RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A NATURAL GAS PRO-
CESSING FACILITY - DARENCO, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 7th day of December, 1983 , at the hour of 2 : 00
o' clock p.m. in the Chambers of the Board for the purpose of hear-
ing the application of Darenco, Inc. P.O. Box 11098 , Denver,
Colorado 80211, for a Use by Special Review for a natural gas
processing facility on the following described real estate, to-wit:
Part of the NE4 NEa, Section 36, Township 4
North, Range 68 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Plan-
ning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that this
request shall be approved for the following reasons:
1. The submitted materials are in compliance with the
application requirements of Section 24. 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 .2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe
on continued agricultural use in the vicinity or
County. The proposal does not appear to have any
adverse impacts on the agricultural interests of
the County or the environment.
b. The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as
a Use by Special Review.
c. No overlay districts affect the site .
d. Use by Special Review Operation and Design Stand-
ards provide adequate protection of the health,
safety and welfare of the neighborhood and County.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application for a
Use by Special Review for a natural gas processing facility on
the hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1. The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . No building or electrical permits shall be issued for
the Use by Special Review Permit area until the Stand-
ards for the Use by Special Review have been placed on
the Use by Special Review plat and the plat has been
delivered to the Department of Planning Services Office.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
December, A.D. , 1983.

OPERATION STANDARDS
Darenco, Inc.
U.S.R. - 586:83:49
1. The uses permitted shall be a natural gas processing facility as
described in the application materials on file with the Department of
Planning Services.
2. A six (6) foot chain link fence, topped with three (3) strands of barbed
wire, shall enclose the Use by Special Review area.
3. An air emissions permit for the facility must be obtained from the Air
Pollution Control Division, Colorado Department of Health, 4210 E. 11th
Avenue, Denver, Colorado 80220.
4. Noise emissions must not exceed those standards which are found in
Colorado Revised Statute 25-12-101, et seq.
5. The appearance of the facility shall be maintained in a neat and orderly
condition through periodic painting and maintenance.
6. The Use by Special Review area is situated on prime agricultural soils.
The entire subject site shall be covered by gravel and/or a vegetative
cover as recommended by the Soil Conservation Service to prevent wind and
water erosion. Said subject site shall be restored to its original
condition by the operator and/or owner upon cessation of the prescribed
natural gas processing facility.
7. Liquid storage vessels shall be bead to contain all potential content
spillage or leakage.
8. The Use by Special Review area shall be limited to one (1) access point
on Weld County Road 40; a fifteen (15) inch by forty (40) foot CMP
culvert shall serve the access point.
9. Within ten (10) days after final approval by the Weld County Building
Inspection Department, or after the plant is on line, the Johnstown Fire
Protection District shall be contacted and invited to attend
instructional training and meetings concerning shutdown and fire control
at the plant site.
10. Hazardous substances, per Colorado Revised Statute 29-22-107 shall be
stored, handled, quantified and disposed of properly, with proper
notification to required regulatory agencies.
11. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
12. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
13. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall be granted access onto the
site at any reasonable time in order to insure the operations carried out
on the site comply with the Operation Standards stated hereon and all
applicable Weld County Regulations.
14. The Use by Special Review Permit shall be limited to the plans shown
hereon and governed by the Standards as stated above and all applicable
Weld County Regulations. Any material deviations from the plans and/or
Standards as shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall be filed in the office
of the Department of Planning Services.
15. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated November 21, 1983, and duly
published in the La Salle Leader on November 23, 1983, a public hearing was held
for the purpose of considering the request of Darenco Inc. , for a Use by Spedial
Review for a natural gas processing facility. Russell Anson, Assistant County
Attorney, read this request into the record. James Mayerl, Planning Department
representative, read the favorable recommendation, with conditions, from the
Planning Commission into the record. Harold Myles, representing Darenco, Inc. ,
came forward to explain this proposal. Commissioner N. Carlson stated that
he has a problem with the gas & oil companies completing their projects and
then they come before the Board to request approval. He said that this par-
ticular project is almost complete at this time. Mr. Myles said it is about
99% complete. Commissioner N. Carlson also said he feels WCR 40 needs to be
upgraded and he would like to include in the Development Standards that Darenco,
Inc. , be responsible for the upgrading of this road. Mr. Myles explained that
his company has already put in 14 inches of road base and they plan to put
in another 6 or 8 inches after the snow has melted. James Mayerl said that
Operation Standard #8 addresses a 40 foot C4P culvert. After a short dis-
cussion, Commissioner Brantner moved to approve this Use by Special Review
for Darenco, Inc. , to include the conditions and Operation Standards as
recommended. Commissioner Martin seconded the notion. Commissioner N. Carlson
again voiced his concerns that these companies are constucting first and then
seeking permission for permits later. The motion carried unanimously.

13. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall be granted access onto the
site at any reasonable time in order to insure the operations carried out
on the site comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
14. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Standards as stated above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Standards as
shown or stated above shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans and/or Standards are
permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
15. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

In compliance with the Weld County Zoning Ordinaces, Section 24,
September 23, 1983, Darenco, Inc. (Applicant) submits the following
background data for its application for Special Review Permit for a
Major Facilities of a Public Utility and is a part thereof.
1. A. It is zoned agriculture and will remain agriculture in the
Weld County Comprehensive Plan.
B While agriculture is a major use in the area proposed, for
many years oil and gas development has been a very important
secondary use. Oil and gas production facilites are a use
allowed by right in an agriculture zone. The facilities
proposed herein are designed to enhance existing oil and gas
production and possibily promote new production.
C. The lands adjacent to the proposed are currently planted in
annual fee crops or in grasses for livestock grazing. The
area is dotted with producing oil and gas wells. Similar
natural gas processing facilities exist approximately 2 miles
to the north.
D. The areas projected as agriculture in the comprehensive plan.
The proposed use is considered agri-business and has long been
associated with agricultural lands and will continue to be so
associated.
E. The proposed is not in or near any established overlaid
district area as identified by maps officially adopted by Weld
County.
F. The proposed is located in an agricultural (A) zone on very
valuable and productive lands. Because of this the total
acreage of proposed is the minimum needed for safety and
efficient operation of the existing proposed facilities. On
less productive lands, the normal size parcel of land for a
similar facility would be at least twice as large.
G. The proposed is designed and operated under guidelines and
regulations established by the Colorado Public Utilities
Commission, the United States Department of Transportation,
and the National Pipeline Safety Act among others. Operating
procedures and safety measures meet or exceed federal, state,
and local regulations.
5. A. The proposed is a natural gas processing and liquids
extraction facility capable of processing two million cubic
feet a day of natural gas and extracting there from
approximately five thousand gallons per day of liquids
(propane, methane, etc.) normally found in natural gas.
B. The nearest residential structure is approximately one-half
mile from the proposed.
C. The proposed will be operated twenty-four hours a day year
around. The operation is automatic, requiring twice daily
maintenance and operation checks by operating personnel.

G. Structures proposed for the premises are a 20 x 20 metal
compressor building. A 7 x 8 metal meter building. A 14 x 24
metal utility building and several pieces of above-ground gas
processing and conditioning equipment. The proposed
structures are three skid mounted processing units
approximately 10 feet by 30 feet each and one 8 foot diameter
by 40 foot long above-ground storage tank. Both the
extraction plant and the storage tanks will be installed on 8"
thick, steel reinforced concrete slabs.
H. Vehicular access to the proposed is from county road 13 west
on road 40 one-quarter mile. As mentioned above, maintenance
and operating personnel will travel to and from the proposed
place daily by pickup and once every four days a tank truck
will travel to land from the site to transport liquid
extracted at the plant.

L. Construction of the proposed is scheduled to begin in October
of 1983 and is anticipated to take four to five weeks to
complete. During construction, eight to ten construction
workers will be employed on site.
M. After construction, the proposed facilities will be painted to
blend with the surrounding environment. Traveled areas within
the plant will be graveled. Disturbed areas not graded will
be seeded with native grasses.
N. Upon abandonment of the proposed, all structures and equipment
will be removed. Underground piping will be removed and
excavations backfilled and compacted. The entire premises
would then be placed back into production as agricultural
lands.
0. The proposed is designed to shutdown automatically in event of
fire or other emergency. In the event of fire, applicant will
notify local fire departments of the location and type of
fire. Applicant's personnel will respond to assist and secure
the area. Remoteness of the facility make damage or danger to
others in the event of an emergency highly unlikely.

7. SUPPORTING DOCUMENTS
A. Harold Miles, who signed this application, is an employee of
DARENCO, INC. applicant and is authorized to do so. DARENCO,
INC. is a lessee of surface rights to the subject property by
virtue of a lease with the surface rights owner and properly
recorded in the Weld County records (copy attached) .
B. No water is required in the construction, operation, and
maintenance of the facility.

background information for its application for Special Review for Major

Selection of the proposed site was done after careful consideration of
the Engineering and Operating requirements in the proximity to services.
Source of natural gas, pipelines, etc. essential to the operation. It
is at this time hard to verify, but safe to assume, that very little if
any consideration was given to the future land use of the area and the
impact on natural resources at or near the site.
