Dear Ms. Lockman:
We have reviewed the above referenced proposal to subdivide a 161.34 acre parcel described as
Lot C of the Recorded Exemption No. 2637 located in the SW1/4 of Section 9, Township 6 North, Range
66 West of the 6th Principal Meridian, into 8 (PUD) single family residential lots of approximately 1-acre in
size, 27 acres of open space and an agricultural lot approximately 124 acres in size. A 5-acre building site
is proposed to be provided of the agricultural lot. The North Weld County Water District (District) has been
proposed as the source of water for the household use of the residential lots and a copy of the agreement
between the developer and the District was included in the submitted material. The Water Supply
Information Summary Sheet was also included, indicates that according to the contract agreement
between landowner and the District, 70% of an acre-foot or 228,000 gallons per year per lot will be
supplied for the household use (0.69 acre-feet per year per lot).
Additional information provided indicates that approximately 30 acres of open space will be
irrigated using 20 shares of Woods Lake Mutual. Each share will produce on an average between 1.5 and
2.5 acre-feet of water per year. The Homeowner Association will own and distribute these shares of water
for common open space.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers the opinion that
with the District as a water supplier for residential lots, the proposed water supply can be provided without
causing material injury to existing water rights and the supply is expected to be adequate.

The Weld County Health Department has reviewed this proposal. The applicant proposes a 9
lot minor subdivision on 161.34 acres. The minimum lot size is 1.0 acre with an overall density
of one septic system per 17.9 acres.
The application has satisfied Chapter 27 of the Weld County Code in regard to water and sewer
service. The application states the water will be supplied by North Weld Water District. A
water service agreement from North Weld Water District has been included in the application
materials. Sewer will be provided by individual sewage disposal systems. The minimum
proposed lot size (1.0 acre) coupled with the overall density of one septic system per 17.9 acres
does meet current Department policy.
Primary and secondary envelopes have been placed on the plat map submitted in the Change
of Zone application and are adequate. No documentation has been included in the application
materials that indicates whether language for the preservation and/or protection of the second
absorption field envelope has be placed in the development covenants (no covenants were
included in the application materials).
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the North Weld County Water District.
2. This subdivision is in rural Weld County and is not served by a municipal sanitary
sewer system. Sewage disposal shall be by septic systems designed in accordance
with the regulations of the Colorado Department of Public Health and Environment,
Water Quality Control Division and the Weld County Code in effect at the time of
construction, repair, replacement, or modification of the system.
3. Language for the preservation and/or protection of the absorption field envelopes
shall be placed in the development covenants. The covenants shall state that
activities such as permanent landscaping, structures, dirt mounds or other items are
expressly prohibited in the absorption field site.
4. If required, the applicant shall obtain a storm water discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and the
Environment. Silt fences shall be maintained on the down gradient portion of the site
during all parts of the construction phase of the project.

5. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance conditions,at
the request of the Weld County Health Department,a fugitive dust control plan must
be submitted.
6. In accordance with the Regulations of the Colorado Air Quality Control Commission
any development that disturbs more than 5 acres of land must incorporate all
available and practical methods which are technologically feasible and economically
reasonable in order to minimize dust emissions.
7. If land development creates more than a 25 acre contiguous disturbance,or exceeds
6 months induration,the responsible party shall prepare a fugitive dust control plan,
submit an air pollution emissions notice, and apply for a permit from the Colorado
Department of Public Health and Environment.
8. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County
Code shall be placed on any recorded plat.

The Weld County Public Works Department has reviewed this change of zone request.
Comments made during this phase of the subdivision process may not be all-inclusive, as other
concerns or issues may arise during the remaining application process.
COMMENTS:
❑ The change of zone plan sheets shall be renumbered in successive order with sheet total
given.
❑ The applicant shall address the 5-acre building envelope of Lot 9, specifying building
location and roadway access. This will be shown on the change of zone plat.
External Roadways:
o WCR 70 is classified by the County as a local road and requires a 60-foot right-of-way.
This right-of-way shall be shown on the final plat. The existing 60-foot right-of-way
shall be verified by the applicant and the documents creating the right-of-way noted on
the final plat. If the right-of-way cannot be verified, it will be dedicated on the final plat.
❑ WCR 70 serving this development is a gravel road. This development will introduce
approximately 80 additional vehicle trips per day to the roadway system, which doubles
the traffic count. This count approaches the 200 vehicles per day County limit, whereby
dust abatement measures are enforced.
o The applicant will be required to enter into an agreement with the County to
proportionately share the cost of improving WCR 70 from the western most access road,
easterly to paved WCR 31. The cost will be based on a proportion of the traffic
generated by the development to the existing traffic. This agreement shall be submitted
with the final plat materials.
o The 5-acre building envelop for Lot 9 would require a second access onto WCR 70. The
applicant shall justify the need for the second access and show its proposed location on
the change of zone plat. The Lot 9 will have only one access, thereby combining the
building and agricultural services.

o Additional right-of-way shall be required adjacent to the bus pullout area equivalent to
the width of the pullout lane. The right-of-way will be dedicated on the final plat.
Internal Roadways:
❑ The Public Works Department has deliberated on the paving requirements for this PUD.
This development is requesting a PUD status, one mile from SH 392, and in proximity to
several rural subdivisions, which have paved internal roadways. In conclusion, the
Public Works Department recommends that this PUD internal roadway be paved.
❑ Internal roads shall meet Weld County criteria for a PUD. The internal roadway right-of-
way shall be 60-feet in width including cul-de-sacs with a 65-foot radius, and dedicated
to the public. The typical roadway section of interior roadway shall be shown as two 12-
foot paved lanes with 4-foot gravel shoulders on the change of zone plat. The cul-de-sac
edge of pavement radius shall be 50-feet. Stop signs and street name signs will be
required at all intersections.
❑ Intersection sight distance triangles at the development entrance will be required. All
landscaping within the triangles must be less than 3%z feet in height at maturity, and noted
on the Landscape Plan. The bus shelter and mailbox kiosk must be place outside the
intersection sight distance triangles.
❑ The interior roadway typical cross-section shown on Sheet 5 (Street Plan and Profile) is
acceptable. The typical roadway cross-section shown on Sheet 2 (Rezoning Plat) must be
corrected to match that on Sheet 5.
o The Pavement Section on Sheet 5 shall show the required asphalt depth.
❑ The applicant shall provide a pavement design prepared by a professional engineer along
with the final plat submittal.
❑ Roadway and grading plans along with construction details will be required for the final
plat.
❑ Easements shall be shown in accordance with County standards and / or Utility Board
recommendations, also dimensioned on the final plat.
Drainage:
❑ A final drainage report stamped, signed and dated by a professional engineer licensed in
the State of Colorado shall be submitted with the final plat application. The 5-year storm
and 100-year storm drainage studies shall take into consideration off-site flows both
entering and leaving the development.
o The final drainage report shall document and review FEMA maps to determine if flood
hazards exist.
❑ The June 2002, report states increased runoff due to development is minimal and
detention will not be required. Calculations verifying this will be required with the final
drainage report.
o The June 2002, report fails to incorporate the entire development, expressly Lot 9, in the
drainage analysis. The final drainage report shall include the entire PUD.

o The June 2002, report states in conclusions and recommendations that an adequately
sized culvert is to be placed at the intersection of the interior roadway and WCR 70. The
final drainage report shall show detailed calculations sizing this culvert. The plat shows a
24-inch culvert just upstream of the proposed location.
o The June 2002, report fails to correlate any of the abundant numerical data in Appendix I
to the conclusions and recommendations. The final report shall tie the calculated data to
the discussion, conclusions and recommendations.
o Final drainage construction plans, conforming to the drainage report, shall be submitted
with the final plat application.
❑ The applicant shall show and name all irrigation systems in the development on the final
plat, including ditch easements. Any increased drainage into an irrigation system shall be
corroborated with the appropriate owner. The applicant shall provide a confirmation
letter from the ditch owner addressing these issues along with the final plat application.
RECOMMENDATION:
The Public Works Department recommends approval of this change of zone. The following
Conditions of Approval shall be fulfilled prior to change of zone acceptance.
Conditions of Approval:
1. The change of zone plan sheets shall be renumbered in successive order with sheet total
given.
2. The applicant shall address the 5-acre building envelope of Lot 9,justify a second access
requirement, and show the building location along with the roadway access. This will be
shown on the change of zone plat.

of interior roadway shall be shown as two 12-foot paved lanes with 4-foot gravel
shoulders on the change of zone plat.
The applicant shall address the comments listed above at the specific step of the review
process stated. The review process will continue only when all appropriate elements have
been submitted. Any issues of concern must be resolved with the Public Works
Department prior to recording the change of zone and final plats.

The Department of Planning Services has reviewed the Preliminary Landscape Plan for Cattail
Creek PUD and offers the following comments. An Improvements Agreement for Private Road
Maintenance was not received in the referral packet.
Per the application materials, the applicant is proposing a nine parcel PUD with eight one acre
parcels and one 119 acre agricultural parcel with center pivot. There is approximately twenty-
seven acres of common open space to maintained by the Home Owners Association.
On-site landscape treatment consists of a three deciduous trees, and one evergreen tree with
no common, botanical or cultivar species has been noted. This plant material is located
northeast of the proposed monument sign location. The application drawing package did not
delineate the monument sign as described in the application materials.
Future submittals shall provide a detailed Landscape Plan for the entry, including the design of
the monument sign for the proposed development.
Per the application materials, the open space area will be planted in native and/or drought
tolerant grasses. Future correspondence shall identify the species of grass seed mix and
whether the mix is to be drilled or broadcast for installation. Further, the applicant has not
addressed the landscape treatment for areas within the 100-year floodplain of Coal Bank
Creek. Future correspondence shall identify the erosion control devices including but not
limited to rip-rap and seeding that will be placed within and adjacent to this area. If plant
material is proposed, please identify the species and how this plant material will be installed.
Staff has concerns with the selection of the native grasses and the potential for noxious weeds
to gain a foothold and establish themselves within the open space areas. The application
materials state that this proposal greatly increases the amount of wildlife on site. The attached
correspondence from the Division of Wildlife does not indicate this to be the case. Future
correspondence shall identify the proposed management plan for the open space, particularily
given the close proximity of the agricultural production lands to the west.
Per the application materials, the open space area, including the entry area plant materials will
be irrigated utilizing a non-potable water source. Future correspondence shall identify the
source of this irrigation water and the timing of delivery.
The Eaton School District requested a bus pull-off of fifteen (15) by eighty (80) feet to be
located near the eastern entrance flare and point of ingress/ egress of the PUD. This shall be
graphically delineated on the drawings. Further, the location and relationship to the bus pull-off,
if any, has not been delineated on the submitted drawings. The Change of Zone Plat shall
reflect these additions to the development.
Sheriff Pouncelow with the Weld County Sheriffs Office stated that a minimum of fifteen feet by
width of drive pavement shall be placed at the point of ingress/egress into the agricultural lot
from Weld County Road 70. The Department of Planning Services suggests that the length of
this pavement strip be increased to a minimum of twenty feet, one automobile length to
accommodate this issue.
The internal road for this PUD development shall be paved and meet the Code requirements of
Chapters 24 and 27. Chapter 26 is not applicable to the development as the project is not in
the MUD. The application provides conflicting information. Section 27-6-50.6 of the application
text states the proposed vehicular circulation system is paved and there are no off-street
parking areas. Section 27-6-50.18 of the application text states all lots will be served by an
internal gravel roadway dedicated to the County. This section further identifies this
development as a Minor Subdivision and not a PUD as proposed.
Per Section 24-2-20 all PUD developments will be served by an internally paved road system
according to County standards. The cross-section delineated in the drawing package has
identified two 12-foot paved lanes and two 4-foot gravel shoulders adjacent to borrow ditches
placed on each side of the road.
Summary
The applicant shall provide additional information pertaining to the open space plant material
including the plant material utilized for the floodplain area. Specific seed mixes shall be
identified, including the installation method.
The applicant shall provide additional information pertaining to the entry sign and plant
materials, including common, botanical and species names, size at installation and any
additional information deemed necessary by Landscape Designer.
The applicant shall provide evidence of the non-potable water source and delivery for irrigation
for proposed plantings.
The applicant shall provide additional detail to the relationship of the bus pull-out, mail box
location and point of ingress and egress for development.
The applicant shall submit an Improvements Agreement for Private Road Maintenance for
review and approval with the Final Plat application.

Agricultural Zone Uses along with 30.13 acres of open space.
PZ-613
1. Additional information is needed for the Bus Shelter: setbacks; road right-of-way
encroachment; type of construction; foundation.
2. Building permits shall be obtained prior to the construction of any building or structure.
Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-
1-20 and Section 29-3-20 B.13 do not need building permits, however a Certificate of
Compliance must be filed with the Planning Department and an electrical permit is required for
any electrical service to the building.
3. A plan review is required for each building except for buildings that meet the definition of Ag
Exempt buildings. Plans shall bear the wet stamp of a Colorado registered architect or
engineer. Two complete sets of plans are required when applying for each permit.
4. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 1997 UBC, 1998 IMC, 1997 IPC,
1999 NEC and Chapter 29 of the Weld County Code.
5. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.
6. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. (For residential
occupancies, walls shall be protected with one-hour fire resistive construction within three feet
of property lines and openings are not permitted within three feet of property lines) Separation
of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
7. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the

Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
8. A Flood Hazard Development Plan shall be submitted for buildings constructed within the
100-year flood plain.

Review of Plan; Agreed changes
To meet the Districts' desire to provide adequate fire protection for single family homes
in a rural setting the applicant shall install two Fire Hydrants one at the intersection of
WCR 70 and the project access road. The second hydrant shall be installed at the SW
corner of proposed lot 6. The fire flow shall be 500 gpm per minute at 20 psi. Hydrants
shall be Mueller Centurion, American Darling or Waterous Pacer.
The culler sack shall be free of any obstacle or vegetation of any kind allowing the fire
apparatus ability to turn around with in the radius of 65 feet.
The road way and culler sack shall be paved allowing the fire apparatus the ability to
reach the scene of an emergency, secure a hydrant, and drain water in any weather
condition with out causing damage to the property, apparatus, and equipment carried such
as fire fighting hose.
Actual spotting and installation should be coordinated with North Weld County Water
District.

Thank you for the opportunity to review this change of zone from A (Agriculture)to a PUD(Planned Unit
Development). The City of Greeley Planning staff has reviewed the application for the change of zone request
from Cattail Creek Group, LLC and wish to forward the following comments:
The proposed PUD does not comply with the policies and intent of the City of Greeley's Comprehensive Plan and
i-. Resolution 7, 1985. This resolution indicates that we cannot recommend approval on any application where the
overall gross density exceeds one dwelling unit per 20 acres when the subject property is located outside of the
2010 growth ring. Since this application creates nine lots through the exemption process on an existing 161.34-
acre parcel, we cannot recommend its approval based on Resolution 7, 1985.
If the Weld County Planning Commission approves the proposal,the City of Greeley recommends that it should
be on the condition that the private access road be paved. In addition it is recommended that Weld County Road
70 be paved up to the private access road to reduce the development's impact on air quality and that 60 feet of
right-of-way be reserved from the centerline of Weld County Road 70 to facilitate the development of Weld
County Road 70 as a future arterial roadway.
