Planning C I DATE: March 8, 2002 O • FROM: Pam Smith, W.C. Department of Publi COLORADO Health and Environment '✓ CASE NO.: S-626 NAME: Scott/Deanne Day The Weld County Health Department has reviewed this proposal. The applicant proposes to re-subdivide the property for change to a lot line on the plat to accommodate the road. There are 5 lots on a total of 25 acres. The minimum lot size is 4.3 acres, with an overall density of one septic system per 5.0 acres, which does meet current Department policy. The application has satisfied Chapter 24 of the Weld County Code in regard to water and sewer service. Water is to be provided by individual wells. No proof of well permits was provided in the application materials. Sewer will be provided by individual sewage disposal systems. As discussed above, the minimum lot size and overall density meet the current Department policy. A review of the soil survey map indicates the most of the site is suitable for conventional septic systems. Because of the size of the lots, and the anticipated percolation rates, there should be no problem in meeting the 100-foot setback between the absorption fields and wells. Subdivisions reviewed under current standards would normally address such things as: preliminary percolation tests, primary and secondary septic envelopes for the lots (depending on lot size, soil conditions, etc.), and protective language for the secondary envelope. The County views this as a minor adjustment to accommodate the road, and this re-subdivision doesn't change parcel sizes on the property. Therefore, the Department will not impose those standards on this request. The Department recommends approval with the following: 1. Water service shall be obtained from the individual wells. 2. A Weld County Septic Permit is required for each proposed septic system and shall be installed according to the Weld County Individual Sewage Disposal System Regulations. Each septic system shall be designed for site-specific conditions, including but not limited to maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. The applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment, if required. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods, which are technologically, feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. 0:\PAM\PLANNING\FI NALPLAN\S-626.RTF Weld County Referral WIC. 2002 February '11 ,I Di, COLORADO Rc ' FEB 12 2002 WD COUNTY The Weld County Department of Planning Services has received the following item for review:PUPIEL WORKS DEPT Applicant Scott& Deanne Day Case Number S-626 Please Reply By March 4, 2002 Planner Sheri Lockman Project A Re-subdivision for a change to a lot line on a plat recorded by the Hudson Land P Company (Siarra Run Re-subdivision). Our comments and requirements are as follows: COMMENTS: WCR 39 is designated on the Transportation Plan Map as a local gravel road, which requires a 60- foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Improvements: The applicant has agreed to upgrade and pave the Siarra Run Minor Re- subdivision with three inches of asphalt and six inches of base. The typical cross section will reflect 24 feet of pavement with four-foot gravel shoulders, cul-de-sac, and an adequate turning radius connecting to WCR 39 with a stop sign. Storm Water Drainage: The storm water drainage report was submitted and approved. The applicant is working with legal staff on an Improvements Agreement to secure collateral on each lot that is sold. The sale of the lots will be used to upgrade and pave of the minor subdivision. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application.
