RE: ACTION OF THE BOARD CONCERNING BAN OF OPEN FIRES WITHIN
UNINCORPORATED AREAS OF WELD COUNTY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 30-15-401(1)(n.5), C.R.S., the Board has the authority
to ban open fires to a degree, and in any manner it deems necessary, to reduce the danger of
wildfires within those portions of the unincorporated areas of the County where the danger of
forest or grass fires is found to be high, based upon competent evidence, and
WHEREAS, Ed Jordan, Weld County Sheriff, recommends that the Board adopt this
Resolution, for the purpose of banning open fires in the unincorporated areas of Weld County.
WHEREAS, pursuant to the Weld County Home Rule Charter, Article 3, Section 3-13,
the concurrence of three of the members of the Board is required to approve a Resolution, and
WHEREAS, the motion to approve a Resolution banning open fires within
unincorporated area of Weld County received only one vote and therefore failed; and the effect
of the failure to obtain a majority vote is a denial of the motion.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 29th day of April, A.D., 2002.
