As property owners directly adjacent to this property we would like to know what the proposed use changes are. While we are not adverse to growth and/or change, we have some concerns regarding the proposal. We have had relatively few problems with the delicatessen (mainly the trash scattered downwind pp ow nine acres) and no major property destruction other than the removal of our barbed wire fence and posts just east of the deli. •Increased clientele, of course, could increase problems. We question 1)how often and how large a'Use by Special Review' can keep growing. We also are concerned at open-ended proposals as this is that at some future date can grow in size, hours open, etc. and 2) the need for another business selling liquor when the adjacent property to the north and in Wyoming (also owned by the applicant) sells liquor. Webster states a delicatessen is a business which sells sandwiches, meat, cheese and salads. With the addition of liquor do we still have a deli? Is there an occupancy maximum in the current deli and who/when has checked on this? It never crossed our mind that a deli would result in the extravagant parking lot lighting the existing business has. On cloudy nights we unhappily find our property well lit from reflections off the clouds. •How much more lighting will this project require? •We are concerned with the increased noise which would be generated in an open atrium or patio area. Is there anyoccupency maximum in this open area? We're adverse to an open structure coupled with drinking. Currently the`imbibing group' occasionally creates unrestrained noise from the parking lot of the Wyoming structure into the early morning hours. We have no objections to the existing 42'x52'building. This, however, would be dwarfed by the 100'x100' proposed building shown on the site plan which would not be built initially. •Our greatest concern is the traffic.We feel Weld County was negligent in not requiring a turn lane when this'Use by Special Review'was first approved. There is potential for serious and/or fatal accidents at the entrance to this property (in Wyoming). The applicant refers to 1000 people per day and, when lottery stakes are high, this might be conservative. This probably means in excess of 500 cars per day. This approach is a bomb with a lit fuse. Numerous times we've experienced and heard screeching tires a quarter of a mile away. The clientele this establishment feeds off is the elderly who frequently misjudge heavy traffic even without imbibing. There are only narrow shoulders on the east and west sides of this two-lane US highway and absolutely no turn lane. Shouldn't the State of Colorado and Weld County (or the applicant) pay for a turn lane in Wyoming? These are the three entities profiting from this endeavor. •The speed limit on Hwy 85 is 65 mph and, having owned the adjacent property for over 20 years, we can assure you the heavy truck and commuter traffic frequently exceed the limit, partially due to its remoteness from the county seat and partially because the State Patrol/Sheriff is very seldom seen in this part of the Weld County. We hope the State of Wyoming will be involved in this review process as the applicant indicates they will be providing emergency services to this locale. Laramie County Fire District #1 has established a mutual aid agreement with the Nunn Fire Protection District which allows our fire apparatus and firefighters to respond to emergencies within Weld County. Our response will be at the request of the Nunn Fire Protection District. Our fire station is located approximately 9 miles from the Colorado border, therefore our response time would be less than Nunn Fire. The mutual aid agreement also allows Laramie County Fire District #1 to call Nunn Fire for emergencies in Laramie County Fire District #1s area. This agreement allows for more fire equipment assets should the emergency require additional firefighters and apparatus. Since our deputies are typically closer to the business than Weld county authorities, we will respond to calls from the perspective of maintaining public safety. We are, however, limited by the fact that we have currently no enforcement powers in the State of Colorado. There is currently legislation proposed in the Wyoming Legislature that would, if passed, enable us to enter into more definitive mutual aid agreements with the Weld County Sheriff. '� The next step in the adjudication (finalization) process for the water right is a field inspection conducted by ground water division personnel to verify all records in the State Engineer's office are consistent with the actual use of the ground water. Field inspections are conducted normally April through October, and require a pump test to check well production and an observation of the conveyance of water to the points of use specified in the permit. Our field schedule has not been finalized at this time. An attempt will be made to contact you to arrange a mutually acceptable time to conduct the inspection.
