HomeMy WebLinkAbout20021801 RESOLUTION RE: APPROVE PROPOSAL FOR CONSTRUCTION MATERIALS TESTING FOR NORTH JAIL ADDITIONS AND AUTHORIZE CHAIR TO SIGN - NORTHERN COLORADO GEOTECH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Proposal for Construction Materials Testing for North Jail Additions between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the, and Northern Colorado Geotech, with further terms and conditions being as stated in said proposal, and WHEREAS, after review, the Board deems it advisable to approve said proposal, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Proposal for Construction Materials Testing for North Jail Additions between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Northern Colorado Geotech be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said proposal. This proposal includes a brief review of the project information provided to us, the proposed scope of services and schedule, and our estimated fees. PROJECT INFORMATION As we understand it, the project will consist of building a concrete block and structural steel building that will be two-story on the southern side of the building and single-story with a basement on the northern side of the structure. The second story slab will have steel decking and light weight concrete flooring. SOILS Northern Colorado Geotech will provide an engineering technician on a part time basis to perform field density testing of the compacted fill for pad construction, utility trench backfill, sidewalk and pavement subgrade and base course placement. Laboratory testing that will be performed in conjunction with the density testing may include moisture-density relationship (proctor), gradation and Atterberg limits (classification). Additional observations of excavations will be performed prior to forming foundation elements to verify subgrade soils. CONCRETE Northern Colorado Geotech will provide an engineering technician on a part time basis to perform testing of the concrete for the anticipated footings and pads, foundation walls and concrete slabs. Additionally, testing of the exterior exercise yard concrete slab will be provided. The concrete testing will include slump, air content, temperature, unit weight and 5 cylinders that will be field cured for one day and then returned to our laboratory to cure. The concrete cylinders will be tested for compressive strength at 7 days (2 cylinder) and 28 days (2 cylinders). The fifth cylinder will be held in the event that additional testing is required for unforeseen circumstances. We suggest testing the concrete at approximate intervals of 1 test per 50 cubic yards or part thereof. 2002-1801 Proposal for Construction Materials Testing Weld County Law Enforcement Administration Northern Colorado Geotech Proposal No. P02011c Northern Colorado Geotech will also perform various observations for reinforcing rebar prior to the placement of concrete in footings and walls. STRUCTURAL STEEL Inspex ndt, a subcontractor of Northern Colorado Geotech will provide an AWS certified inspector for observation of steel erection,joist and girder connection and deck installation. MASONRY Northern Colorado Geotech will provide masonry construction observation on a part time basis to verify proper placement of rebar, lintels, bond beams and grouting of cells. Additionally, Northern Colorado Geotech will provide masonry, grout and masonry prism testing in general accordance with the specifications called out in Sections 4100 and 4200 of the project specifications. ESTIMATED COST The following cost estimate is based on estimates obtained from job specifications and plans. The total number of tests needed will be influenced by contractor and subcontractor schedules and performance. Therefore, the final number of tests may vary from the estimated values proposed below. Also, we have not included estimates for mortar and/or grout testing due to the uncertainty of requiring testing. Please see our attached Standard Fee Schedule for per unit prices for these tests. SECTION 1: SCOPE OF WORK: NORTHERN COLORADO GEOTECH shall perform the services defined M the contract and shall invoice at fee schedule rates. My cost estimate stated In this contract should not be considered a firm figure unless so stated. If unexpected conditions or an extended scope of work occur during the performance of the work,the additional work will be billed on a time-spent basis at fee schedule rates. Fee schedule rates are valid for one year following the date of the contract unless otherwise noted. Initiation of services by NORTHERN COLORADO GEOTECH pursuant to this proposal will incorporate these terms and conditions. SECTION 2: STANDARD OF CARE: Services performed by NORTHERN COLORADO GEOTECH will be conducted in a manner consistent with that level of care and skill ordinarily exercised by member of the profession currently practicing under similar conditions In the area. No warranty or guarantee,express or implied.Is made or intended by the proposal for consulting services or by providing plans and specifications or written or oral reports. The client acknowledges that unrecognizable conditions may occur and the opinions, plans or reports provided by NORTHERN COLORADO GEOTECH are based solely on data provided and recognizable conditions. NORTHERN COLORADO GEOTECH will be responsible for interpretation of the data and recognizable conditions, but shall not be responsible for the interpretations by others of the information developed. SECTION 3: SAFETY: Nothing in this agreement shall be construed to subject,nor extend NORTHERN COLORADO GEOTECH or its employees,the responsibility or authority to direct or supervise construction means, methods,techniques,sequence,or procedures or construction selected by contractors or subcontractors or the safety precautions and programs incident to the work of the contractors or subcontractors. SECTION 4: ACCESS: Unless otherwise agreed,the client will furnish NORTHERN COLORADO GEOTECH with access to the site and test bore locations. NORTHERN COLORADO GEOTECH will take reasonable precautions to minimize damage to the properly,although it is understood by the client that some damage may occur in the normal course of drilling activities. SECTION 5: INVOICES: NORTHERN COLORADO GEOTECH will submit invoices to the client on a monthly basis or as otherwise determined applicable as work progresses. Invoice amounts are due and payable in full within thirty(30)days of the invoice date. Client agrees to pay a finance charge of one and one-half percent(1.1/2%) per month,but not exceeding the maximum rate allowed by law,on past due accounts. Client also agrees to pay all costs and expenses,including reasonable attorney fees incurred by NORTHERN COLORADO GEOTECH relating to collection procedures on overdue accounts. Failure of the client to abide by the provisions of this section wilt be considered grounds for termination of this agreement by NORTHERN COLORADO GEOTECH. SECTION 6: OWNERSHIP OF DOCUMENTS: All documents including field notes,calculations,estimates,and other documents prepared by NORTHERN COLORADO GEOTECH as instruments of service,shall remain the property of NORTHERN COLORADO GEOTECH unless there are other contractual agreements. The documents may not be used by the client for any other endeavor without the written consent of NORTHERN COLORADO GEOTECH. SECTION 6: CONFIDENTIALITY: NORTHERN COLORADO GEOTECH shall hold confidential all information obtained from the client or generated in the performance of services under this agreement and identified in writing by the client as'confidential". NORTHERN COLORADO GEOTECH shall not disclose such information without the client's consent except to the extent required for; 1) Performance of services under this agreement; 2)Compliance with professional or ethical standards of conduct for preservation of public safety, health,and welfare; (3)Compliance with any court order or other governmental directive and/or;4) Protection of NORTHERN COLORADO GEOTECH against claims or liabilities arising from performance of services under this agreement. NORTHERN COLORADO GEOTECH obligation hereunder shall not apply to information in the public domain or lawfully acquired on a non-confidential basis from others. SECTION 7: LIMITATION OF LIABILITY: The client agrees to limit NORTHERN COLORADO GEOTECH'liability to the owner and all construction contractors and subcontractors on the project arising from NORTHERN COLORADO GEOTECH'professional acts,errors,or omissions or breach of contract or other cause of action such that the total aggregate liability of NORTHERN COLORADO GEOTECH to all those named shall not exceed$50,000 or NORTHERN COLORADO GEOTECH'total fee for the services rendered on the project,whichever is greater,and the client hereby releases NORTHERN COLORADO GEOTECH from any liability greater than this amount. The client further agrees to require of the contractor and his subcontractors an identical limitation of NORTHERN COLORADO GEOTECH'liability for damages suffered by the contractor or the subcontractor arising from the NORTHERN COLORADO GEOTECH'performance of services. Neither the contractor nor any of his subcontractors assumes any liability for damages to others which may arise on account of NORTHERN COLORADO GEOTECH'professional acts,errors or omissions. SECTION 8: INSURANCE: NORTHERN COLORADO GEOTECH carries General liability and Professional liability and Workman's compensation insurance. Within the limits and conditions of such insurance and the limit of liability,NORTHERN COLORADO GEOTECH agrees to Indemnify and save client harmless from and against any loss, damage,injury or liability arising from any negligent acts of NORTHERN COLORADO GEOTECH,its employees,agents,subcontractors and their employees and agents. NORTHERN COLORADO GEOTECH shall not be responsible for any loss,damage or liability arising from any acts by a client,its agents,staff,consultants employed by others,or other third parties who are not employees of NORTHERN COLORADO GEOTECH. SECTION 9: INDEMNITY: The client waives any claim against NORTHERN COLORADO GEOTECH,except as provided in this contract,and agrees to indemnify and save NORTHERN COLORADO GEOTECH, its agents, and employees harmless from any claim, liability or defense cost, including but not limited to attorney fees and other incidental costs,for injury or loss sustained by any party allegedly arising out of or related to NORTHERN COLORADO GEOTECH'performance of services hereunder. Client and NORTHERN COLORADO GEOTECH agree that they will not be liable to each other,under any circumstances,for special,consequential or punitive damages arising out of or related to this Contract. SECTION 10: OBSERVATION SERVICES: If NORTHERN COLORADO GEOTECH is retained by Client to provide a site representative for the purpose of observing specific portions of the work or other field activities as set forth in the proposal,then this section applies. The presence of NORTHERN COLORADO GEOTECH'field personnel will be for the purpose of observation. Our work does not include supervision or direction of the actual work of the Contractor,his employees or agents. The Contractor for this project should be so advised. The Contractor should also be informed that the presence of our field representative or the observation by our firm shall not excuse him in any way for defects discovered in his work. The term,'observation",implies that we would observe the progress of the work we have agreed to be involved with to develop an opinion as to whether the work essentially complies with the job requirements. SECTION 11: SUBPOENAS: The client is responsible,after notification,for payment of time,charges and expenses resulting from the required response by NORTHERN COLORADO GEOTECH to subpoenas issued by any party other than NORTHERN COLORADO GEOTECH in conjunction with work performed under this contract. Charges are based on fee schedules in affect at the time the subpoena is served. SECTION 12: SEVERABILITY: If any of the provisions contained in this agreement are held illegal,invalid,or unenforceable,the enforceability of the remaining provisions will not be impaired. SECTION 13: TERMINATION: This Agreement may be terminated by either party upon seven(7)days written notice in the event of substantial failure by the other party to perform in accordance with the terms hereof. Such termination shall not be effective If that substantial failure has been remedied before expiration of the period specified In the written notice. In the event of termination,NORTHERN COLORADO GEOTECH shall be paid for services performed to the termination notice dated plus reasonable termination expenses.Expenses of termination or suspension shall include all direct costs of NORTHERN COLORADO GEOTECH required to complete analyses and records necessary to complete it files and may also include a report on the services performed to the date of notice of termination or suspension. SECTION 14: ASSIGNS: Neither the client nor NORTHERN COLORADO GEOTECH may delegate,assign,subvrite or transfer its duties or interest in this agreement without the written consent of the other party. SECTION 15: PRECEDENCE: These Terms and Conditions shall take precedence over any inconsistent or contradictory provisions contained in any proposal,contract, purchase order,requisition,notice to proceed,or like document regarding NORTHERN COLORADO GEOTECH'services.
