Re: Booth Land and Livestock
Dear Ms. Etcheveny,
This letter is to address your comments to Booth Land and Livestock dated July 11, 2002.
In your letter you explain the reason for your visit was a complaint that Booth's were
pumping wastewater directly into a freshwater pond. Mark Booth showed you exactly how
the pumping was occurring, and that it was not being pumped directly into a freshwater
pond, as the complainant charged.
Secondly,you imply that there was a discharge of wastewater toward the west. This is
incorrect, as explained by Mark Booth on site. Mr. Booth explained to me that the area in
your picture was old eroded soil from last year. If there had been a discharge in that area
the soil would have been wet or even muddy. Mr. Booth indicates that there was no
discharge during the events you describe. Mr. Booth also contends that they have not had a
discharge since the one last year that they have corrected and are currently working with the
Water Quality Control Division on a Settlement Agreement and Stipulated Order.
You also state that the retention ponds are not constructed as described in my letter dated
August 13, 2001. The entire length of ponds is constructed and operates as described in my
previous letter. Since Booth made improvements last year, Booth indicates that the system
has been working as planned and no discharges have occurred. No time-line for pond
modification is forthcoming at this time since, in Booth's and my professional opinion, the
ponds are working as designed and described in my previous letter.
Booth is planning on making some improvements to the system, including revising the
north-side spillways to make it easier and more efficient in getting wastewater down to the
south after rain events for pumping to the west pivot. Also included in their improvement

plan is installation of a permanent pump in the south pond with permanent piping to the
diversion structure that subsequently gets the wastewater to the west pivot. These
mentioned improvements,while not impacting the environmental compliance of the feedlot,
will be done within the next three or four months.
