HomeMy WebLinkAbout20020237.tiff RESOLUTION RE: APPROVE REQUEST FOR CONSTRUCTION OF ADDITIONAL PIPELINE IN EXISTING EASEMENT ACROSS SHEEP'S DRAW PROPERTY AND AUTHORIZE CHAIR TO SIGN - COLORADO INTERSTATE GAS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Request for construction of an additional pipeline in an existing easement across the Sheep's Draw property between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Colorado Interstate Gas, with terms and conditions being as stated in said request, and WHEREAS, after review, the Board deems it advisable to approve said request, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Request for construction of an additional pipeline in an existing easement across the Sheep's Draw property between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Colorado Interstate Gas be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said request. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 28th day of January, A.D., 2002. Ma den ate of signature: . 412a--- 2002-0237 EG0046 A Colorado ep Interstate Gas an El Paso company August 13, 2001 Weld County 915 10th Street Greeley, Colorado 80634 Re: Colorado Interstate Gas 5C Loop Expansion Weld County, Colorado Gentlemen: On June 9, 1955, Colorado Interstate Gas (CIG), acquired from Clyde C. and Clara Wright a Right of Way Agreement across the S/2NE/4 and SE/4 of Section 33, Township 6 North, Range 66 West, Weld County Colorado. Said agreement being recorded in Book 1424 at Page 71, of the records of Weld County. This agreement allows construction of additional pipelines across this property for an added consideration. Enclosed for your review is a copy of said Right of Way Agreement. Weld County records show that you are the present owner of this land as described in a Deed dated October 21, 1998, Reception No. 2649867. This letter is to advise you that CIG, on or about January 15, 2002, will begin construction of an additional pipeline alongside the present pipelines where it crosses your property. The distance traversed by this pipeline will be approximately 2,942.94 feet or 178.36 rods. For the additional pipeline to be constructed, CIG has issued Draft No. 15318 in the amount of $267.54, as payment for the stated consideration as required in the agreements described above. CIG is currently paying a consideration of $40.00 per rod for right of way. CIG's Land Agent will issue a check to cover the additional consideration. Upon completion of this new pipeline, CIG will contact you for settlement of damages caused by this construction. Hempen, Jr. Director of Public Works/County Engineer COLORADO SUBJECT: Agenda Item Please place the following items on the Board's next agenda: Consider Construction of Additional Pipeline in Existing Easement Across Sheep's Draw Property- Colorado Interstate Gas. Colorado Interstate Gas has an existing "blanket" easement across the Sheep's Draw Property. They intend to place an additional transmission line immediately east of their existing lines (west of Sheep's Draw Creek). This location has no impact on future mining operations for this site. It has minimal, if any at all, impacts on future wetland banking opportunities. Recommend approval. The appropriate documentation is attached. Enclosures pc: Frank B.
