HomeMy WebLinkAbout20020854.tiff HEARING CERTIFICATION DOCKET NO. 2002-25 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1368 FOR A BOARDING KENNEL FOR 50 DOGS (INCLUDES BOARDING, TRAINING, SPECIAL EVENTS AND TWO DWELLING UNITS, MOBILE HOMES) IN THE A(AGRICULTURAL) ZONE DISTRICT - PHILIP AND PATRICIA HIDDESSEN A public hearing was conducted on April 3, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David D. Long, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 15,2002,and duly published March 20,2002, in the Tri-Town Farmer and Miner and the Greeley Tribune, a public hearing was conducted to consider the request of Philip and Patricia Hiddessen for a Site Specific Development Plan and Use by Special Review Permit#1368 for a Boarding Kennel for 50 dogs (includes boarding, training, special events, and two dwelling units, mobile homes) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light gave a brief description of the site, which is 73 acres, and she reviewed the proposed uses as indicated in the application materials. She stated there are currently two mobile homes which were permitted in 1986, all of the existing structures are located on the northwest portion of the site so no prime land will be removed from production, and the site will be accessed by an existing recorded access easement. She further stated ten referral agencies reviewed this proposal, four indicated no conflict,four responded with comments which have been addressed by the Conditions of Approval and Development Standards, and two agencies did not respond. Ms. Light stated the applicant plans to insulate the kennel to help prevent noise, and they will hold six special events per year. Any additional events will require approval of a Temporary Assembly Permit from the Weld County Board of Commissioners. She stated the kennel is the only additional structure proposed, and the neighbor to the north expressed concern with setbacks. Responding to Commissioner Geile, Ms. Light stated the applicant anticipates 20 to 30 dogs and their owners will attend the special events. In response to Commissioner Jerke, Ms. Light stated the property is under contract, and the sale is contingent upon approval of this request. Responding to Chair Vaad, Ms. Light stated administrative approval of a Flood Hazard Permit is required prior to construction of the kennel,and the standards will likely be less stringent since the structure is not a residence. Responding to Commissioner Masden, Char Davis, Department of Public Health and Environment, stated 2002-0854 dr • Az /72 Az-t) PL1593 HEARING CERTIFICATION - PHILIP AND PATRICIA HIDDESSEN (USR#1368) PAGE 2 Development Standard #4 is a normal requirement to ensure the waste is removed from the site in a sanitary manner. She further stated there are two existing septic systems for the homes which will be resided in by the owner and an employee. Ms. Davis stated Condition of Approval #2.C is necessary because the septic system serving the employee home and other existing buildings used by visitors will provide for more of a commercial use. In response to Commissioner Masden, Patricia Hiddessen, applicant,stated the special events will be competitions for work-type dogs. She stated she will continue to use the existing feedlot pens with some slight modifications. She further stated they will continue raising alfalfa, sheep, and ducks. Ms. Hiddessen stated she and her husband are trying to continue the lost art of moving stock animals with dogs, and added they will be bringing their sheep from Arizona and purchasing cattle here in Colorado. In response to Commissioner Geile, Ms. Hiddessen stated upon approval of this request, they will close on the property on April 29, 2002. In response to Commissioner Long, Ms. Hiddessen stated she shows her dogs and only breeds once every third year to generate new show dogs. No public testimony was offered concerning this matter. In response to Chair Vaad, Ms. Hiddessen stated she has reviewed and agrees with the Conditions of Approval and Development Standards. Commissioner Long moved to approve the request of Philip and Patricia Hiddessen for a Site Specific Development Plan and Use by Special Review Permit#1368 for a Boarding Kennel for 50 dogs (includes boarding, training, special events, and two dwelling units, mobile homes) in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Jerke, and it carried unanimously. There being no further discussion, the hearing was completed at 10:50 a.m. This Certification was approved on the 8th day of April 2002.
