The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 35 is designated on the Transportation Plan Map as a local paved road. This road was recently upgraded
and paved south of State Highway 52 to the Buffalo Ridge Subdivision.
WCR 12 is designated on the Transportation Plan Map as a local gravel road, which extends east of WCR 35 for
approximately 1/4 mile.
Traffic Impact Study: The traffic study has been submitted by Matthew J. Delich, P.E.,for review of Weld County
'ublic Works. An additional copy should be submitted to CDOT for their review as the designated haul routes
affects State Highway 52 at this location. The Public Works Department is in agreement with the traffic study
submitted by Matthew J. Delich. P.E., and the traffic study will not be referred to our consultant, Felsburg, Holt&
Ullevig for any additional review.
REQUIREMENTS:
Improvements Agreement: The Weld County Public Works Department is recommending a Long-term Road
Maintenance Improvements Agreement for the designated haul route. The designated haul route shall be WCR
12 from the entrance of the facility west to WCR 35 then north to State Highway 52 and disburse either east or
west at this location.
A short-term Improvements Agreement for the Upgrade and Paving of approximately 1/4 mile of WCR 12 east
of WCR 35 to the scale house and office area will be required. Our typical pavement section should reflect a
minimum width of 24 feet of asphalt and base combination, 4-foot gravel shoulders, and an adequate turning
radius in the northeast corner of WCR 12 and WCR 35. The depth of asphalt and base will be determined through
a soil investigation and approved by the Weld County Public Works Department.
Storm Water Drainage:A storm water drainage report will be required. Refer to Section 24-7-20, Storm Drainage
Requirements under Subdivision Design Standards in the County Code.
Legal Access: The applicant shall indicate on the plat the type of right-of-way/easement and indicate whether it
is dedicated, private, or deeded to provide an adequate access to the parcel. The access road leaves WCR 12
----and cuts across adjacent properties not shown to be owned by the applicant.
The Weld County Public Works Department recommends approval providing the above requirements are met.

Environmental Health Services has reviewed this proposal for open pit mining. We have no objections to
the proposal; however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services
Division of the Weld County Department of Public Health & Environment. The plan shall include at
a minimum, the following:
1) A list of wastes that are expected to be generated on site (this should include expected
volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
1) The waste handler and facility where the waste will be disposed (including the facility name,
address, and phone number).
2. Submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to the Air
Pollution Control Division, Colorado Department of Health and Environment for emissions of criteria,
hazardous or odorous air pollutants. The site shall operate in accordance with all applicable rules and
regulations of the Air Pollution Control Division.
3. If applicable, a CPDS Permit shall be obtained from the Water Quality Control Division of the Colorado
Department of Health for any proposed discharge into State Waterways.
4. An individual sewage disposal system is required for the proposed office and proposed residence and
shall be installed according to the Weld County Individual Sewage Disposal Regulations. The
proposed office septic system is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations. The proposed
residence may be required to be designed by a Colorado Registered Professional Engineer
We recommend that the following requirements be incorporated into the permit as "development standards:
1. An individual sewage disposal system is required for the proposed office and proposed residence and
shall be installed according to the Weld County Individual Sewage Disposal Regulations. The
proposed office septic system is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations. The proposed

residence may be required to be designed by a Colorado Registered Professional Engineer.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those
wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
5. Fugitive dust shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone
as delineated in 25-12-103 C.R.S., as amended.
7. Adequate toilet and handwashing facilities shall be provided for employees and the public.
8. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility
area in a manner that will prevent nuisance conditions.
9. The facility shall operate in accordance with the approved dust control plan. The facility shall have
sufficient equipment available to implement dust control as required by the Weld County
Department of Public Health and Environment.
10. The operation shall comply with all applicable rules and regulations of the Colorado Division of
Minerals and Geology.
11. The operation shall comply with the Occupational Safety and Health Act(OSHA).
12. The operation shall comply with the Mine Safety and Health Act (MSHA).

1. A separate building permit for each building shall be obtained prior to any construction.
2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
r^. registered architect or engineer. Two complete sets of plans are required when applying for
each permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
6. A Flood Hazard Development Permit shall be submitted for buildings constructed within the
100-year flood plain.

Dear Mr.Gathman:
In response to your request and in accordance with Senate Bill 35(1972), I visited this property to
review the plat.A Change of Zone PUD Application prepared by Todd Hodges Design, LLC(10-28-01)
was included in the referral.Geotechnical and drainage reports were not included in this referral.
The site is located on approximately forty(40)acres of land that is currently used for sand mining.The
referral materials indicate that the site will be used to manufacture soil products and graze cattle.The
site geology consists of a Quaternary-age eolian sand deposit that mantles the Tertiary-age Denver
Formation.
The following conditions were described in the referral and observed during the site visit:
1) Drainage and Erosion.The site plan included in the application packet indicates a proposed
stormwater retention pond in the south east comer of the project site,just north of the existing
irrigation canal. Since the site appears to currently sheetfiow to the irrigation trench, I suggest
installing an interceptor trench to convey the potentially sediment laden stormwater runoff directly
to the proposed retention pond.Another option may be to relocate the pond to an area directly
down slope of the disturbed ground.
The referral material indicates that any stormwater which comes in contact with the on site soil
materials will be collected in a retention pond and will not leave the site.The sand on site is highly
erodible and quite porous and thus may not be the most effective material for construction of a
stormwater retention basin. I suggest utilizing a site-specific drainage investigation to design the
detention area.The basin should be a)capable of handling 100-year storm events,b)easy to
maintenance and c)be impervious to prevent loss of water via leaching. Conversely, if the owner of
the Speer Canal is willing to accept stormwater discharge into the canal,a sand pond may be an
effective water quality sand filter.

2) Geotechnical Information. I suggest structural designs for the proposed residence(s)be designed
using site specific geotechnical investigations.Although the dominant site geology consists of
sand,the subsurface in this area could contain expansive or compressive clays that may cause
structural damage without proper engineering and/or mitigation.
In summary, provided the above comments are addressed,there appear to be no geologic hazards at
this site that would preclude the intended rezoning of this property.Should you receive any additional
