RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #3325 - CLEM SCHRANT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #3325, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for Recorded Exemption #3325 was submitted by Clem Schrant, 32945 Weld County Road 8, for property which is located in part on the following described real estate, to-wit: S1/2 SW1/4 of Section 8, Township 1 North, Range 63 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 46 acres and 34 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Recorded Exemption #3325 by Clem Schrant is approved, conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. The applicant has proposed a well as the source of adequate water for Lot B. Property owners are advised that the quantity of water available for usage may be limited to specific uses, i.e., "Domestic Use Only," etcetera. Because each situation is unique, the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866- 3581), to discuss each individual situation. 3. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 1477-08-3 RE-3325. 2002-2265 CO; /a192 RE3325 • S RE #3325 - CLEM SCHRANT PAGE 2 B. In accordance with Chapter 8, Article II, of the Weld County Code, Lots A and B shall each be granted one residential access. Direct access from a public road shall be limited to one access per legal parcel for residential use, no circle drives or additional accesses shall be granted. The road shall be graded and drained to provide all-weather access. Accesses shall be placed in such a location as to have adequate sight distance in both directions, shall not be placed below the crest of a hill or where physical obstructions are present, and shall be a minimum distance of 75 feet from any intersecting County or State roadway. C. Lot B shall use the existing agricultural access necessary for agricultural operations as no additional accesses shall be granted. D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert, contact the Weld County Department of Public Works to adequately size the culvert. E. Weld County Roads 10 and 63 are designated on the Weld County Transportation Plan Map as local gravel roads, which require 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Roads 10 and 63 shall be delineated as right-of-way on the plat. These roads are maintained by Weld County. F. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. G. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M, and R in Table 3-A of the 1997 Uniform Building Code, shall he constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2002-2265 RE3325 • • RE #3325 - CLEM SCHRANT PAGE 3 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the Building Permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 4) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot B has an adequate water supply of sufficient quality, quantity and dependability. 5) Potential purchasers should be aware that Lot B may not be eligible for a domestic well permit which allows for outside irrigation and/or the watering of stock animals. The State Division of Water Resources issues all well permits. 6) Potential purchasers should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically thereafter. 7) Potential purchasers should be aware that approval of this Recorded Exemption does not guarantee that well permits will be issued for the lots. Any lot may be deemed non-buildable if the lot owner is unable to obtain a well permit. The State Division of Water Resources issues all well permits. 8) Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 9) Weld County's Right To Farm statement, as it appears in the Weld County Code, Appendix 22-E, shall be placed on the Plat. 10) Lot A shall receive by deed 34 shares of Henrylyn Ditch irrigation water. Lot B shall receive by deed 46 shares of Henrylyn Ditch irrigation water. Potential purchasers should be aware that the receipt of such shares are not guarantee that Lots A and B will have sufficient water for irrigation of the lots. 2002-2265 RE3325 • i RE #3325 - CLEM SCHRANT PAGE 4 4. The applicant shall submit two paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copy the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date the application was approved by the Weld County Board of County Commissioners. The applicant shall be responsible for paying the recording fee. 5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 24-8-40.B of the Weld County Code, as follows: A. Section 24-8-40-8.3- Consistency with the intent of the zone district the recorded exemption is located within as expressed in Chapter 23 of the Weld County Code. The parcel is located within the A (Agricultural) Zone District. Section 23-3-10 of the Weld County Code states: "The A(Agricultural)District is intended to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other incompatible land uses." The property is located on land classified as "prime" agricultural according to the USDA-Soil Conservation Service map. The existing parcel has 80 shares of Henrylyn Irrigation District Water. 1) Section 22-2-60.A.Goal 1 of the Weld County Code states "Preserve prime farmland for agricultural purposes which foster the economic health and continuance of agriculture." The USDA-Soil Conservation Service Map indicates that the soils on the property are designated "Prime"farmland. 2) Section 22-2-60.A.Policy 4 of the Weld County Code indicates applications for the division of land which are zoned agricultural shall be reviewed in accordance with all potential impacts of the division on the agricultural community including soil classification,agricultural productiveness on the site. 3) Section 22-2-60.A.Goal 9 of the Weld County Code states "The minimum lot size of parcels in the Agricultural zone district should remain at 80 acres to encourage parcels large enough to retain viable farming operations or to accommodate modern agricultural equipment and irrigation practices. Lots of lesser size are not generally practical to farm due to large scale management practices existing today." 2002-2265 practices existing today." B. Section 24-8-40-B.4 Consistency with efficient and orderly development as expressed in Section 24-1-30 of the Weld County Code. 1) 24-1-30.H Securing equitable handling of all subdivision plans be providing uniform procedures and standards. Planning staff has consistently approved lots on prime farm ground that are approximately 9 acres or less, unless other circumstances exist. 2) 24-1-30.J Preserving agricultural land and promoting it most productive agrarian use; The proposed recorded exemption will essentially split 80 acres of prime agricultural land into two(2) lots of similar size. A smaller lot size for Lot A of the recorded exemption is recommended because smaller parcels are not generally large enough to retain viable farming operations of to accommodate modern agricultural equipment and irrigation practices. C. Section 24-8-80.J- The proposed recorded exemption does not evade the statement of purpose as set forth in Section 24-1-30 of this Chapter. It is the opinion of the Department of Planning Services' staff that the proposed recorded exemptions do in fact evade the statement of purpose as set forth in Section 24-1-30 of the Weld County Code for all of the reasons stated previously. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached: 1. RE-3325 -Schrant 3 • • 9) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts,including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases,will not be equivalent to municipal services. Rural dwellers must,by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important,not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. I have been requested to describe how irrigation water is allocated among users owning real property within the boundaries of the District. The Henrylyn Irrigation District was created and operates pursuant to the authority of Articles 41 and 43 of Title 37,Colorado Revised Statutes. As such all water rights owned by the District are held in trust for pro-rata delivery to all lands located within the boundaries of the District. The right to delivery of any water is "tied to the land" and cannot be separately conveyed or transferred apart from the land. All water rights owned or controlled by the District are diverted from the South Platte River through the Burlington-OT3rian Canal and Denver-Hudson Canal and delivered through laterals and ditches directly for irrigation of the lands within the District(Direct Water)or delivered to Horse Creek or Prospect Reservoirs for storage and later irrigation of lands within the District(Storage Water). Each year, after opportunity to estimate the amount of water that will be available to the District after shrinkage and evaporation from the canals, laterals, ditches and reservoirs,the District Manager consults with the Board of Directors and establishes a"pro-rate". The"pro-rate"is the amount of water available for division,on a per acre basis, among all lands within the boundaries of the District. Presently there are approximately thirty-three thousand acres included within the boundaries of the District Thus, if the Manager determines there will be thirty-three thousand acre feet of water available to the District then the "pro-rate"would be established at one-hundred percent For example if the"pro-rate" was set at twenty-five percent, each irrigable acre would be entitled to delivery of one-quarter of an acre foot of water that particular irrigation season. From 1955 through 2000 the "pro-rate"varied year to year from a low of five percent to a high of fifty percent, depending upon hydrological, structural,and legal conditions. Additionally,the District Manager may annually determine the District's Reservoirs are at their safe carrying capacity and there is extra Direct Water available to the District,then such water is made available as "no charge" water to all lands within the District,without reduction to any parcel's respective "pro-rate". I have managed the above described tract for 31 years. The water rights have allowed me to have limited irrigated farming of this tract. The East half of this quarter section has been farmed as basically dry land during this period.. In addition, it was necessary to transfer 143 acres of water from the home place to provide adequate water for one-half of this South-West quarter. To me, it is not feasible to set a sprinkler on this quarter section, because of the low return on investment. And consequently, the corner tracts with five acres do not apply to our situation. From what I understand, dividing this into two parcels meet the requirements of your planning and zoning guidelines. These tracts of 34, and 46 Acre parcels allows farming to continue, with the limited water available and also provide a farm atmosphere for people desiring to live in that locale. Local farmers are available to seed and maintain grass and other growing crops for the property owners. These size tracts fit in well with what exists around the perimeter. Dividing into these size tracts should not change the usage, compared to what would result in small 5 acre tracts. The soil type of this tract is mostly Weld. It has a very low perc rate. Schrant Keenesburg, Colorado 1. Domestic water: The 34 acres parcel has an existing domestic/stock well, permit #138234. A domestic well permit will be applied fitr when a building permit would be applied for on the 46 acre parcel. Irrigation water: Each parcel retains its full share of Henrylyn Irrigation District Water. The 46 acre parcel will have 46 shares of Henrylyn, and the 34 acre parcel will have 34 shares of Henrylyn water. By taking 33% of the shares per parcel, one can equate the acre feet of water actually allotted for each parcel. The Henrylyn District is not considered a full water supply as its capacity depends totally on rainfall and snowpack. This year the District has already indicated only 15%-20% of each owners allotted water will be available for delivery due to the lack of moisture. 2. Sewer: A septic permit will be applied for as necessary with a building permit on both parcels. 3. The property consists of 80 acres of partially irrigated farmground, which will be partially in barley for the 2002 crop year. With the lack of adequate water, this parcel does not allow for full crop production, and is therefore not considered prime farmground. 4. The purpose of splitting the property into 2 separate larger parcels is to allow the owner to generate much needed working capital. He has chosen this parcel as it is not prime farmground due to the lack of water (Henrylyn is not adequate) and the topography of the site. The proposed configuration of the split will allow for the creation of a home site, as well as the continued use of the parcels for agricultural purposes. It has been determined that there is not enough availability of such parcels. The parcel is either to small for any type of continued crop production or so large that it is cost prohibitive for the buyer to be able to farm the ground. The 80 acre parcel is located 1/2 mile south of Hwy. 52 on WCR 63. The land is currently being planted in barley and receives its water from the ditch at the corner of WCR 63 and WCR 10. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. A local residential/agricultural access shall be a minimum distance of 75 feet from an intersecting county or state roadway, and 150 feet for commercial type use. (Lot B, 46-acre parcel) Direct access from a public road shall be limited; only one access is allowed per legal residential parcel building envelope. No circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall apply to all new and existing accesses within the unincorporated areas of Weld County. Generally,this soil is well suited for windbreaks and landscape plantings. PRIME FARMLANDS: No Prime Farmlands will be taken out of production. SOIL EROSION POTENTIAL: Surface runoff is slow and the erosion hazard is low.
