, Article 4 of the County Code for Off-Street Parking requirements.
Legal Access: The applicant shall indicate on the plat or by legal document the type of right-of-
way/easement or deed to provide adequate access to the parcel.
Storm Water Drainage: A storm water drainage report shall be submitted to the Weld County
Public Works Department for review and approval prior to recording the plat. This report shall be
prepared by a registered professional engineer licensed in the States of Colorado or Wyoming.
This report shall be prepared, certified, and signed by such engineer. Refer to Section 24-7-120
of the Weld County Code for any additional storm water requirements.

SUBJECT: AMUSR-1096 Sharon Parrill
Environmental Health Services has reviewed this proposal for a restaurant/tavern. We have no objections to
the proposal, however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. The facility shall provide evidence that it has demonstrated compliance with the requirements of the
Colorado Primary Drinking Water Regulations, 25-1-107(x), C.R.S. Evidence shall be provided to
the Weld County Department of Public Health and Environment and the Department of Planning
Services that indicates the system complies with the Regulations.
2. The Weld County Department of Public Health and Environment has reviewed the submitted Design
Report and found that the existing septic system does not appear to be adequate for the proposed
hydrologic load. The facility shall provide evidence from the Cheyenne/Laramie City and County
Health Department that the septic system complies with all applicable rules. The review shall consist
of observation of the system and a technical review describing the systems ability to handle the
proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division
of the Weld County Department of Public Health and Environment. In the event the system is found to
be inadequately sized or constructed the system shall be brought into compliance with current
Wyoming Regulations.
We recommend that the following requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those
wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended.

3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing

debris, and other potential nuisance conditions.
4. This facility shall adhere to the maximum permissible noise levels allowed in the (Commercial) Zone
as delineated in 25-12-103 C.R.S., as amended.
5. Adequate hand washing and toilet facilities shall be provided for employees and the public.
6. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations, 25-4-
1601 C.R.S. governing the regulation of retail food service establishments.
7. Fugitive dust shall be controlled on this site.
8. Any sewage disposal system shall comply with all applicable rules and regulations.
9. The existing water well(s) shall comply with the State of Wyoming, Office of the State Engineer(OSE)
and the Wyoming Ground Water Regulations. Before operation of the proposed restaurant, written
evidence from the Wyoming, OSE that an Enlargement Permit (modification) has been granted to
accommodate the proposed 100 x 100 building shall be provided to the Weld County Department of
Public Health and Environment and the Department of Planning Services.
10. The water system shall comply with the requirements of the Colorado Primary Drinking Water
Regulations, 25-1-107 (x) C.R.S.

in the C-2 (General Commercial) Zone District (restaurant/tavern) in the A (Agricultural) Zone

1. A building permit shall be obtained prior to any addition and/or remodeling work or for the
construction of the proposed 100' by 100' building.
2. A plan review is required for each permit. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for the
permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
4. All buildings and addition/remodels will require an engineered foundation based on a site-
specific geotechnical report or an open hole inspection performed by a Colorado registered
engineer. Engineered foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

Subject: AMUSR-1096,Applicant Sharon Parrill
This proposal is for a liquor store in the northen most portion of the county. This
establishment is not operated properly and could cause a substantial use of resources through call
response by the Weld County Sheriffs Office. It is recommended that prior to design of the
building that the Sheriffs Office through it's community resource officers work with the owner of
the business to harden the business against crime. This could be achieved through environmental
design, alarm systems, and training of the personnel operating the business. Additionally, the
law enforcement agency and the neighboring state of Wyoming should be contacted to ascertain
their availability for response due to the proximity of Cheyenne, Wyoming. I have no other input
regarding this USR.

The Division of Environmental Health has reviewed and accepted the Small Wastewater System Design Report
for the State Line Dance Club, Sandwich Shop and Lottery Outlet.
The original small wastewater system for this property was designed and installed for a full service restaurant
serving 100 meals a day with thirteen(13)employees,thus generating a maximum daily flow of 1950 gallons
(engineering report)or 1690 gallons under State of Wyoming Rules.
The new design report for the Change of Use on this property includes a dance club for 100 persons, sandwich
shop with paper service, serving 50 meals per day and ten employees, thus generating a maximum daily flow of
1800 gallons(engineering report)or 1600 gallons under State of Wyoming Rules.
The small wastewater system for this property also included the installation of a 1000 gallon grease trap installed
ahead of the septic tank to prevent grease from entering the small wastewater system, which is required for food
service operations.
The Division also made an on-site evaluation of this property and small wastewater system on February 21,2002
and saw no evidence of failure or non-compliance with any federal, state or local rules or regulations in regards to
that small wastewater system.
The change of use,as described by the property owner and a Wyoming Licensed Engineer, on this property is
approved in reference to the existing small wastewater system.

SEPTIC SYSTEM ANALYSIS
EXISTING STATE LINE FACILITY

As shown on the attached Septic System Design Report (WY Permit No. 95-
175) dated May, 1994, the existing system was designed for peak day septic tank
storage of 2,900 gallons with max day leach field treatment of 1,950 gallons. Since
the original design the use of the area has changed, as no full service restaurant was
constructed. Under the current proposal a 300 seat capacity dance club would be
added to the existing lotto sales, gift/sandwich shop. Maximum day use for the
combined facility is as follows:
Employees 10 x 50 gal/day = 500 gal
Dance Club 300 people x 3 gal/person = 900 gal
Sandwich Shop (paper service) 50 meals x 8 gal/meal = 400 gal
Total 1,800 gal/day xis: a,hy0%oC,
The existing system was designed for 1 ,950 gallons/day; therefore, should
function properly with the proposed Dance Club addition.
